Recording Requested by: Glendale Redevelopment Agency DRAFT FORM ONLY RESOLUTION NO. __ A RESOLUTION OF THE GLENDALE REDEVELOPMENT AGENCY PURSUANT TO HEALTH & SAFETY CODE SECTIONS 33399(g) WAIVING THE AGENCY'S RIGHT TO USE EMINENT DOMAIN REGARDING PROPERTY SUBIECT TO A STATUTORY DEVELOPMENT AND PARTICIPATION AGREEMENT BETWEEN THE CITY OF GLENDALE, THE GLENDALE REDEVELOPMENT AGENCY AND DREAM WORKS ANIMATION, L.L.C. WHEREAS, Health and Safety Code § 33399(g) provides thaI the Redevelopment Agency may exempt certain property from the future use of eminent domain if the owners participate in the redevelopment of their propeny in conformity with the Redevelopment Plan; AND WHEREAS, [he site described below will be redeveloped by the owners pursuant to a Statutory Development and Participation Agreement in conformity with the Redevelopment Plan; NOW THEREFORE, THE GLENDALE REDEVELOPMENT AGENCY RESOLVES AS FOLLOWS: SECTION 1. Owner of the Parcels. The owner of the propeny included within the scope of the waivers and agreements provided by this resolution is: (1) FBTe Leasing Corp., a New York corporation. SECTJO 2. Findinl!s and Determinations. The Glendale Redevelopment Agency fmds and determines as follows:
a. Redevelopment of the property described below as contemplated in the Statutory Development and Participation Agreement will be consistent with the tenns and restrictions of the San Fernando Road Corridor Redevelopment Project Area. b. Such redevelopment will eliminate all aspects of the property that may be considered blighted within the meaning of Health and Safery Code § 33030 through 33033, inclusive. c. Such redevelopment will render tile property unnecessary for any other effective redevelopment of the Project Area as set forth in Health & Safety Code § 33367(d)(lO). SECTION 3. Exemption From Furure Eminent Domain. Pursuant to Health and Safely Code § 33399(g) all of the property described in Section 4 below is hereby made exempt from the use of eminent domain by the Glendale Redevelopment Agency. The Glendale Redevelopment Agency shall have no power of eminent domain as to rhat property unless the redevelopment plan is hereafler amended 10 expressly make the property subject to eminent domain. 1996.
