A student (other than the head of household or spouse) who attends school away from<br />

home but lives with the family during the school recesses may, at the choice of the<br />

family, be considered either temporarily or permanently absent. If the family decides that<br />

the member is permanently absent, income of that member will not be included in total<br />

household income, the member will not be included in the lease, and the member will not<br />

be included for determination of voucher size. (See page 5-2.)<br />

If the student family member resides with the family 183 days per year or more, the<br />

family member must be considered temporarily absent when away at school, the member<br />

must be included on the lease and the member must be included for determination of the<br />

voucher size. (See page 5-2.)<br />

A family caretaker resident in the dwelling unit, as a result of permanent absence of the<br />

head of household and spouse, and approved by <strong>CMHA</strong>, will maintain a status of a<br />

temporary caretaker, and income of the temporary caretaker will not be counted for a<br />

period not to exceed 180 days.<br />

If by the end of that period, court-awarded custody or legal guardianship has been<br />

awarded to the caretaker, the Voucher will be transferred to the caretaker if s/he meets<br />

<strong>HCVP</strong> eligibility requirements.<br />

If custody or legal guardianship has not been awarded by the court, but the action is in<br />

process, the PHA will secure verification from social services staff or the attorney as to<br />

the status.<br />

The PHA will transfer the voucher to the caretaker, in the absence of a court order, if the<br />

caretaker has been in the unit for more than 180 days and it is reasonable to expect that<br />

custody will be granted.<br />

Upon court awarded custody, when the PHA approves a person to reside in the unit as the<br />

permanent caretaker for the child/ren, the income should be counted. The PHA will work<br />

with the appropriate agencies and the landlord to provide a smooth transition in these<br />

cases.<br />

If the family includes a child or children temporarily absent from the home due to<br />

placement in foster care, the PHA will determine from the appropriate agency when the<br />

child/children will be returned to the home. If the time period is to be greater than 12<br />

months from the date of removal of the child/ren, the voucher size will be reduced. If all<br />

children are removed from the home permanently, the voucher size will be reduced in<br />

accordance with the PHA’s subsidy standards. On a case-by-case basis, custody or<br />

guardianship may include a minor child residing with an adult member of the household<br />

pursuant to the written permission of a minor child’s parent or legal custodian. The head<br />

of household must report, within 30 days from the date of removal, the absence of minor<br />
