income. Therefore, for disabled families entitled to the earned income disallowance, the<br />

amounts of the full and phase-in exclusions from income shall not be used in determining the cap<br />

for childcare deductions.<br />

Tracking the Earned Income Exclusion<br />

The earned income exclusion will be reported on the HUD 50058 form. Documentation will be<br />

included in the family’s file to show the reason for the reduced increase in rent.<br />

The PHA will maintain a tracking system to ensure correct application of the earned income<br />

disallowance. Upon request of the family, the PHA will conduct an interim examination due to a<br />

person’s increase in income due to employment.<br />

Inapplicability to Admission<br />

The earned income disallowance is only applied to determine the annual income of families who<br />

are participants in the <strong>Housing</strong> Choice Voucher Program, and therefore, does not apply for<br />

purposes of admission to the program (including the determination of income eligibility or any<br />

income targeting that may be applicable).<br />

D. MINIMUM RENT [24 CFR 5.616]<br />

Minimum rent is $50.00. Exemptions will be granted as required in 24 CFR 5.630. Minimum<br />

rent refers to the Total Tenant Payment and includes the combined amount a family pays towards<br />

rent and/or utilities when it is applied.<br />

Hardship Requests for an Exemption to Minimum Rent<br />

In accordance with 24 CFR 5.630, the PHA must grant an exemption from payment of minimum<br />

rent if the family is unable to pay the minimum rent because of financial hardship. Financial<br />

hardship includes:<br />

1) When the family has lost eligibility for or is awaiting an eligibility determination for a<br />

Federal, State, or local assistance program, including a non-citizen lawfully admitted for<br />

permanent residence under the Immigration and Nationality Act who would be entitled to<br />

public benefits but for title IV of the Personal Responsibility and Work Opportunity Act<br />

of 1996.<br />

2) When the family would be evicted because it is unable to pay the minimum rent.<br />

3) When the income of the family has decreased because of changed circumstances,<br />

including loss of employment.<br />

4) When a death has occurred in the family.<br />

5) Other circumstances determined by the PHA or HUD.<br />

Families subject to minimum rent will be advised at the time of initial rent determination and<br />

annual recertification of their right to request a hardship exemption. The PHA will provide<br />

written notice of a family’s right to request a hardship exemption at the time of each rent<br />

determination where a family’s TTP is $50 based on the minimum rent requirement.<br />
