E. Other Conditions<br />

XXVI. Working Conditions <strong>of</strong> Supportive Services Assistants,<br />

Parent Assistants and Health Room Technicians<br />

1. A per diem substitute shall be eligible for the same sick leave benefits and<br />

holiday pay as a regular employee when he/she has:<br />

(a) Served at least twenty (20) consecutive days in the place <strong>of</strong> an employee<br />

whose absence is likely to exist for ninety (90) days or more; and<br />

(b) Received a rating <strong>of</strong> satisfactory from the Principal during such twenty<br />

(20) days <strong>of</strong> per diem service.<br />

ArTiCle XXVii<br />

Severability<br />

In the event that any provision <strong>of</strong> this Agreement is or shall at any time be<br />

held to be contrary to law by a court <strong>of</strong> last resort <strong>of</strong> Pennsylvania or <strong>of</strong> the<br />

United States or by a court <strong>of</strong> competent jurisdiction from whose judgment or<br />

decree no appeal has been taken within the time provided for doing so, all other<br />

provisions <strong>of</strong> this Agreement shall continue in effect.<br />

ArTiCle XXViii<br />

Resolution <strong>of</strong> Differences by Peaceful Means<br />

The <strong>Federation</strong> and the <strong>School</strong> <strong>District</strong> agree that differences between the<br />

parties shall be settled by peaceful means as provided in this Agreement. The<br />

<strong>Federation</strong>, in consideration <strong>of</strong> the terms and conditions <strong>of</strong> this Agreement, will<br />

not engage in, instigate or condone any strike, work stoppage or any concerted<br />

refusal to perform normal work duties on the part <strong>of</strong> any employee covered by<br />

this Agreement, and will undertake to exert its best efforts to discourage any<br />

such acts by any such employees.<br />

ArTiCle XXiX<br />

Guarantee Clause<br />

During the term <strong>of</strong> this Agreement, the <strong>School</strong> <strong>District</strong> agrees that it will<br />

appropriate in its annual budget(s) for each year <strong>of</strong> the contract sufficient monies<br />

to provide for, maintain and guarantee without exception each and every<br />

economic provision set forth in this Agreement. The <strong>School</strong> <strong>District</strong> further<br />

agrees that it will not, under any circumstances, unilaterally abrogate any economic<br />

provision <strong>of</strong> this Agreement during its term.<br />

ArTiCle XXX<br />

Duration <strong>of</strong> Agreement<br />

The term <strong>of</strong> this Agreement shall be from September 1, 2009 and shall continue<br />

in full force and effect through August 31, 2012. Either party may give<br />

written notice to its intention to open negotiations for a new Agreement in<br />

accordance with the procedure and time schedule required by law.<br />
