G. ZERO ($0) ASSISTANCE TENANCIES<br />

This section applies only to tenant based vouchers:<br />

When family income reaches a level where no <strong>Housing</strong> Assistance Payments (HAP) are<br />

required, both the HAP contract and the <strong>HCVP</strong> voucher lease remain in effect, and the family<br />

continues to be a participant in the <strong>HCVP</strong> voucher program for a maximum of 180 days. During<br />

this time, the family is responsible for the full amount of rent to the owner. If the family is still<br />

in the unit after 180 days, and if there has been no change in circumstance causing HAP<br />

payments to resume, the participant will be withdrawn. If, within the 180-day time frame, an<br />

owner rent increase or a decrease in the Total Tenant Payment causes the family to be eligible<br />

for a <strong>Housing</strong> Assistance Payment, the PHA will resume assistance payments for the family.<br />

After 120 days at zero HAP, the client will be given written notice including:<br />

1) A description of the one hundred and eighty-day (180) rule;<br />

2) The family’s status relative to the one hundred and eighty-day rule;<br />

3) The options available to the family to continue participation in the <strong>HCVP</strong> Voucher<br />

Program; and<br />

4) The family’s opportunity to meet with <strong>CMHA</strong> to discuss these options.<br />

In order for a family to move to another unit during the 180 days, the family would have had to<br />

reside in the unit for one year, complete its current lease term and the rent for the new unit<br />

would have to be high enough to necessitate a <strong>Housing</strong> Assistance Payment.<br />

H. OPTION NOT TO TERMINATE FOR MISREPRESENTATION [24 CFR<br />

982.551, 982.552(c)]<br />

If the family has misrepresented any facts that caused the PHA to overpay assistance, the PHA<br />

may choose not to terminate and may offer to continue assistance provided that the family<br />

executes a Repayment Agreement and makes payments in accordance with the agreement or<br />

reimburses the PHA in full according to the requirements of the PHA. Repayment agreements<br />

are offered at the discretion of the PHA.<br />

I. MISREPRESENTATION IN COLLUSION WITH OWNER [24 CFR<br />

982.551, 982.552 (c)]<br />

If the family intentionally, willingly, and knowingly commits fraud or is involved in any other<br />

illegal scheme with the owner, the PHA may deny or terminate assistance.<br />

J. MISSED APPOINTMENTS AND DEADLINES [24 CFR 982.551, 982.552<br />

(c)]<br />

It is a Family Obligation to supply information, documentation, and certification as needed for<br />

the PHA to fulfill its responsibilities. The PHA schedules appointments and sets deadlines in<br />
