AFGHANISTAN (Tier 2)<br />
Afghanistan is a source, transit, and dest<strong>in</strong>ation<br />
country <strong>for</strong> men, women, and children trafficked<br />
<strong>for</strong> the purposes of commercial sexual exploitation<br />
and <strong>in</strong>voluntary servitude. Afghan children are trafficked<br />
<strong>in</strong>ternally and to Iran, Pakistan, Saudi Arabia,<br />
Oman, and Zimbabwe <strong>for</strong> commercial sexual<br />
exploitation, <strong>for</strong>ced marriage to settle debts or<br />
disputes, <strong>for</strong>ced begg<strong>in</strong>g, debt bondage, service as<br />
child soldiers, or other <strong>for</strong>ms of <strong>in</strong>voluntary servitude.<br />
Afghan women are trafficked <strong>in</strong>ternally and to<br />
Pakistan and Iran <strong>for</strong> commercial sexual exploitation,<br />
and men are trafficked to Iran <strong>for</strong> <strong>for</strong>ced labor.<br />
Afghanistan is also a dest<strong>in</strong>ation <strong>for</strong> women and<br />
girls from Ch<strong>in</strong>a, Iran, and Tajikistan trafficked <strong>for</strong><br />
commercial sexual exploitation. Tajik women and<br />
children are also believed to be trafficked through<br />
Afghanistan to Pakistan and Iran <strong>for</strong> commercial<br />
sexual exploitation.<br />
The Government of Afghanistan does not fully<br />
comply with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation<br />
of traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant<br />
ef<strong>for</strong>ts to do so. The government provided land to<br />
IOM <strong>for</strong> the construction of a shelter <strong>for</strong> traffick<strong>in</strong>g<br />
victims. The government should take additional<br />
steps to enact a comprehensive anti-traffick<strong>in</strong>g law<br />
and <strong>in</strong>crease law en<strong>for</strong>cement ef<strong>for</strong>ts aga<strong>in</strong>st <strong>in</strong>ternal<br />
traffick<strong>in</strong>g, particularly traffick<strong>in</strong>g of children <strong>for</strong><br />
commercial sexual exploitation, <strong>for</strong>ced marriage,<br />
and <strong>in</strong>voluntary servitude. Afghanistan also should<br />
<strong>in</strong>stitute a <strong>for</strong>mal mechanism to refer traffick<strong>in</strong>g<br />
victims to NGO protection services and should not<br />
punish sex traffick<strong>in</strong>g victims <strong>for</strong> crimes committed<br />
as a direct result of their be<strong>in</strong>g trafficked.<br />
Protection<br />
The Government of Afghanistan made modest<br />
improvements <strong>in</strong> its ef<strong>for</strong>ts to protect victims of<br />
traffick<strong>in</strong>g, but deficiencies <strong>in</strong> its overall ef<strong>for</strong>ts<br />
rema<strong>in</strong>ed. In March <strong>2007</strong>, the government provided<br />
land <strong>for</strong> IOM to build a shelter specifically designed<br />
<strong>for</strong> child victims of traffick<strong>in</strong>g. The government also<br />
assisted <strong>in</strong> support<strong>in</strong>g 400 child victims of traffick<strong>in</strong>g<br />
repatriated from Saudi Arabia, Oman, Pakistan,<br />
and Zimbabwe by facilitat<strong>in</strong>g family reunification<br />
and provid<strong>in</strong>g the children shelter <strong>in</strong> exist<strong>in</strong>g juvenile<br />
centers or orphanages, as well as medical care<br />
and educational services. Due to cultural mores,<br />
some victims of traffick<strong>in</strong>g, however, cont<strong>in</strong>ue to be<br />
arrested or otherwise punished <strong>for</strong> prostitution and<br />
morality crimes. The government does not encourage<br />
victims to assist <strong>in</strong> <strong>in</strong>vestigations of their traffickers,<br />
nor does it provide them with legal alternatives<br />
to removal to countries <strong>in</strong> which they may face<br />
hardship or retribution. Afghanistan should take<br />
immediate steps to end the arrest and <strong>in</strong>carceration<br />
of traffick<strong>in</strong>g victims, and should work with<br />
NGOs to establish a <strong>for</strong>mal victim identification<br />
and referral mechanism. The government should<br />
also improve protection of victims of <strong>in</strong>voluntary<br />
servitude, <strong>in</strong>clud<strong>in</strong>g bonded laborers and <strong>for</strong>ced<br />
child beggars.<br />

Prosecution<br />
Over the year, Afghanistan made no clear progress<br />
<strong>in</strong> its anti-traffick<strong>in</strong>g law en<strong>for</strong>cement ef<strong>for</strong>ts.<br />
Afghanistan does not prohibit all <strong>for</strong>ms of traffick<strong>in</strong>g<br />
<strong>in</strong> persons, but the government relies on kidnapp<strong>in</strong>g<br />
and other statutes to charge some traffick<strong>in</strong>g<br />
offenses. This year, Afghanistan did not provide<br />
sufficient evidence of arrest<strong>in</strong>g, prosecut<strong>in</strong>g, or<br />
convict<strong>in</strong>g traffickers. Both the M<strong>in</strong>istry of Interior<br />
and the Attorney General’s Office reported data<br />
<strong>in</strong>dicat<strong>in</strong>g that traffickers had been arrested, prosecuted,<br />
and convicted, but they were unable to<br />
provide disaggregated traffick<strong>in</strong>g data from other<br />
related law en<strong>for</strong>cement data. The government did<br />
not demonstrate any ef<strong>for</strong>ts to <strong>in</strong>vestigate, arrest, or<br />
prosecute government officials facilitat<strong>in</strong>g traffick<strong>in</strong>g<br />
offenses despite reports of widespread complicity<br />
among border and highway police. The government<br />
should enact an anti-traffick<strong>in</strong>g law without further<br />
delay and <strong>in</strong>crease law en<strong>for</strong>cement action aga<strong>in</strong>st<br />
complicit government officials. Officials should also<br />
take law en<strong>for</strong>cement measures to curb <strong>in</strong>ternal traffick<strong>in</strong>g<br />
of m<strong>in</strong>ors <strong>for</strong> commercial sexual exploitation<br />
and <strong>in</strong>voluntary servitude, <strong>in</strong>clud<strong>in</strong>g bonded labor.<br />
Prevention<br />
Dur<strong>in</strong>g the year, Afghanistan made limited progress<br />
<strong>in</strong> prevent<strong>in</strong>g traffick<strong>in</strong>g <strong>in</strong> persons. The M<strong>in</strong>istry<br />
of Labor and Social Affairs, with the assistance<br />
of UNICEF, conducted a broad public awareness<br />
campaign to educate the public on the dangers of<br />
traffick<strong>in</strong>g and resources <strong>for</strong> assistance. Afghanistan<br />
does not adequately monitor its borders, but has<br />
developed a pilot program to beg<strong>in</strong> monitor<strong>in</strong>g <strong>for</strong><br />
evidence of traffick<strong>in</strong>g <strong>in</strong>to or out of the country at<br />
two sites along the Afghan-Pakistan and Afghan-<br />
Iran borders. Afghanistan has not ratified the 2000<br />
UN TIP Protocol.<br />
ALBANIA (Tier 2)<br />
Albania is a country of orig<strong>in</strong> <strong>for</strong> women and girls<br />
trafficked transnationally and <strong>in</strong>ternally <strong>for</strong> the<br />
purpose of commercial sexual exploitation; it is no<br />
longer considered a major country of transit, and it<br />
is not a significant country of dest<strong>in</strong>ation. Albanian<br />
victims are trafficked to Greece and Italy, with many<br />
