(A)EVAs(I)Introduction of Legislative Amendments(1) The Planning, Environment and Lands Branchshould, in consultation with the BD andthe FSD, consider the feasibility ofintroducing legislative amendments to theBO with a view to making the provision ofEVAs for all types of buildingdevelopments a statutory requirement andto empowering the BA to disapprovebuilding plans with no or inadequate EVAs.The proposed legislative amendments shouldforestall the unwanted situation of acivil dispute arising from the breach ofthe lease conditions in respect of newbuilding developments and redevelopmentswith a change in the lease conditions andshould also plug the existing loopholes inrespect of redevelopment projects withouta change in the lease conditions.Legislative attempts will not always beeasy, but will certainly be worthwhile• when protection of human life is involved.(II) Enforcement of the Provision of andto EVAsInspections(2) The FSD should look more vigorously intothose situations where the structures canbe regarded as a 'fire hazard' within theinterpretation of the Fire ServicesOrdinance due to the lack or inadequacy ofEVAs with a view to taking appropriateenforcement or improvement actions.(3) The FSD should consider the feasibility ofcausing a fire safety survey to be carriedout in respect of the pre-1964 buildingslocated in thosex old' areas where becauseof physical constraints or otherhistorical reasons, there are no EVAsprovided and no FSIs and equipmentinstalled.
