City agrees to provide a sufficient number of qualified building inspectors to
inspect the construction work on an as needed basis. Inspection shall be provided as necessary
to maintain the construction schedule.
G. [§ 207) Schedule of Performance
Participant shall begin and complete or cause to be begun and completed all construction
of the First Phase within the times specified in the Schedule of Perfonnance, or as such times
may be extended pursuant to Section 608 of this Agreement. The Schedule of Perfonnance is
also SUbject to revision from time to time as mutually agreed upon in writing by and between
Participant, Agency and City.
H. [§ 208J Indemnification During Construction; Bodily Injury and Property Damage
Insurance
During periods of construction on the Site pursuant to this Agreement, Participant agrees
to, and shall, indemnify and hold the Agency and the City hannless from and against all
liability, loss, damage, costs, or expenses (including attorneys' fees and court costs) arising from
or as a result of the death of any person or any accident, injury, loss and damage whatsoever
caused to any person or to the property of any person which shall occur on or adjacent to the
Site and which may be caused by the performance of Participant, its agents, servants, employees
and contractors or anyone d.irectly or indirectly employed by Participant, and whether such
damage shall accrue or be discovered before or after the tennination of this Agreement. Nothing
in this Section shall be construed to mean· that Participant shall hold the City or the Agency
hannless and/or defend either from any claims arising from, or alleged to arise from, the
negl igent acts, or negligent failure to act, on the part of the City or the Agency. The City and
Agency agree [0 fully cooperate with Participant in the defense of any matter in which
Participant is defending and/or holding the City and/or the Agency harmless.
Prior to the commencement of construction on the site, Participant shall furnish or shall
cause lO be furnished, to the Agency and City, duplicate originals or appropriate certificates of
bodily injury and property damage insurance policies in the amount of at least $1,000,000
combined single limits, naming the Agency and the City as additional insureds. Such insurance
shall be maintained and kept in force until the Agency and City has issued a Certificate of
Completion (pursuant to § 220) for the First Phase. Additional certificates of insurance shall
be provided in connection with subsequent phases of construction and shall be similarly released
by the City.
All policies or certificates issued by the respective insurers for insurance shall provide
that such policies or certificates shall not be canceled or materially changed without at least
thirty (3D) days' prior written notice to the City and the Agency. Copies of such policies or
certificates shall be deposited with the City and the Agency together with appropriate evidence
of payment of the premiums therefor; and, at least thirty (30) days prior 10 expiration dates of
expiring policies or contracts held by said City and Agency, copies of renewal or new policies
or contracts or certificates shall be deposited with said City and Agency.
