Program Fraud Families, owners or other interested parties who owe money to the PHA due to program fraud will be required to repay in accordance with the guidelines in the Payment Agreement section of this chapter. If a family, owner or other interested party owes an amount as a result of program fraud, the case may be referred to the Inspector General. Where appropriate, the PHA may refer the case for criminal prosecution. E. GUIDELINES FOR REPAYMENT AGREEMENTS [24 CFR 792.103] Repayment agreements will be executed between the PHA and the family head of household and/or spouse. Repayment agreements are offered at the discretion of the PHA. The repayment agreement must be executed by a Manager or his/her designee. Payments may only be made by money order or check. The agreement will be in default when a payment is not made by the due date. The family may be proposed for termination unless the PHA receives the late payment within 10 business days of the termination notice. Monthly payments may be decreased in cases of family hardship and if requested with reasonable notice from the family, verification of the hardship, and the approval of a Manager or his/her designee. The family is given the opportunity to repay the overpayment. OWNER DEBTS TO THE PHA [24 CFR 982.453(b)] If the PHA determines that the owner has retained housing assistance or claim payments the owner is not entitled to, the PHA may reclaim the amounts from future Housing Assistance Payments or claim payments owed the owner for any units under contract. If future Housing Assistance Payments or claim payments are insufficient to reclaim the amounts owed, the PHA may: Require the owner to pay the amount in full within 30 days. Pursue collections through the local court system. Restrict the owner from future participation. G. WRITING OFF DEBTS Refer to Office of the Inspector General Debts may be written off if: The debtor's whereabouts are unknown and the debt is more than one year-old.
