hundred and fifty-five dollars ($155) per year for each employee covered by this<br />

Agreement payable at the rate <strong>of</strong> seven dollars and seventy-five cents ($7.75)<br />

per employee per pay period for twenty (20) full bi-weekly pay periods each<br />

school year. Effective beginning with the 2011-2012 school year, the <strong>School</strong> <strong>District</strong><br />

shall pay to said Trust Fund one hundred and sixty-five dollars ($165) per<br />

year for each employee covered by this Agreement payable at the rate <strong>of</strong> eight<br />

dollars and twenty-five cents ($8.25) per employee per pay period for twenty<br />

(20) full bi-weekly pay periods each school year.<br />

2. It is further agreed that there shall be established a qualified group legal<br />

services plan <strong>of</strong> which the aforedescribed Trust Fund shall form a part, pursuant<br />

to the provisions <strong>of</strong> Section 120 <strong>of</strong> the United States Internal Revenue Code <strong>of</strong><br />

1954, as amended.<br />

3. The purposes <strong>of</strong> the <strong>Philadelphia</strong> <strong>Federation</strong> <strong>of</strong> <strong>Teachers</strong> Legal Services<br />

shall be to provide for the exclusive benefit <strong>of</strong> employees, their spouses or<br />

dependents’ specified benefits consisting <strong>of</strong> personal legal services through prepayment<br />

<strong>of</strong>, or provision in advance for, legal fees in whole or part. Exclusions<br />

and Limitations <strong>of</strong> the Plan shall include at a minimum matters involving as<br />

adverse parties any <strong>of</strong> the following: the Plan, any Employer or any agent <strong>of</strong> the<br />

Plan or Employer, the Trust or any Trustee.<br />

4. The <strong>Philadelphia</strong> <strong>Federation</strong> <strong>of</strong> <strong>Teachers</strong> Legal Services Trust Fund shall<br />

have such places <strong>of</strong> business as the Trustees in their discretion may from time to<br />

time direct. The <strong>Philadelphia</strong> <strong>Federation</strong> <strong>of</strong> <strong>Teachers</strong> Legal Services Trust Fund<br />

shall be operated in the same manner as the <strong>Philadelphia</strong> <strong>Federation</strong> <strong>of</strong> <strong>Teachers</strong><br />

Health and Welfare Trust Fund by a Board <strong>of</strong> eight (8) Trustees, six (6) <strong>of</strong><br />

whom shall be appointed by the <strong>Federation</strong> and two (2) <strong>of</strong> whom shall be<br />

appointed by the <strong>School</strong> <strong>District</strong> or its designee.<br />

5. All provisions above which are applicable to the <strong>Philadelphia</strong> <strong>Federation</strong><br />

<strong>of</strong> <strong>Teachers</strong> Health and Welfare Trust Fund, with respect to the Trustees’ authority<br />

to establish rules and regulations regarding coverage, amounts <strong>of</strong> benefits,<br />

eligibility, methods <strong>of</strong> providing and/or arranging for the provision <strong>of</strong> benefits,<br />

investments <strong>of</strong> funds and other related matters; to leaves <strong>of</strong> absence for <strong>School</strong><br />

<strong>District</strong> employees working for the Fund, to prorating the payments <strong>of</strong> employees<br />

who cease working for the <strong>School</strong> <strong>District</strong>; to the methods and times <strong>of</strong><br />

payments <strong>of</strong> amounts to the Fund; and to the title <strong>of</strong> the monies paid to the<br />

Fund, shall be fully applicable to the <strong>Philadelphia</strong> <strong>Federation</strong> <strong>of</strong> <strong>Teachers</strong> Legal<br />

Services Trust Fund to the extent permissible under applicable law.<br />

H. career Development<br />

1. The <strong>School</strong> <strong>District</strong> and <strong>Federation</strong> agree to create a Career Development<br />

Fund for the purpose <strong>of</strong> assisting the bargaining unit members in career development.<br />

Towards this end, the <strong>School</strong> <strong>District</strong> shall contribute the sum <strong>of</strong> four<br />

hundred thousand dollars ($400,000) on an annual basis for the purpose <strong>of</strong><br />

tuition reimbursement.<br />

2. The <strong>School</strong> <strong>District</strong> and <strong>Federation</strong> agree to create a Joint Committee<br />

comprised <strong>of</strong> two (2) representatives appointed by the Superintendent and/or<br />

CEO and two (2) representatives appointed from the <strong>Federation</strong> who shall<br />

have the authority to implement and oversee this program.<br />
