If the parties filing the charges or petitions did not choose to withdraw<br />

them when informed by the regional director that in his opinion<br />

no further action was warranted, the director issued orders formally<br />

refusing to issue complaintst and recommended to the Board, in representation<br />

that the petitions be dismissed.<br />

In a majority of cases settlements in compliance with the act were<br />

brought about through the voluntary cooperation of the employer, the<br />

complaining union, and the agents of the Board.<br />

In some instances charges or petitions involving the same employer<br />

were filed in more than one regional office. In most of such cases all<br />

of the charges or petitions were transferred to one of the regional<br />

offices thus securing more expeditious and complete disposition.<br />

After formal action taken by the Board, complaint cases may be<br />

disposed of either by compliance with the recommendations of the<br />

intermediate report of the trial examiner, after hearing, or by compliance<br />

with Board decisions and orders. Even after formal action,<br />

in many instances, cases were settled, withdrawn, or dismissed.<br />

Settlements in compliance with the act were secured in 4,621 cases,2<br />

or 52.2 percent of the total cases closed. A total of 1,439 cases, or 16.3<br />

percent of the cases closed, was dismissed either by the regional directors<br />

or by the trial examiners during hearings. Parties filing charges<br />

and petitions withdrew 2,345 cases, 2 or 26.5 percent of all cases closed.<br />

The remaining 446 cases, or 5 percent of the total cases disposed<br />

of, were closed after the issuance of Board decisions and orders.<br />

Included in these 446 cases are 29 cases in which there was compliance<br />

with the Board's orders, 75 cases which were dismissed by Board<br />

decision, and 342 cases which were closed as a result of the Board's<br />

certification of unions representing a majority of the workers in the<br />

appropriate units.<br />

Table I shows the cases on docket, the number of workers involved,<br />

and various methods by which cases were disposed of during the fiscal<br />

year ending June 30, 1938, as well as the total number of cases pending<br />

on that date.<br />
