Mixed Families. A family is eligible for assistance as long as at least one member is a citizen or<br />

eligible immigrant. Families that include eligible and ineligible individuals are called "mixed."<br />

Such applicant families will be given notice that their assistance will be pro-rated and that they<br />

may request a hearing if they contest this determination.<br />

All members ineligible. Applicant families that include no eligible members are ineligible for<br />

assistance. Such families will be denied admission and offered an opportunity for an informal<br />

hearing.<br />

Non-citizen students. Defined by HUD in the non-citizen regulations at 24 CFR 5.522. Not<br />

eligible for assistance.<br />

Appeals. For this eligibility requirement only, the applicant is entitled to a hearing exactly like<br />

those provided for participants.<br />

Verification of Status Before Admission<br />

The PHA will not provide assistance to families prior to the verification of eligibility for the<br />

individual or at least one member of the family pursuant to this section.<br />

G. OTHER CRITERIA FOR ADMISSIONS [24 CFR 982.552(a)(b)(c)(e), 24<br />

CFR 982.553(a)]<br />

A PHA may deny assistance for an applicant under the program because of the family’s action or<br />

failure to act.<br />

Denial of assistance for an applicant may include any or all of the following: denying listing on<br />

the PHA waiting list, denying or withdrawing a voucher, refusing to enter into a HAP contract or<br />

approve a lease, and refusing to process or provide assistance under portability procedures.<br />

The PHA must deny admission to the program for an applicant, or terminate program assistance<br />

for a participant, if any member of the family fails to sign and submit consent forms for<br />

obtaining information in accordance with 24 CFR part 5, subparts B and F of the HUD<br />

regulations.<br />

The family must submit required evidence of citizenship or eligible immigration status.<br />

Denial of Admission<br />

The PHA only considers felony level criminal activity unless otherwise required in the CFR.<br />

The PHA may deny assistance for an applicant if any adult family member does not clear the<br />

criminal background check.<br />
