servitude and sexual exploitation and boys are trafficked<br />
<strong>for</strong> <strong>for</strong>ced labor as street vendors, shoe sh<strong>in</strong>ers,<br />
beggars, and <strong>for</strong> <strong>for</strong>ced m<strong>in</strong>e and agricultural labor.<br />
Gu<strong>in</strong>ean women and girls are trafficked abroad<br />
to Cote d’Ivoire, Ben<strong>in</strong>, Senegal, Nigeria, South<br />
Africa, Spa<strong>in</strong>, and Greece <strong>for</strong> domestic servitude and<br />
sexual exploitation. Girls are trafficked to Gu<strong>in</strong>ea<br />
from Nigeria, Ghana, Mali, Burk<strong>in</strong>a Faso, Liberia,<br />
Senegal and Gu<strong>in</strong>ea-Bissau <strong>for</strong> sexual exploitation<br />
and domestic servitude. Gu<strong>in</strong>ean men are occasionally<br />
trafficked with<strong>in</strong> Gu<strong>in</strong>ea <strong>for</strong> agricultural labor.<br />
Some from the People’s Republic of Ch<strong>in</strong>a (P.R.C.)<br />
women and girls are trafficked to Gu<strong>in</strong>ea <strong>for</strong> sexual<br />
exploitation. Organized traffick<strong>in</strong>g networks from<br />
Nigeria, Ch<strong>in</strong>a, India, and Greece use Gu<strong>in</strong>ea as a<br />
po<strong>in</strong>t of transit, mov<strong>in</strong>g female victims through the<br />
Maghreb countries to Europe, notably Italy, Ukra<strong>in</strong>e,<br />
Switzerland, and France.<br />
The Government of Gu<strong>in</strong>ea does not fully comply<br />
with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of<br />
traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant ef<strong>for</strong>ts<br />
to do so, despite limited resources. To strengthen its<br />
response to traffick<strong>in</strong>g, Gu<strong>in</strong>ea should pass legislation<br />
prohibit<strong>in</strong>g all <strong>for</strong>ms of traffick<strong>in</strong>g, <strong>in</strong>crease<br />
ef<strong>for</strong>ts to <strong>in</strong>vestigate and prosecute traffickers and<br />
rescue victims, with a focus on children subjected to<br />
sexual exploitation.<br />
Prosecution<br />
The Government of Gu<strong>in</strong>ea made m<strong>in</strong>imal ef<strong>for</strong>ts<br />
to combat traffick<strong>in</strong>g through law en<strong>for</strong>cement <strong>in</strong><br />
the last year. Gu<strong>in</strong>ea prohibits all <strong>for</strong>ms of traffick<strong>in</strong>g<br />
<strong>in</strong> persons through separate statutes. Labor<br />
traffick<strong>in</strong>g is crim<strong>in</strong>alized through Article 337 of its<br />
1998 Penal Code, which prescribes penalties of six<br />
months’ to 10 years’ imprisonment — penalties that<br />
are sufficiently str<strong>in</strong>gent. Forced prostitution and<br />
child prostitution are crim<strong>in</strong>alized by Article 329<br />
of its Penal Code, which prescribes penalties of six<br />
months’ to two years’ imprisonment if the trafficked<br />
victim is an adult, and two to five years’ imprisonment<br />
if the victim is a child. These penalties <strong>for</strong> sex<br />
traffick<strong>in</strong>g of adults are not sufficiently str<strong>in</strong>gent<br />
and not commensurate with penalties prescribed<br />
<strong>for</strong> other grave crimes, such as rape. The government<br />
arrested and jailed a suspected trafficker <strong>for</strong><br />
attempt<strong>in</strong>g to sell his daughter. The police arrested<br />
two <strong>in</strong>dividuals <strong>for</strong> traffick<strong>in</strong>g a m<strong>in</strong>or to Liberia<br />
<strong>for</strong> domestic servitude, but the case could not be<br />
pursued because the victim denied the charges and<br />
asked that the suspects be released. The police are<br />
currently <strong>in</strong>vestigat<strong>in</strong>g two transnational traffick<strong>in</strong>g<br />
cases. Dur<strong>in</strong>g the last year, the government cont<strong>in</strong>ued<br />
draft<strong>in</strong>g a law prohibit<strong>in</strong>g all <strong>for</strong>ms of traffick<strong>in</strong>g<br />
and a separate law aga<strong>in</strong>st child traffick<strong>in</strong>g<br />
as part of a new child legal code. The government<br />
failed to <strong>in</strong>vestigate reports that higher level government<br />
officials might be protect<strong>in</strong>g some traffickers.<br />
Gu<strong>in</strong>ea also failed to respond to a report of child<br />
commercial sexual exploitation.<br />
Protection<br />
The Government of Gu<strong>in</strong>ea cont<strong>in</strong>ued to make progress<br />
<strong>in</strong> provid<strong>in</strong>g care to traffick<strong>in</strong>g victims dur<strong>in</strong>g<br />
the report<strong>in</strong>g period. Although the government does<br />
not operate or fund victim shelters, it liaised with<br />
NGOs to place 22 child traffick<strong>in</strong>g victims <strong>in</strong> foster<br />
homes. A government case manager monitored<br />
each child’s care to ensure that medical and legal<br />
services were provided. The government cont<strong>in</strong>ued<br />
to provide free phone service <strong>for</strong> an NGOoperated<br />
24-hour victim hotl<strong>in</strong>e. The government<br />
requires that victims participate <strong>in</strong> traffick<strong>in</strong>g<br />
prosecutions be<strong>for</strong>e a case may go to trial. Gu<strong>in</strong>ea<br />
does not provide legal alternatives to the removal of<br />
<strong>for</strong>eign victims to countries where they would face<br />
hardship or retribution. Due to lack of crime data, it<br />
is unclear whether Gu<strong>in</strong>ea <strong>in</strong>appropriately <strong>in</strong>carcerates,<br />
f<strong>in</strong>es, or penalizes victims <strong>for</strong> unlawful acts<br />
committed as a direct result of be<strong>in</strong>g trafficked.<br />
Prevention<br />
The Government of Gu<strong>in</strong>ea cont<strong>in</strong>ued solid ef<strong>for</strong>ts<br />
to raise awareness about traffick<strong>in</strong>g dur<strong>in</strong>g the<br />
report<strong>in</strong>g period. The government contributed<br />
fund<strong>in</strong>g <strong>for</strong> some costs associated with an ILO<br />
study on the number of children <strong>in</strong> domestic labor,<br />
m<strong>in</strong><strong>in</strong>g, and street vend<strong>in</strong>g, or who are associated<br />
with drug or arms sales. The National Committee to<br />
Combat <strong>Traffick<strong>in</strong>g</strong> hosted a workshop <strong>in</strong> July 2006<br />
to evaluate whether Gu<strong>in</strong>ea’s national action plan<br />
is <strong>in</strong> compliance with ECOWAS’ traffick<strong>in</strong>g guidel<strong>in</strong>es,<br />
conclud<strong>in</strong>g that it does comply. The government<br />
has <strong>in</strong>tegrated traffick<strong>in</strong>g-relatede issues <strong>in</strong>to<br />
the primary school curriculum. The M<strong>in</strong>istry of<br />
Defense, through its own child protection office,<br />
has developed a <strong>2007</strong> plan to combat child traffick<strong>in</strong>g.<br />
The government cont<strong>in</strong>ued to contribute<br />
personnel, vehicles and other travel resources to an<br />
<strong>in</strong>tensive national media campaign aga<strong>in</strong>st traffick<strong>in</strong>g<br />
that it launched jo<strong>in</strong>tly with UNICEF <strong>in</strong> 2005.<br />
GUINEA-BISSAU (Tier 2)<br />
Gu<strong>in</strong>ea-Bissau is a source country <strong>for</strong> children<br />
trafficked <strong>for</strong> the purposes of <strong>for</strong>ced begg<strong>in</strong>g and<br />
agricultural labor. Most victims are boys (talibe) trafficked<br />
to West African countries, primarily Senegal,<br />
by Koranic school <strong>in</strong>structors (marabouts) or their
