Restrictions on Portability<br />

Applicants<br />

If neither the head nor spouse had a domicile (legal residence) in the PHA's jurisdiction at the<br />

date of their initial application for assistance, the family will not be permitted to exercise<br />

portability upon initial issuance of a voucher, unless the PHA approves such a move.<br />

For a portable family that was not already receiving assistance in the PHA's based program, the<br />

PHA must determine whether the family is eligible for admission under the receiving PHA's<br />

program.<br />

Participants<br />

The PHA will not permit families to exercise portability:<br />

If the family is in violation of a family obligation.<br />

If the family owes money to the PHA.<br />

If the family has moved out of its assisted unit in violation of the lease.<br />

Receiving PHA's will be required to submit hearing determinations to the PHA within 30 days.<br />

Special Circumstances<br />

A family may receive a voucher from a public housing agency and move to another jurisdiction<br />

under the tenant-based assistance program if the family has complied with all other obligations<br />

of the <strong>Housing</strong> Choice Voucher Program and has moved out of the assisted dwelling unit in<br />

order to protect the health or safety of an individual who is or has been the victim of domestic<br />

violence, dating violence, or stalking and who reasonably believed he or she was imminently<br />

threatened by harm from further violence if he or she remained in the assisted dwelling unit.<br />

G. INCOMING PORTABILITY [24 CFR 982.354, 982.355]<br />

Absorption or <strong>Admin</strong>istration<br />

If <strong>CMHA</strong> does not absorb the incoming family, it will administer the voucher and bill the initial<br />

PHA accordingly.<br />

When <strong>CMHA</strong> absorbs the incoming family, it will notify the initial PHA that it can reissue its<br />

voucher to a new family. The family becomes a <strong>CMHA</strong> participant.<br />

Income and Total Tenant Payment of Incoming Portables [982.353(d)]<br />

If the family's income is such that a $0 subsidy amount is determined prior to lease-up in the<br />

receiving PHA's jurisdiction, the PHA will refuse to enter into a contract on behalf of the family<br />

at $0 assistance.<br />

Requests for Approval of Tenancy<br />

When the family submits a Request for Tenancy Approval, it will be processed using the<br />

receiving PHA's policies. If the family does not submit a Request for Approval of Tenancy or<br />

does not execute a lease, the receiving PHA will notify the initial PHA within 30 days.<br />
