than contribut<strong>in</strong>g to that legitimisation. The question <strong>in</strong> <strong>the</strong> context of this<br />

chapter should <strong>the</strong>refore be to what extent safeguards can offer suitable<br />

remedies. Therefore, safeguards are here def<strong>in</strong>ed as checks and balances<br />

which enable national politicians and adm<strong>in</strong>istrators to contribute to <strong>the</strong><br />

legitimisation of eu policy <strong>in</strong> <strong>the</strong> Ne<strong>the</strong>rlands.<br />

Horizontal safeguards at <strong>the</strong> <strong>Europe</strong>an level fall outside <strong>the</strong> scope of this<br />

def<strong>in</strong>ition, s<strong>in</strong>ce <strong>the</strong>y do not contribute to improv<strong>in</strong>g <strong>the</strong> role of <strong>the</strong><br />

national adm<strong>in</strong>istration and national politicians <strong>in</strong> <strong>the</strong> legitimisation of eu<br />

policy <strong>in</strong> <strong>the</strong> Ne<strong>the</strong>rlands.<br />

In <strong>the</strong> forego<strong>in</strong>g, <strong>the</strong> examples thus far used have ma<strong>in</strong>ly related to hard,<br />

legally b<strong>in</strong>d<strong>in</strong>g or even constitutionally embedded safeguards; however,<br />

less mandatory safeguards, not necessarily anchored <strong>in</strong> <strong>the</strong> law, are also<br />

relevant. The ‘red l<strong>in</strong>es’ <strong>in</strong>troduced by uk Prime M<strong>in</strong>ister Tony Blair at <strong>the</strong><br />

time of <strong>the</strong> discussion on <strong>the</strong> <strong>Europe</strong>an Convention provide a good example.<br />

The subsidiarity pr<strong>in</strong>ciple, which only has political significance and<br />

cannot be legally enforced, is ano<strong>the</strong>r example of such a safeguard.<br />

4.2.2 <strong>the</strong> ne<strong>the</strong>rlands and safeguards<br />

The Ne<strong>the</strong>rlands has an established tradition of emphasis<strong>in</strong>g safeguards at<br />

<strong>the</strong> eu level. When it comes to <strong>in</strong>stitutional safeguards, <strong>the</strong> Dutch position<br />

has traditionally been that <strong>Europe</strong>an co-operation must be based on <strong>the</strong><br />

‘Community method’. This means that <strong>the</strong> Commission was assigned a<br />

key role <strong>in</strong> <strong>in</strong>itiat<strong>in</strong>g policy and that <strong>the</strong> <strong>Europe</strong>an Court of Justice had an<br />

<strong>in</strong>dependent role <strong>in</strong> apply<strong>in</strong>g and enforc<strong>in</strong>g <strong>Europe</strong>an law. For this reason,<br />

<strong>the</strong> Ne<strong>the</strong>rlands was not a supporter of national veto rights and flexible<br />

forms of co-operation, <strong>in</strong> which certa<strong>in</strong> countries could opt out (or participate<br />

only under certa<strong>in</strong> conditions) of specific forms of <strong>Europe</strong>an co-operation<br />

(e.g., Denmark, <strong>the</strong> uk and Ireland <strong>in</strong> Justice and Home Affairs).<br />

Accord<strong>in</strong>g to <strong>the</strong> Dutch view, <strong>the</strong>se practices could jeopardise <strong>the</strong> substantive<br />

safeguards <strong>in</strong> relation to <strong>the</strong> <strong>in</strong>ternal market. These safeguards rema<strong>in</strong><br />

extremely important to <strong>the</strong> Ne<strong>the</strong>rlands. Safeguards are thus closely<br />

related to specific views on <strong>Europe</strong>an co-operation. If <strong>the</strong> eu is viewed as<br />

a legal community, for example, <strong>the</strong> emphasis will be on safeguards for<br />

parliamentary and judicial scrut<strong>in</strong>y. In <strong>the</strong> past, <strong>the</strong> comb<strong>in</strong>ation of<br />

substantive and <strong>in</strong>stitutional safeguards created a balance at <strong>the</strong> <strong>Europe</strong>an<br />

level which matched Dutch wishes and needs. As a result, little attention<br />

was paid to o<strong>the</strong>r types of safeguards.<br />

This has changed <strong>in</strong> recent years. In <strong>the</strong> first place, <strong>the</strong> substantive safeguards<br />

of <strong>the</strong> eu <strong>in</strong> relation to <strong>the</strong> <strong>in</strong>ternal market have become more
