Chapter 7: ADFA’s Structure and Staffing – Recommend<strong>at</strong>ions 11-15Underperforming undergradu<strong>at</strong>esWith regard to undergradu<strong>at</strong>es <strong>the</strong> <strong>Review</strong> heard th<strong>at</strong> in several cases, staff appeared to resent wh<strong>at</strong><strong>the</strong>y feel is a situ<strong>at</strong>ion in which it is difficult to remove underperforming undergradu<strong>at</strong>es unless <strong>the</strong>y arefailing academically. 58 The Audit is aware th<strong>at</strong> <strong>the</strong> COMDT has taken steps in order to have this authoritydeleg<strong>at</strong>ed to him by <strong>the</strong> Services. According to <strong>the</strong> Career Management Agencies:We did examine potentially passing PERS Regul<strong>at</strong>ions to <strong>the</strong> COMDT ADFA to termin<strong>at</strong>e cadetservice…We don’t think it’s been a happy experience for us because <strong>the</strong> legal nuances <strong>of</strong>termin<strong>at</strong>ion and redress, formal warnings, censures impact upon it and specialised knowledge isrequired. 59Now cadets, this is one place I am happy to have more <strong>of</strong> a convers<strong>at</strong>ion with more discretionfrom <strong>the</strong> Commandant, [but] it’s <strong>of</strong>ten better to let <strong>the</strong> parent Service manage <strong>the</strong> end stage <strong>of</strong> acomplex case. 60The issue <strong>of</strong> removing underperforming undergradu<strong>at</strong>es remains alive within ADFA. In interviews andfocus groups <strong>the</strong> Audit was told th<strong>at</strong>:Cadets and midshipmen progress through here [but] if <strong>the</strong>y were <strong>at</strong> o<strong>the</strong>r training institutions[<strong>the</strong>y] would not. 61There needs to be more punishment and more discharge. If someone is found by a legitim<strong>at</strong>eprocess to be actually a problem, a problem drinker, you know, frequent sexual harassmentclaims – wh<strong>at</strong>ever – <strong>the</strong>n you need to be able to kick <strong>the</strong>m out or <strong>at</strong> least punish <strong>the</strong>m, give <strong>the</strong>mserious punishment. 62I think <strong>the</strong> issue is it’s too hard to get kicked out <strong>of</strong> this place. So you can get away with a lot.The discharge system works <strong>the</strong> same for someone who’s been in for 20 years, it is just as hardto discharge. 63Despite discussion, <strong>the</strong> process for removing undergradu<strong>at</strong>es appears to be unchanged. The COMDTmust make a recommend<strong>at</strong>ion to <strong>the</strong> respective Service headquarters, a member <strong>of</strong> <strong>the</strong> personnel staffconsiders <strong>the</strong> recommend<strong>at</strong>ion and <strong>the</strong> Service makes <strong>the</strong> decision.The Audit acknowledges th<strong>at</strong> <strong>the</strong>re will always be an element <strong>of</strong> negoti<strong>at</strong>ion given each Service’sprerog<strong>at</strong>ive to consider <strong>the</strong>ir numbers, strengths and requirements, but it also notes <strong>the</strong> frustr<strong>at</strong>ionand effect on morale th<strong>at</strong> an inability to deal decisively and expeditiously with underperformingundergradu<strong>at</strong>es can have. As for staff, <strong>the</strong> Audit strongly advoc<strong>at</strong>es th<strong>at</strong> each Service deleg<strong>at</strong>e <strong>the</strong>decision making authority for <strong>the</strong> removal <strong>of</strong> underperforming undergradu<strong>at</strong>es to <strong>the</strong> COMDT.In summary, <strong>the</strong>re is some progress on <strong>the</strong> implement<strong>at</strong>ion <strong>of</strong> Recommend<strong>at</strong>ion 12, however it is p<strong>at</strong>chy.Substantive and systemic changes need to be built <strong>into</strong> career management processes in order toachieve <strong>the</strong> intent <strong>of</strong> this Recommend<strong>at</strong>ion.Given <strong>the</strong> l<strong>at</strong>e start to <strong>the</strong> implement<strong>at</strong>ion <strong>of</strong> this Recommend<strong>at</strong>ion <strong>the</strong> opportunity to impact <strong>the</strong> staffselection process was largely lost for 2013. The Audit looks forward to <strong>the</strong> changes to be effected for<strong>the</strong> 2014 intake.56
