VI. REPRESENTATION CASES 43<br />

Decisions issued and cases heard.—Hearings were conducted by trial<br />

examiners designated by the Chief Trial Examiner in 728 representation<br />

cases during the fiscal year 1937-38. Thus, 16.5 percent of all<br />

representation cases on docket were heard during the year.<br />

After hearing, the Board issued decisions in 514 cases which involved<br />

a question of representation. During the year the Board<br />

issued 364 directions of election, and 233 certifications after elections<br />

had been conducted. In 25 cases supplemental decisions were issued<br />

by the Board dismissing the petitions after elections had been held.<br />

The 514 cases decided represent 11.6 percent of all representation<br />

cases on docket during the 12 months ending June 30, 1938.<br />

Table XVII gives a regional breakdown of representation cases<br />

heard, the number of elections ordered, and decisions issued.<br />

B. ANALYSIS OF REPRESENTATION CASES BY UNIONS INVOLVED<br />

For statistical purposes, in the analysis of representation cases by<br />

unions involved, the petitions filed by individuals were combined<br />

with the petitions filed by unaffiliated unions. Only 17 petitions,<br />

invilving 3,128 workers, which were filed by individuals, were on<br />

docket during the year and it is assumed that many of these petitions<br />

were filed by informal groups of employees which are, in effect,<br />

unaffiliated unions.<br />

Of the 4,419 representation cases on docket, 1,434 were cases filed<br />

by A. F. of L. unions, 2,331 were cases filed by C. I. 0. unions, and<br />

654 by unaffiliated unions. The workers involved in the petitions<br />

filed by the three groups were 260,488 for the A. F. of L. affiliates,<br />

1,015,216 for the C. I. 0. unions, and 212,945 for the unaffiliated<br />

unions.<br />

The Board, during the fiscal year 1937-38, disposed of 78.7 percent<br />

of all the A. F. of L. cases on docket as against 71 percent for<br />

C. I. 0. cases, and 57.2 percent of the cases filed by unaffiliated<br />

unions.<br />

Settlements before formal action was instituted were secured in<br />

53.5 percent of all A. F. of L. cases closed. Of the 603 cases of<br />
