2. Mover Briefings<br />

Briefings are conducted for families currently participating in the <strong>HCVP</strong> Program who wish to<br />

move. The purpose of these briefings is to update families on changes in the program and to<br />

assist families at successfully moving with assistance.<br />

The PHA will complete a criminal background check on all adult family members age 18 and<br />

over at the time a move is requested. The PHA may deny assistance to move or terminate<br />

program assistance if any family member engaged in criminal or drug related activity as<br />

described in 982.551, 982.552 or 982.553; or has engaged in other related program violations. In<br />

conducting criminal background checks on families who move, checks will only be conducted<br />

from the date of the family’s admission to the program or after. The PHA will not consider the<br />

time period previously reviewed in its admission determination for the household. In addition, in<br />

conducting the criminal background check, the PHA will not consider a time period in excess of<br />

three years for:<br />

a) Drug related criminal activity;<br />

b) Other criminal activity which may threaten the health, safety, or right to peaceful<br />

enjoyment of the premises by other residents or persons residing in the immediate<br />

vicinity;<br />

c) Other criminal activity which may threaten the health or safety of the owner, property<br />

management staff, or persons performing a contract administration function or<br />

responsibility on behalf of the PHA, including a PHA employee or PHA contractor,<br />

subcontractor or agent; or<br />

d) For three years for violent criminal activity. The PHA only considers felony level<br />

criminal activity unless otherwise required by the CFR.<br />

Briefing Packet [24 CFR 982.301(b)]<br />

The documents and information provided in the briefing packet for the voucher program will<br />

comply with all HUD requirements.<br />

When the PHA selects a family to participate in a tenant-based or project-based program, the<br />

PHA must give the family an oral briefing.<br />

The briefing must include information on the following subjects:<br />

A description of how the program works;<br />

Family and owner responsibilities; and<br />

Where the family may lease a unit, including renting a dwelling unit inside or outside the<br />

PHA jurisdiction.<br />

For a family that qualifies to lease a unit outside the PHA jurisdiction under portability<br />

procedures, the briefing must include an explanation of how portability works. The PHA<br />

may not discourage the family from choosing to live anywhere in the PHA jurisdiction,<br />

or outside the PHA jurisdiction under portability procedures.<br />

If the family is currently living in a high poverty census tract in the PHA's jurisdiction,<br />

the briefing must also explain the advantages of moving to an area that does not have a<br />

high concentration of poor families.<br />
