How to find a home, including information about Homeownership opportunities, schools,<br />

and transportation in the PHA jurisdiction;<br />

Advantages of purchasing a home in an area that does not have a high concentration of<br />

low-income families and how to locate homes in such areas;<br />

Information about the Real Estate Settlement Procedures Act (RESPA), State and Federal<br />

truth-in-lending laws, and how to identify and avoid loans with oppressive terms and<br />

conditions;<br />

Fair <strong>Housing</strong> laws.<br />

Families shall attend one post purchase-counseling sessions within the first year of<br />

homeownership.<br />

Eligible Units [24 CFR 982.628]<br />

The unit must meet all of the following requirements:<br />

The unit must meet HUD’s “Eligible <strong>Housing</strong>” requirements. The unit may not be any of<br />

the following:<br />

o A public housing or Indian housing unit;<br />

o A unit receiving <strong>HCVP</strong> project-based assistance;<br />

o A nursing home, board and care home, or facility providing continual psychiatric,<br />

medical, or nursing services.<br />

o A college or other school dormitory;<br />

o On the grounds of penal, reformatory, medical, mental, or similar public or<br />

private institutions.<br />

o The unit is a manufactured home where both the home and land are purchased by<br />

the participant.<br />

o Families may enter into contracts of sale for units not yet under construction at the<br />

time the family enters into the contract for sale. However, the PHA shall not<br />

commence homeownership assistance for the family for that unit, unless and until<br />

1.) The responsible entity completed the environmental review procedures<br />

required by 24 CFR part 58, and HUD approved the environmental certification<br />

and request for release of funds prior to the commencement of construction; or 2.)<br />

HUD performed an environmental review under 24 CFR part 50 and notified the<br />

PHA in writing of environmental approval of the site prior to commencement of<br />

construction. In addition, the PHA shall not commence homeownership<br />

assistance unless and until construction of the unit has been completed and the<br />

unit has passed the required HQS inspection and independent inspection.<br />

o The unit is a one-unit property or a single dwelling unit in a cooperative or<br />

condominium.<br />

o The unit has been inspected by the PHA and by an independent inspector<br />

designated by the family. The PHA inspection shall occur prior to the<br />

independent inspection.<br />
