and Council of M<strong>in</strong>isters) and <strong>the</strong> <strong>in</strong>dependent <strong>Europe</strong>an Court of Justice.<br />

However, not only <strong>in</strong>stitutional but also substantive safeguards are relevant.<br />

At <strong>the</strong> <strong>Europe</strong>an level, for <strong>in</strong>stance, <strong>the</strong>se <strong>in</strong>clude <strong>the</strong> safeguards<br />

enshr<strong>in</strong>ed <strong>in</strong> treaties relat<strong>in</strong>g to <strong>the</strong> <strong>in</strong>ternal market (<strong>the</strong> four freedoms) to<br />

which <strong>the</strong> actions of <strong>the</strong> eu must be geared.<br />

In addition to such ‘horizontal’ safeguards at <strong>the</strong> <strong>Europe</strong>an level, ‘vertical’<br />

safeguards function <strong>in</strong> <strong>the</strong> relationship between <strong>the</strong> eu and <strong>the</strong> member<br />

states. Examples are <strong>the</strong> ‘competence catalogue’ (Kompetenz-Katalog),<br />

national vetoes and subsidiarity. However, <strong>Europe</strong>an <strong>in</strong>tegration also has<br />

consequences for <strong>the</strong> separation of powers with<strong>in</strong> member states. In most<br />

member states, a shift has taken place whereby <strong>the</strong> executive power has<br />

acquired more power, largely at <strong>the</strong> expense of national parliaments.<br />

This development is <strong>in</strong> fact not limited to eu policy, although it manifests<br />

itself prom<strong>in</strong>ently <strong>in</strong> that doma<strong>in</strong>. In several countries this shift has led to<br />

<strong>the</strong> <strong>in</strong>troduction of correction mechanisms aimed at preserv<strong>in</strong>g or restor<strong>in</strong>g<br />

<strong>the</strong> balance between government and Parliament. The most strik<strong>in</strong>g<br />

example <strong>in</strong> this regard is <strong>the</strong> parliamentary mandate to which <strong>the</strong> Danish<br />

government is bound <strong>in</strong> its decision mak<strong>in</strong>g on eu policy (Van den Br<strong>in</strong>k<br />

2004).<br />

The last type of safeguards <strong>in</strong>volves <strong>the</strong> citizens. Based on <strong>the</strong> doctr<strong>in</strong>e of<br />

direct effect, <strong>in</strong>dividuals may seek recourse <strong>in</strong> national courts to enforce<br />

compliance with <strong>Europe</strong>an law, <strong>in</strong> both horizontal (i.e., with regard to<br />

o<strong>the</strong>r citizens and bus<strong>in</strong>esses) and vertical (i.e., vis-à-vis <strong>the</strong> national<br />

government) relationships. <strong>Europe</strong>an law itself already offers an elaborated<br />

framework for this. The judiciary can consequently provide a substantial<br />

counterweight to <strong>the</strong> grow<strong>in</strong>g power of <strong>the</strong> adm<strong>in</strong>istrative branch,<br />

provided citizens are sufficiently aware of <strong>the</strong> possibility of this aspect.<br />

Safeguards thus have a protective function <strong>in</strong> <strong>the</strong> context of <strong>Europe</strong>an cooperation.<br />

However, it is not just <strong>the</strong> protection of <strong>the</strong> <strong>in</strong>dividual aga<strong>in</strong>st<br />

national and <strong>Europe</strong>an adm<strong>in</strong>istrative <strong>in</strong>stitutions that is at stake, but <strong>the</strong><br />

protection mechanisms available with<strong>in</strong> and between <strong>the</strong>se levels are just<br />

as relevant. By <strong>the</strong>ir very nature, safeguards are reciprocal <strong>in</strong> <strong>the</strong>ir application.<br />

The subsidiarity pr<strong>in</strong>ciple provides a good illustration <strong>in</strong> this respect;<br />

not only does it offer protection to <strong>the</strong> member states aga<strong>in</strong>st unbridled<br />

<strong>in</strong>tervention by <strong>the</strong> eu, but it also provides a guarantee that decisions will<br />

be taken at <strong>the</strong> Community level if <strong>the</strong> eu is <strong>in</strong> a better position to take<br />

those decisions than <strong>the</strong> <strong>in</strong>dividual member states.<br />
