NGOs also held sem<strong>in</strong>ars on traffick<strong>in</strong>g <strong>for</strong> students<br />

and teachers <strong>in</strong> four schools.<br />

AUSTRALIA (Tier 1)<br />

Australia is a dest<strong>in</strong>ation country <strong>for</strong> some women<br />

from East Asia and Eastern Europe trafficked <strong>for</strong><br />

the purpose of commercial sexual exploitation. The<br />

majority of traffick<strong>in</strong>g victims were women who<br />

traveled to Australia voluntarily to work <strong>in</strong> both<br />

legal and illegal brothels, but were subject to conditions<br />

of debt bondage or <strong>in</strong>voluntary servitude.<br />

There were several reports of men and women from<br />

India, the People’s Republic of Ch<strong>in</strong>a, and South<br />

Korea migrat<strong>in</strong>g to Australia temporarily <strong>for</strong> work<br />

whose labor conditions amounted to slavery, debt<br />

bondage, and <strong>in</strong>voluntary servitude.<br />

The Government of Australia fully complies with the<br />

m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of<br />

traffick<strong>in</strong>g. Dur<strong>in</strong>g the report<strong>in</strong>g period, the government<br />

strengthened its domestic traffick<strong>in</strong>g laws to<br />

cover offenses <strong>in</strong>volv<strong>in</strong>g deception, exploitative<br />

employment, conditions and contracts, or debt<br />

bondage. The government also ensured that each<br />

person <strong>in</strong> a traffick<strong>in</strong>g network could be prosecuted<br />

<strong>in</strong> cases <strong>in</strong>volv<strong>in</strong>g <strong>in</strong>ternal traffick<strong>in</strong>g. It also<br />

<strong>in</strong>creased penalties <strong>for</strong> traffick<strong>in</strong>g <strong>in</strong> children and<br />

<strong>for</strong> employers who exploit workers <strong>in</strong> conditions of<br />

<strong>for</strong>ced labor, sexual servitude, or slavery. The government<br />

provides significant resources to support antitraffick<strong>in</strong>g<br />

ef<strong>for</strong>ts throughout Southeast Asia, law<br />

en<strong>for</strong>cement tra<strong>in</strong><strong>in</strong>g, victim assistance, and prevention<br />

activities. The Australian government should<br />

devote more attention and resources to address<strong>in</strong>g<br />

allegations of labor traffick<strong>in</strong>g, <strong>in</strong>clud<strong>in</strong>g <strong>in</strong> connection<br />

with its 457 worker visa program.<br />

Prosecution<br />

The Government of Australia demonstrated<br />

<strong>in</strong>creased ef<strong>for</strong>ts to prosecute traffick<strong>in</strong>g <strong>in</strong> persons<br />

cases dur<strong>in</strong>g 2006. Australia prohibits sex and<br />

labor traffick<strong>in</strong>g and traffick<strong>in</strong>g-related offenses<br />

<strong>in</strong> Divisions 270 and 271 of the Commonwealth<br />

Crim<strong>in</strong>al Code. Prescribed penalties <strong>for</strong> these<br />

offenses are sufficiently str<strong>in</strong>gent and commensurate<br />

with those prescribed <strong>for</strong> other grave crimes. Dur<strong>in</strong>g<br />

the report<strong>in</strong>g period, there were four convictions <strong>for</strong><br />

sex traffick<strong>in</strong>g. One defendant was sentenced to six<br />

years’ imprisonment; the three other convictions are<br />

on appeal. Six sex traffick<strong>in</strong>g and two labor traffick<strong>in</strong>g<br />

cases are currently be<strong>for</strong>e the courts <strong>in</strong>volv<strong>in</strong>g 16<br />

defendants. The Transnational Sexual Exploitation<br />

and <strong>Traffick<strong>in</strong>g</strong> Teams (TSETT) with<strong>in</strong> the Australian<br />

Federal Police <strong>in</strong>vestigated 14 possible traffick<strong>in</strong>g<br />

cases <strong>in</strong> 2006. Australian citizens were returned to<br />

Australia to face prosecution <strong>for</strong> sexually exploit<strong>in</strong>g<br />

children <strong>in</strong> other countries under Australia’s extraterritorial<br />

child sex tourism law. Dur<strong>in</strong>g the report<strong>in</strong>g<br />

period, the Australian Federal Police conducted 10<br />

<strong>in</strong>vestigations <strong>for</strong> violations under child sex tourism<br />

law, and there were four convictions under<br />

that law. There were no reports of government or<br />

law en<strong>for</strong>cement <strong>in</strong>volvement <strong>in</strong> traffick<strong>in</strong>g. In<br />

late 2006, a Bangladeshi domestic worker filed a<br />

compla<strong>in</strong>t aga<strong>in</strong>st a United Arab Emirates diplomat<br />

<strong>in</strong> Australia, alleg<strong>in</strong>g work conditions that amounted<br />

to <strong>in</strong>voluntary servitude.<br />

Protection<br />

The Government of Australia cont<strong>in</strong>ued to provide<br />

comprehensive assistance <strong>for</strong> victims of traffick<strong>in</strong>g,<br />

their family members, or witnesses will<strong>in</strong>g to aid <strong>in</strong><br />

crim<strong>in</strong>al prosecutions. The government encourages<br />

victims and witnesses to participate <strong>in</strong> the <strong>in</strong>vestigation<br />

of traffickers, but directly l<strong>in</strong>ks cont<strong>in</strong>ued<br />

assistance to victims’ role <strong>in</strong> a viable prosecution. An<br />

enhanced visa regime enables victims or witnesses<br />

assist<strong>in</strong>g <strong>in</strong> an <strong>in</strong>vestigation to rema<strong>in</strong> lawfully <strong>in</strong><br />

Australia. A total of 58 visas have been granted under<br />

this regime s<strong>in</strong>ce its <strong>in</strong>ception <strong>in</strong> January 2004. One<br />

of the visas available is designed to protect victims<br />

from retribution they would face if they had to<br />

return to their country of orig<strong>in</strong>. Due to the requirement<br />

that permanent visas will be granted only to<br />

those who have held a temporary visa <strong>for</strong> two years,<br />

no one has yet been <strong>in</strong> the program long enough to<br />

qualify <strong>for</strong> a permanent visa.<br />

Individuals granted status under this visa regime are<br />

entitled to a package of benefits, <strong>in</strong>clud<strong>in</strong>g shelter,<br />

counsel<strong>in</strong>g, and food and liv<strong>in</strong>g allowances. The<br />

benefit program is adm<strong>in</strong>istered by the government’s<br />

Support <strong>for</strong> Victims of People <strong>Traffick<strong>in</strong>g</strong> and was<br />

assist<strong>in</strong>g 35 victims as of January <strong>2007</strong>. Australia<br />

funds two return and re<strong>in</strong>tegration activities <strong>in</strong> the<br />

Asia region. The first is <strong>for</strong> return and re<strong>in</strong>tegration<br />

of trafficked women and children, and the second<br />

solely supports Thai victims. The Australian Federal<br />

police tra<strong>in</strong>ed 25 special TSETT <strong>in</strong>vestigators <strong>in</strong> <strong>in</strong>terview<strong>in</strong>g<br />

suspected traffick<strong>in</strong>g victims. The government<br />

implemented a <strong>for</strong>mal referral protocol and<br />

<strong>in</strong>terview<strong>in</strong>g procedure <strong>for</strong> traffick<strong>in</strong>g cases.<br />

Prevention<br />

Australian government agencies, <strong>in</strong>clud<strong>in</strong>g specialized<br />

Australian Federal Police <strong>in</strong>vestigation teams,<br />

worked closely with regional counterparts on traffick<strong>in</strong>g<br />

matters. Cooperation extended to tra<strong>in</strong><strong>in</strong>g,<br />

support<strong>in</strong>g <strong>in</strong>vestigations <strong>in</strong> neighbor<strong>in</strong>g countries,<br />

and secur<strong>in</strong>g prosecutions <strong>in</strong> Australia and over-<br />
