Section 2. Overpayments<br />

Management will endeavor to notify the affected employee of an overpayment on the<br />
employee's payroll warrant(s) prior to making any deduction to recover any such<br />
overpayment from the employee's subsequent payroll warrant(s). Upon request by the<br />
affected employee Management will establish a reasonable method of repayment.<br />
<strong>County</strong> agrees to determine the feasibility of having an affected employee repay an<br />
overpayment with accumulated benefits that the employee would be entitled to at<br />
termination of employment. <strong>County</strong> agrees to consult with the Union on this issue within<br />
ninety (90) days after implementation of this MOU, in accordance with the Employee<br />
Relations Ordinance (5.04.090(A)).<br />
Recovery of more than fifteen percent (15%) of net pay will be subject to a repayment<br />
schedule established by the appointing authority under guidelines issued by the Auditor-<br />
Controller. Such recovery shall not exceed fifteen percent (15%) per month of disposable<br />
income (as defined by State law), except, however, that a mutually agreed-upon<br />
acceleration provision may permit faster recovery.<br />
Section 3. Grievances<br />
Any grievances regarding this Article shall be processed beginning with level three (3) of<br />
the Grievance Procedure.
