Protection<br />

Government protection <strong>for</strong> traffick<strong>in</strong>g victims<br />

dur<strong>in</strong>g the report<strong>in</strong>g period rema<strong>in</strong>ed <strong>in</strong>adequate<br />

and no department dedicated f<strong>in</strong>ancial or staff<br />

resources specifically <strong>for</strong> traffick<strong>in</strong>g victims. While<br />

the government operated facilities that provide an<br />

array of social services to its citizens, <strong>in</strong>clud<strong>in</strong>g 10<br />

“Thuthuzela” reception centers that offer medical<br />

and psychological care to victims of sexual violence,<br />

it rema<strong>in</strong>s unclear whether traffick<strong>in</strong>g victims<br />

utilized any of these services <strong>in</strong> 2006. However,<br />

police referred an unknown number of traffick<strong>in</strong>g<br />

victims to local NGO-run shelters dur<strong>in</strong>g the<br />

report<strong>in</strong>g period; the government provided f<strong>in</strong>anc<strong>in</strong>g<br />

to some of these facilities to assist <strong>in</strong> the care of<br />

victims. Police requested IOM’s participation <strong>in</strong> jo<strong>in</strong>t<br />

<strong>in</strong>terviews of suspected <strong>for</strong>eign victims and referred<br />

a number of victims to the organization <strong>for</strong> shortterm<br />

care and repatriation. The government actively<br />

encouraged victims’ assistance <strong>in</strong> the <strong>in</strong>vestigation<br />

and prosecution of their traffickers; at least six traffick<strong>in</strong>g<br />

victims were placed <strong>in</strong> South Africa’s witness<br />

protection program dur<strong>in</strong>g the year to enable their<br />

<strong>in</strong>volvement. In December, however, photographs<br />

of four Thai women <strong>in</strong> witness protection appeared<br />

<strong>in</strong> a Durban newspaper, <strong>in</strong>creas<strong>in</strong>g threats aga<strong>in</strong>st<br />

their lives and families <strong>in</strong> Thailand. One group of<br />

suspected <strong>for</strong>eign victims was deta<strong>in</strong>ed <strong>in</strong> a jail cell<br />

with their alleged traffickers, seriously compromis<strong>in</strong>g<br />

their ability to assist <strong>in</strong> a prosecution. There are no<br />

legal alternatives to the removal of <strong>for</strong>eign<br />

traffick<strong>in</strong>g victims to countries where they<br />

face hardship or retribution. While local<br />

law en<strong>for</strong>cement’s ability to question<br />

migrants improved, the lack of national<br />

coord<strong>in</strong>ation and procedures <strong>for</strong> victim<br />

protection cont<strong>in</strong>ued to lead to deportation<br />

of most <strong>for</strong>eign victims be<strong>for</strong>e they<br />

were able to give evidence <strong>in</strong> court. In<br />

addition, immigration officials did not<br />

attempt to identify traffick<strong>in</strong>g victims<br />

among undocumented <strong>for</strong>eigners,<br />

notably Mozambicans, be<strong>for</strong>e deport<strong>in</strong>g them.<br />

Prevention<br />

While awareness of human traffick<strong>in</strong>g has <strong>in</strong>creased<br />

substantially with<strong>in</strong> the country over the past year,<br />

government ef<strong>for</strong>ts <strong>in</strong> promot<strong>in</strong>g awareness were<br />

m<strong>in</strong>imal. The Sexual Offenses and Community<br />

Affairs Unit with<strong>in</strong> the NPA rema<strong>in</strong>ed responsible<br />

<strong>for</strong> coord<strong>in</strong>ation of the Human <strong>Traffick<strong>in</strong>g</strong> Inter-<br />

Sectoral Task Team. This team’s ability to function<br />

rema<strong>in</strong>ed hampered by the lack of a specific<br />

mandate from the Department of Justice and poor<br />

coord<strong>in</strong>ation with other departments; it produced<br />

no substantial ef<strong>for</strong>ts dur<strong>in</strong>g the year. Also due to<br />

the lack of a mandate, the prelim<strong>in</strong>ary National<br />

Plan of Action adopted <strong>in</strong> March 2006 was not<br />

implemented. In August, the <strong>Women</strong>’s Parliament<br />

conducted a two-day meet<strong>in</strong>g focus<strong>in</strong>g on human<br />

traffick<strong>in</strong>g.<br />

SPAIN (Tier 1)<br />

Spa<strong>in</strong> is a transit and dest<strong>in</strong>ation country <strong>for</strong> men,<br />

women, and children trafficked <strong>for</strong> the purposes<br />

of commercial sexual exploitation and <strong>for</strong>ced<br />

labor. While most victims are women between the<br />

ages of 18 and 24 trafficked <strong>for</strong> sexual exploitation,<br />

females as young as 16 are also trafficked to<br />

Spa<strong>in</strong> <strong>for</strong> the same purpose and men are trafficked<br />

<strong>for</strong> <strong>for</strong>ced labor, usually <strong>in</strong> agriculture. Primary<br />

source countries <strong>for</strong> victims trafficked to Spa<strong>in</strong> are<br />

Romania, Russia, Brazil, Colombia and Nigeria,<br />

though victims are trafficked from other areas of<br />

Lat<strong>in</strong> America and Eastern Europe as well as from<br />

Sierra Leone. In smaller numbers, Ch<strong>in</strong>ese women<br />

are trafficked to Spa<strong>in</strong> <strong>for</strong> sexual exploitation and<br />

Ch<strong>in</strong>ese men <strong>for</strong> labor exploitation.<br />

The Government of Spa<strong>in</strong> fully complies with the<br />

m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of traffick<strong>in</strong>g.<br />

Spa<strong>in</strong> aggressively <strong>in</strong>vestigated, arrested, and<br />

prosecuted traffick<strong>in</strong>g crimes, closely monitor<strong>in</strong>g<br />

these ef<strong>for</strong>ts through effective crime data collection.<br />

Spa<strong>in</strong>’s anti-traffick<strong>in</strong>g legislation <strong>in</strong>cludes victim<br />

protection mechanisms, which are implemented<br />

largely through government cooperation with<br />

NGOs. To strengthen its response to traffick<strong>in</strong>g,<br />

Spa<strong>in</strong> should f<strong>in</strong>alize its national action plan to<br />

combat traffick<strong>in</strong>g and cont<strong>in</strong>ue and expand its<br />

demand reduction ef<strong>for</strong>ts.<br />

Prosecution<br />

The Government of Spa<strong>in</strong> demonstrated strong<br />

ef<strong>for</strong>ts to combat traffick<strong>in</strong>g through law en<strong>for</strong>cement<br />

<strong>in</strong> the last year. Spa<strong>in</strong> prohibits all <strong>for</strong>ms<br />

of traffick<strong>in</strong>g <strong>in</strong> persons though Article 318 of its<br />

Crim<strong>in</strong>al and Penal Code, which was passed <strong>in</strong> 1995<br />

and amended <strong>in</strong> 2003 to <strong>in</strong>crease the sentence <strong>for</strong><br />

sex traffick<strong>in</strong>g to 5 to 15 years’ imprisonment and<br />

the penalty <strong>for</strong> labor traffick<strong>in</strong>g to 4 to 12 years <strong>in</strong><br />

prison, both sufficiently str<strong>in</strong>gent penalties. The<br />

penalty prescribed <strong>for</strong> sex traffick<strong>in</strong>g is commensurate<br />

with the nation’s 15-year maximum sentence <strong>for</strong><br />

rape. In December 2006, the Council of M<strong>in</strong>isters<br />

approved <strong>in</strong>creas<strong>in</strong>g sentences <strong>for</strong> traffick<strong>in</strong>g by<br />

two to six years <strong>in</strong> prison if the perpetrator belongs<br />

to a crim<strong>in</strong>al organization. Dur<strong>in</strong>g the report<strong>in</strong>g<br />

period, Spanish police dismantled 177 sex traffick<strong>in</strong>g<br />

networks and 63 labor traffick<strong>in</strong>g r<strong>in</strong>gs. Police<br />

arrested 862 <strong>in</strong>dividuals <strong>for</strong> sex traffick<strong>in</strong>g and 177<br />

<strong>for</strong> labor traffick<strong>in</strong>g. In 2006, police launched 272
