76Policies Favoring Chinese Enterprises—ContinuedSkeptics have noted that many of these patents represent onlysmall adjustments or changes from previous patents <strong>and</strong> are unlikely<strong>to</strong> foster substantial innovation. In the May 5, <strong>2011</strong>, hearingbefore the Commission, Alan Wm. Wolff described many ofthese patents as ‘‘utility model patents, just having incrementaltechnology change, requiring <strong>and</strong> getting no review.’’ In fact,even these seemingly mundane patents serve a particular purpose.According <strong>to</strong> Dieter Ernst, senior fellow at the East-WestCenter, ‘‘Chinese firms regularly file ‘utility patents’ on knownproducts in order <strong>to</strong> prevent their original foreign developersfrom selling these products within <strong>China</strong>.’’ 251 Commissionershave also heard from American businesses in Beijing that Chinesecompanies can use these utility patents as reprisals for litigationin other areas. Chinese holders of utility patents can file apatent infringement case against a foreign competi<strong>to</strong>r who hasfiled an infringement lawsuit outside of <strong>China</strong>. 252 The Chineseholder might expect <strong>to</strong> win in Chinese courts even if the case hasno merit.Technical St<strong>and</strong>ards<strong>China</strong> has sought <strong>to</strong> impose Chinese technical st<strong>and</strong>ards onforeign competi<strong>to</strong>rs even in cases where widely accepted technicalst<strong>and</strong>ards already exist. For example, <strong>China</strong>’s governmentcreated a third-generation mobile telecommunications st<strong>and</strong>ard,the Time Division Synchronous Code Division Multiple Access <strong>to</strong>compete with the U.S. CDMA (Code Division Multiple Access)<strong>and</strong> the European GSM (Global System for Multiple Communications)st<strong>and</strong>ards.
