(aw) The punishments and penalties awarded byboth the court and the FSI ContractorsDisciplinary Board (hote 8) appear to be onthe side of leniency. Even for seriousoffences such as "issuing or forwarding afalse certif icate" and "signing a falsecertificate", there are no provisions forcustodial sentences (Annex XXXXXI). Themaximum level of punishment for themajority of the relevant offences listedunder the Fire Service (Installations andEquipment) Regulations is only $5,000, andit was last reviewed in 1981. Moreover,almost all of the punishments awarded bythe Disciplinary Board were merely a'"reprimand" which may not fully reflectthe serious nature of the offences inquestion.Other Issues(ax) As regards those multi-storey buildingsconstructed in the pre-1964 era in siteswhich are inaccessible by emergencyvehicles and for which no FSIs andequipment were required to be installed,the risk of fire is, at least in theory,higher than other developments. However,although no statistics regarding suchbuildings presently existing in theterritory are made available to thisOffice during the course of thisinvestigation, the number of thesebuildings is understood to be decliningwith the passage of time as a result ofredevelopment projects being carried outin Hong Kong.(ay) The FSD headquarters has not drawn up acomprehensive list of buildings coveringthe whole Territory where there are poorand/or inadequate FSIs and equipment.However, the local fire stations do keeprecords of the so-called "high risk'buildings in their respective areas.- 102 -
(az) The Administration has devoted moreattention to FSI problems in PHEs thanthat in the private developments. This isevident by the fact that many improvementworks for FSIs and equipment have beendrawn up and implemented in the PHEs butnone has so far been proposed for theprivate developments. In the course ofour investigation, it has been found thatno comprehensive review of the FSIs andequipment situation in private buildingshas been, or will be, attempted in thenear future. The proposed enactment ofthe Fire Safety (Commercial Premises)Ordinance which was culminated followingthe Shek Kip Mei Hong Kong Bank fire in1994 covers commercial premises of aspecific type only.-103 -
