G. NOTIFICATION OF RESULTS OF RECERTIFICATIONS [HUD Notice<br />

PIH 98-6]<br />

The HUD Form 50058 will be completed and transmitted as required by HUD.<br />

The Notice of Rent Change is mailed to the owner and the tenant. Signatures are not required by<br />

the PHA. If the family disagrees with the rent adjustment, they may request an informal hearing.<br />

H. TIMELY REPORTING OF CHANGES IN INCOME (AND ASSETS) [24<br />

CFR 982.516(c)]<br />

Standard for Timely Reporting of Changes<br />

The PHA requires that families report certain changes to the PHA within 30 days of when the<br />

change occurs. (See “Interim Reexamination Policy.”) In such cases, the family will be issued<br />

an interim re-examination packet. Zero income families who become employed or gain any type<br />

of income must report the income within 30 days from the date of notification of the income<br />

received or date of hire, whichever comes first.<br />

If the change is not reported within the required time period, or if the family fails to provide<br />

documentation or signatures, it will be considered untimely reporting.<br />

Procedures when the Change is reported in a Timely Manner<br />

The PHA will notify the family and the owner of any change in the <strong>Housing</strong> Assistance Payment<br />

to be effective according to the following guidelines:<br />

Increases in the Tenant Rent are effective on the first of the month following a thirty-day<br />

notice.<br />

Decreases in the Tenant Rent are effective the first of the month following the month in<br />

which the change occurred.<br />

Effective dates may need to be implemented retroactively because of the verification<br />

process described herein.<br />

Procedures when the Change is Not Reported by the Family in a Timely Manner<br />

If the family does not report the change as described under Timely Reporting, the family will<br />

have caused an unreasonable delay in the interim reexamination processing and the following<br />

guidelines will apply:<br />

Increase in Tenant Rent will be effective retroactive to the date it would have been<br />

effective had it been reported on a timely basis. The family will be liable for any overpaid<br />

housing assistance and may be required to sign a Payment Agreement or make a lump<br />

sum payment.<br />

Decreases in Tenant Rent will be effective on the first of the month following the month<br />

in which the family reported the change.<br />

Procedure when the Change is Not Processed by the PHA in a Timely Manner<br />

The PHA will not delay the processing more than is required by the verification process<br />

described in Chapter 7.<br />
