is placed on Tier 2 Watch List <strong>for</strong> a second consecutive<br />

year <strong>for</strong> its failure to provide evidence of <strong>in</strong>creas<strong>in</strong>g<br />

ef<strong>for</strong>ts to elim<strong>in</strong>ate traffick<strong>in</strong>g over the past year.<br />

To strengthen its response to traffick<strong>in</strong>g, Mauritania<br />

should apply its law aga<strong>in</strong>st traffick<strong>in</strong>g <strong>in</strong> persons,<br />

strengthen its anti-slavery law, and <strong>in</strong>crease protection<br />

and awareness-rais<strong>in</strong>g ef<strong>for</strong>ts.<br />

Prosecution<br />

The Government of Mauritania demonstrated weak<br />

law en<strong>for</strong>cement ef<strong>for</strong>ts dur<strong>in</strong>g the year. Mauritania<br />

prohibits all <strong>for</strong>ms of traffick<strong>in</strong>g through its 2003<br />

Law Aga<strong>in</strong>st <strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Persons</strong> and slavery<br />

through its 1981 Abolition of Slavery Ord<strong>in</strong>ance.<br />

The prescribed penalty of five to 10 years <strong>for</strong> all<br />

<strong>for</strong>ms of traffick<strong>in</strong>g is adequate and exceeds the<br />

nation’s prescribed penalty <strong>for</strong> <strong>for</strong>cible sexual<br />

assault. The slavery ord<strong>in</strong>ance, however, neither<br />

prescribes a penalty nor def<strong>in</strong>es slavery. Mauritania<br />

failed to report any traffick<strong>in</strong>g or slavery prosecutions<br />

or convictions dur<strong>in</strong>g the year. Lack<strong>in</strong>g exact<br />

data, Mauritania estimated that it <strong>in</strong>vestigated five<br />

cases of traffick<strong>in</strong>g or slavery, most of which were<br />

reported to officials by civil society activists. In each<br />

case, authorities concluded that slavery did not exist,<br />

but failed to apply the traffick<strong>in</strong>g statute. <strong>Report</strong>s<br />

<strong>in</strong>dicate that some local officials may have covered<br />

up slavery cases by <strong>in</strong>timidat<strong>in</strong>g or provid<strong>in</strong>g cloth<strong>in</strong>g<br />

and other goods to <strong>in</strong>dividuals <strong>in</strong> servitude so<br />

they would testify to satisfactory liv<strong>in</strong>g conditions.<br />

In response to the repatriation to Mauritania <strong>in</strong> 2006<br />

of 21 children who had been trafficked to the United<br />

Arab Emirates as camel jockeys, the head prosecutor<br />

spoke at donor-organized public education sessions<br />

about penalties prescribed under Mauritanian law<br />

aga<strong>in</strong>st traffickers. The government is <strong>in</strong> the process<br />

of establish<strong>in</strong>g a children’s police brigade to en<strong>for</strong>ce<br />

a January 2006 ord<strong>in</strong>ance aga<strong>in</strong>st child prostitution<br />

and exploitative child labor.<br />

Protection<br />

Mauritania demonstrated modest ef<strong>for</strong>ts to<br />

protect traffick<strong>in</strong>g and slavery victims dur<strong>in</strong>g the<br />

report<strong>in</strong>g period. With f<strong>in</strong>anc<strong>in</strong>g from the African<br />

Development Bank, the government provided<br />

six months of literacy tra<strong>in</strong><strong>in</strong>g <strong>for</strong> 5,000 women,<br />

most of them domestic servants of an ethnic group<br />

historically victimized by slavery. The government<br />

cont<strong>in</strong>ued to contribute personnel and a build<strong>in</strong>g<br />

to a collaborative project with UNICEF and a<br />

private bank to provide micro-credit programs <strong>for</strong><br />

domestic workers and <strong>for</strong>mer slaves. Mauritania<br />

cont<strong>in</strong>ued to fund six centers <strong>in</strong> Nouakchott<br />

provid<strong>in</strong>g care <strong>for</strong> <strong>in</strong>digents, many of whom were<br />

talibe boys. The centers, however, are operat<strong>in</strong>g<br />

below capacity despite apparent need. The government<br />

also created a welcome center <strong>for</strong> 21 victims<br />

repatriated to Mauritania <strong>in</strong> 2006 after hav<strong>in</strong>g<br />

been trafficked to the United Arab Emirates as<br />

camel jockeys. The government does not encourage<br />

victims to assist <strong>in</strong> traffick<strong>in</strong>g or slavery <strong>in</strong>vestigations<br />

or prosecutions. The government does not<br />

provide legal alternatives to the removal of <strong>for</strong>eign<br />

victims to countries where they face hardship or<br />

retribution. Victims are <strong>in</strong>appropriately <strong>in</strong>carcerated,<br />

f<strong>in</strong>ed or penalized <strong>for</strong> unlawful acts as a direct<br />

result of be<strong>in</strong>g trafficked. The government places<br />

children <strong>in</strong> jail <strong>for</strong> steal<strong>in</strong>g or engag<strong>in</strong>g <strong>in</strong> sexual<br />

activity (<strong>in</strong>clud<strong>in</strong>g <strong>for</strong> be<strong>in</strong>g raped), although many<br />

of them are likely traffick<strong>in</strong>g victims.<br />

Prevention<br />

The Government of Mauritania made limited ef<strong>for</strong>ts<br />

to raise awareness about traffick<strong>in</strong>g and slavery<br />

dur<strong>in</strong>g the report<strong>in</strong>g period. The <strong>in</strong>ter-m<strong>in</strong>isterial<br />

work<strong>in</strong>g group on traffick<strong>in</strong>g adopted a national<br />

action plan aga<strong>in</strong>st traffick<strong>in</strong>g dur<strong>in</strong>g the report<strong>in</strong>g<br />

period. In March 2006, the government held a “Day<br />

of Reflection” <strong>for</strong> development partners, the media,<br />

civil society and political parties to discuss strategies<br />

<strong>for</strong> eradicat<strong>in</strong>g the vestiges of slavery.<br />

MAURITIUS (Tier 2)<br />

Mauritius is a source country <strong>for</strong> female children<br />

trafficked with<strong>in</strong> the country <strong>for</strong> the purpose of<br />

commercial sexual exploitation. This commercial<br />

sexual exploitation of children (CSEC) largely<br />

consists of school girls engag<strong>in</strong>g <strong>in</strong> the practice,<br />

often with the encouragement and support of their<br />

peers or family members. Taxi drivers are known to<br />

provide transportation and <strong>in</strong>troductions to both<br />

the girls and the clients.<br />

The Government of Mauritius does not fully comply<br />

with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of<br />

traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant ef<strong>for</strong>ts<br />

to do so. The government openly acknowledges that<br />

child prostitution occurs with<strong>in</strong> the country and is<br />

actively work<strong>in</strong>g to curb the problem. To further its<br />

ef<strong>for</strong>ts, the government should complete the prosecution<br />

of suspected traffickers apprehended <strong>in</strong> 2006<br />

and expand the provision of anti-traffick<strong>in</strong>g tra<strong>in</strong><strong>in</strong>g<br />

to law en<strong>for</strong>cement officials <strong>for</strong>ce-wide.<br />

Prosecution<br />

The government vigorously <strong>in</strong>vestigated cases of<br />

human traffick<strong>in</strong>g throughout the year. Mauritius<br />

prohibits all <strong>for</strong>ms of traffick<strong>in</strong>g found <strong>in</strong> the<br />

country through its Child Protection Bill of<br />

2005, which prescribes punishment of up to<br />
