Submit a PHA Vacancy Claim Request Form no sooner than the last day of the month<br />
following the move-out date. The Vacancy Claim Request Form will be accepted for 14<br />
calendar days from the move out date.<br />
If a unit remains vacant for more than 120 days from the day on which the vacancy notification<br />
is received, the PHA will remove it from the PBV contract.<br />
Participant Rights and Responsibilities<br />
Admission, tenant rent contributions, tenancy, annual reexaminations, and <strong>Housing</strong> Quality<br />
Standards and policies for participants will be governed by 24 CFR Parts 982, 983 and this<br />
<strong>Admin</strong>istrative <strong>Plan</strong>.<br />
All families living in units under a PBV contract and the PHA must sign a Statement of Family<br />
Responsibility. The Statement of Family Responsibility must contain all family obligations<br />
including the family’s participation in a supportive services plan if applicable.<br />
Voucher issuance and portability are restricted while the family participates in the project-based<br />
voucher program. Tenants that wish to vacate the property may request a voucher to convert to<br />
the tenant-based program after residing in the project-based unit for at least one year.<br />
If a voucher is not available, the family receives priority for the next available voucher.<br />
The family must give the owner advance written notice (in accordance with the terms of the<br />
lease) of intent to vacate. If the family terminates the assisted lease before the end of one year, it<br />
relinquishes the opportunity for the continued tenant-based assistance at that time. Voucher<br />
holders must comply with HUD’s list of family obligations and <strong>Admin</strong>istrative <strong>Plan</strong><br />
requirements.<br />
The PHA will annually monitor the excepted family’s continued participation in the supportive<br />
services plan at the family’s annual recertification. The PHA will require case management<br />
reports from the property owner indicating the family’s continued compliance with the terms of<br />
the supportive services plan. At the PHA’s discretion, it may request additional documentation<br />
of compliance with supportive service obligations.<br />
Owner Responsibilities<br />
The owner is responsible for performing all of the owner responsibilities as identified in 24 CFR<br />
Part 982.452 and in Part 983, including but not limited to unit maintenance and operation,<br />
applicant screening and lease enforcement.<br />
PHA Responsibilities<br />
The PHA will comply with applicable HUD and <strong>CMHA</strong> regulations and policies. If <strong>CMHA</strong>owned<br />
units are selected for project-based voucher assistance, a HUD field office review of the<br />
