A. THE <strong>BOARD</strong><br />

During the fiscal year 1938, the members of the Board were as<br />

follows : J Warren Madden, of Pennsylvania, chairman; Edwin S.<br />

Smith, of Massachusetts, member; and Donald Wakefield Smith, of<br />

Pennsylvania, member.<br />

R ORGANIZATION-WASHINGTON OFFICE<br />

As will be seen by the accompanying chart, the following major<br />

divisions in the Washington office have been established by the Board:<br />

Administrative, Legal, Trial Examining, Economic Research, and<br />

Publications.<br />

The Administrative Division, under the general supervision of the<br />

Secretary, is responsible for the coordination of all the divisions of<br />

the Board and also for the administrative activities of the Board<br />

both in the Washington and regional offices..<br />

The clerical and fiscal work is under the direct supervision of a<br />

chief clerk who is directly responsible for the following sections :<br />

Accounts, Personnel, Dockets, Files and Mails, Purchase and Supply,<br />

Duplicating and Stenographic.<br />

The Secretary, together with the Assistant Secretary and an administrative<br />

staff, directs and supervises all case development in the<br />

field to the point where hearings are held, and specializes in the<br />

labor-relations phases of these problems as well as the more formal<br />

procedures under the act. The executive office conducts liaison activities<br />

with other Government agencies and establishments in matters<br />

germane to the handling of the Board's cases.<br />

The Legal Division, under the supervision of the General Counsel,<br />

has charge of the legal work involved in the administration of the<br />

National Labor Relations Act. This work falls into two main sections,<br />

Litigation and Review.<br />

The Litigation Section, beaded by the Associate General Counsel,<br />

is responsible for the conduct of hearings before the Board and advises<br />

the regional attorneys in their conduct of hearings before the<br />

. agents of the Board in the field. It represents the Board in judicial<br />

proceedings seeking to enjoin the Board from holding hearings and<br />

taking other action in cases before it, and also represents the Board<br />

in proceedings brought by it in the United States circuit courts of<br />

appeals for the enforcement of its orders, and proceedings brought<br />

by parties for the review of the Board's orders. It collaborates with<br />

the Department of Justice in the presentation of arguments before<br />

the Supreme Court of the United States. It prepares briefs for presentation<br />

to the courts in all judicial proceedings brought by or<br />

against the Board.<br />
