streng<strong>the</strong>n<strong>in</strong>g <strong>the</strong> legitimacy of dutch eu policy: conclusions and recommendations<br />
proposed (most recently by <strong>the</strong> Council of <strong>St</strong>ate) that <strong>the</strong> political primacy<br />
for Dutch eu policy be transferred from <strong>the</strong> M<strong>in</strong>istry of Foreign Affairs to<br />
a position closer to <strong>the</strong> Prime M<strong>in</strong>ister, namely <strong>the</strong> M<strong>in</strong>istry of General<br />
Affairs. Undoubtedly <strong>the</strong>re are all manner of practical objections to such<br />
a suggestion which deserve serious attention, but <strong>the</strong> underly<strong>in</strong>g message<br />
is crucial: eu policy is an <strong>in</strong>tegral part of general government policy and<br />
<strong>the</strong>refore fits <strong>in</strong> with <strong>the</strong> special responsibilities of <strong>the</strong> Prime M<strong>in</strong>ister.<br />
However, this would do little to underm<strong>in</strong>e <strong>the</strong> responsibility of <strong>in</strong>dividual<br />
m<strong>in</strong>isters and junior m<strong>in</strong>isters regard<strong>in</strong>g <strong>the</strong> <strong>Europe</strong>an dimension of <strong>the</strong>ir<br />
specific policy doma<strong>in</strong>s.<br />
<strong>St</strong>eps <strong>in</strong> this direction could be taken relatively quickly by allow<strong>in</strong>g <strong>the</strong><br />
Prime M<strong>in</strong>ister to take on a greater strategic role <strong>in</strong> <strong>the</strong> present Cab<strong>in</strong>et<br />
subcommittee currently responsible for <strong>Europe</strong>an affairs (known as <strong>the</strong><br />
reiz-ea). In <strong>the</strong> longer term, a reconfiguration of Cab<strong>in</strong>et responsibilities<br />
could be <strong>in</strong>troduced that would be more <strong>in</strong> harmony with <strong>the</strong> preparation,<br />
implementation and monitor<strong>in</strong>g of <strong>the</strong> consistency of <strong>the</strong> ma<strong>in</strong> strategic<br />
l<strong>in</strong>es of government policy <strong>in</strong> relation to <strong>the</strong> eu. As chairman of <strong>the</strong><br />
Cab<strong>in</strong>et, <strong>the</strong> Prime M<strong>in</strong>ister could <strong>the</strong>n focus on <strong>the</strong> effective and energetic<br />
promotion of <strong>the</strong> ma<strong>in</strong> l<strong>in</strong>es of eu policy <strong>in</strong> <strong>the</strong> Ne<strong>the</strong>rlands. The government<br />
would <strong>the</strong>n be giv<strong>in</strong>g a clear signal to citizens, civil society organisations<br />
and <strong>the</strong> news media that <strong>the</strong> eu no longer belongs to foreign affairs<br />
but to <strong>the</strong> <strong>in</strong>ternal affairs of <strong>the</strong> Ne<strong>the</strong>rlands, and derives its legitimacy <strong>in</strong><br />
part from Dutch political channels of representation and accountability.<br />

7.3.3 preferenda<br />
Plebiscites <strong>in</strong> which citizens have more options than a simple ‘yes’ or ‘no’<br />
vote (‘preferenda’) on eu issues may improve <strong>the</strong> political legitimisation<br />
process. There is no <strong>in</strong>strument more powerful for turn<strong>in</strong>g <strong>the</strong> legitimisation<br />
of eu policy <strong>in</strong>to a public matter than a plebiscite. Given <strong>the</strong> persistence<br />
of <strong>the</strong> problems, an <strong>in</strong>strument as drastic as a plebiscite may <strong>the</strong>refore<br />
be justified. Moreover, plebiscites <strong>in</strong> <strong>the</strong> form of preferenda so that citizens<br />
can choose between a number of alternative proposals may circumvent<br />
some of <strong>the</strong> disadvantages of referenda.<br />
Both citizens and politicians could be stimulated to position <strong>the</strong>mselves on<br />
a <strong>Europe</strong>an issue, and as a result, both could end up hav<strong>in</strong>g an <strong>in</strong>fluence on<br />
<strong>the</strong> decision-mak<strong>in</strong>g process. If this <strong>in</strong>strument is categorically rejected,<br />
<strong>the</strong>re is a real risk that <strong>the</strong> legitimisation of eu policy will rema<strong>in</strong> trapped<br />
<strong>in</strong> a technical process, managed by specialists, <strong>in</strong> which <strong>the</strong>re is no role for<br />
ei<strong>the</strong>r politicians or Dutch citizens. Moreover, <strong>the</strong> public has ‘tasted’ this<br />
form of direct participation dur<strong>in</strong>g <strong>the</strong> referendum on <strong>the</strong> Constitutional
