In o<strong>the</strong>r words, <strong>the</strong> social context <strong>in</strong> which politicians act is also an<br />

important factor (Weber 1976).<br />

Red l<strong>in</strong>es are well suited to political views <strong>in</strong>volv<strong>in</strong>g a positive approach<br />

toward <strong>Europe</strong>an co-operation, whilst at <strong>the</strong> same time, <strong>the</strong> need for<br />

certa<strong>in</strong> limits is acknowledged. Red l<strong>in</strong><strong>in</strong>g may thus highlight <strong>the</strong> relevant<br />

differences <strong>in</strong> views between political parties. For example, parties that<br />

emphasise <strong>in</strong>dividual freedoms may formulate red l<strong>in</strong>es to protect Dutch<br />

legislation and practices on issues such as euthanasia, abortion, soft drugs<br />

and <strong>the</strong> rights of homosexuals, whereas o<strong>the</strong>r parties may be less troubled<br />

if <strong>the</strong>se issues were to become <strong>the</strong> focus of debate as a result of <strong>Europe</strong>an<br />

<strong>in</strong>itiatives.<br />

Conclud<strong>in</strong>g remarks<br />

Two safeguards have been discussed <strong>in</strong> this section which operate <strong>in</strong> <strong>the</strong><br />

vertical relationship between <strong>the</strong> eu and <strong>the</strong> <strong>in</strong>dividual member states.<br />

Obviously, this is not an exhaustive elaboration of all of <strong>the</strong> possible safeguards<br />

of this type. Veto rights, <strong>the</strong> attribution pr<strong>in</strong>ciple (whereby <strong>the</strong> eu<br />

only has those powers which <strong>the</strong> member states have explicitly conferred<br />

upon it) and <strong>the</strong> ‘competence catalogue’ are o<strong>the</strong>r salient examples.<br />

However, <strong>the</strong> two examples cited do provide good <strong>in</strong>sight <strong>in</strong>to <strong>the</strong> potential<br />

and <strong>the</strong> risks. Although <strong>the</strong>se k<strong>in</strong>ds of safeguards may offer opportunities<br />

for Dutch politicians to improve <strong>the</strong> legitimisation of eu policy <strong>in</strong> <strong>the</strong><br />

Ne<strong>the</strong>rlands, <strong>the</strong> follow<strong>in</strong>g aspects must also be taken <strong>in</strong>to account. Firstly,<br />

<strong>the</strong>se safeguards apply to <strong>the</strong> relationship between <strong>the</strong> eu and member<br />

states. This provides no guarantee, however, that citizens will actually<br />

be <strong>in</strong>volved. Much of this depends on <strong>the</strong> way <strong>the</strong> safeguards are applied.<br />

Secondly, safeguards of this k<strong>in</strong>d – if <strong>the</strong>y are applied by national politicians<br />

– are of a defensive nature and <strong>the</strong>refore fit <strong>in</strong> primarily with political<br />

views which highlight <strong>the</strong> defensive aspect. Clear demarcation l<strong>in</strong>es may<br />

contribute to <strong>the</strong> genu<strong>in</strong>e legitimacy of eu policy <strong>in</strong> <strong>the</strong> Ne<strong>the</strong>rlands <strong>in</strong><br />

some respects, but it also requires a clear view of what eu actions are actually<br />

desirable. Moreover, social and political problems are often not tackled<br />

simply by choos<strong>in</strong>g between <strong>Europe</strong> and <strong>the</strong> member state; <strong>in</strong>stead, <strong>the</strong>y<br />

<strong>in</strong>volve more <strong>in</strong>tricate choices from a much richer ‘policy menu’. The<br />

substantive choices that have to be made could disappear <strong>in</strong>to <strong>the</strong> background<br />

by emphasis<strong>in</strong>g <strong>the</strong> choice between ‘<strong>the</strong> Ne<strong>the</strong>rlands’ and ‘<strong>Europe</strong>’.<br />

4.2.4 safeguards with<strong>in</strong> <strong>the</strong> ne<strong>the</strong>rlands<br />

As observed <strong>in</strong> section 4.2.2, <strong>the</strong> Ne<strong>the</strong>rlands has never paid much attention<br />

to horizontal safeguards. O<strong>the</strong>r countries have established safeguards
