VII. Bargaining Unit Work<br />

B. Programs initiated to utilize subsidies or grants available from agencies<br />

other than the <strong>School</strong> <strong>District</strong> or the Commonwealth <strong>of</strong> Pennsylvania will be<br />

staffed by employees voluntarily transferring to such programs or newly<br />

employed for such programs or provided by a contracting agency other than the<br />

<strong>School</strong> <strong>District</strong>. In any instance in which the applicable law, regulations, guidelines,<br />

contract or grant document covering the operation <strong>of</strong> such program prohibits<br />

the <strong>School</strong> <strong>District</strong> from doing so, the <strong>School</strong> <strong>District</strong> shall not extend the terms<br />

<strong>of</strong> this Agreement to the employees engaged in such programs. Other wise, the<br />

<strong>School</strong> <strong>District</strong> shall extend the terms <strong>of</strong> this Agreement to employees employed<br />

in such programs.<br />

Article Viii<br />

Examinations and Appointments<br />

A. Postings<br />

1. Whenever it is decided during the school year to fill any positions in the<br />

<strong>School</strong> <strong>District</strong> below the rank <strong>of</strong> Regional Superintendent, notice <strong>of</strong> all examinations<br />

as well as the requirements for such positions, shall be posted in advance<br />

in all schools in a prescribed, appropriate place in each school so that applicants<br />

may know whether they qualify and will be given a reasonable oppor tunity to<br />

apply for the position. All positions for which appointment and/or assignment<br />

decisions are made during the summer months will be posted in all schools<br />

which are open, in Regional Offices and in the Administration Building. Copies<br />

<strong>of</strong> such postings shall simultaneously be sent to the <strong>Federation</strong>.<br />

2. Job opportunity flyers and notices <strong>of</strong> grants and special program opportunities<br />

for which employees may apply for participation shall be posted, when<br />

administratively possible, at least three (3) weeks prior to the closing date for<br />

applications. Such material shall carry the date <strong>of</strong> posting and the closing date.<br />

B. examinations<br />

1. There may be a continued involvement <strong>of</strong> department heads in the process<br />

<strong>of</strong> examination <strong>of</strong> teacher candidates and participation and advisement in<br />

the establishment <strong>of</strong> criteria <strong>of</strong> teacher eligibility.<br />

2. Department heads will be informed <strong>of</strong> the opportunity to serve as members<br />

<strong>of</strong> Oral Examining Committees and may be invited to apply for such service.<br />

Opportunities to serve may be distributed equitably among department<br />

heads who desire such service.<br />

3. Unless the oral and/or practical examination is given on the same day as<br />

the written examination, an applicant shall be notified <strong>of</strong> the numerical results<br />

<strong>of</strong> the written portion <strong>of</strong> an examination and the practical portion, if any, before<br />

the oral portion <strong>of</strong> the examination is taken. When practical, all examinations<br />

shall be graded and applicants notified within thirty (30) calendar days.<br />

4. Unless an employee requests otherwise, a recording shall be made <strong>of</strong> every<br />

oral examination taken by an employee. No member <strong>of</strong> the committee giving<br />

the oral examination shall suggest that the employee waive the recording. The<br />
