TRAFFICKING VICTIMS PROTECTION ACT —<br />

MINIMUM STANDARDS FOR THE ELIMINATION<br />

OF TRAFFICKING IN PERSONS<br />

<strong>Traffick<strong>in</strong>g</strong> Victims Protection Act of 2000, Div. A of Pub. L. No. 106-386, § 108, as amended.<br />

(A) M<strong>in</strong>imum standards<br />

For purposes of this chapter, the m<strong>in</strong>imum<br />

standards <strong>for</strong> the elim<strong>in</strong>ation of traffick<strong>in</strong>g<br />

applicable to the government of a country of<br />

orig<strong>in</strong>, transit, or dest<strong>in</strong>ation <strong>for</strong> a significant<br />

number of victims of severe <strong>for</strong>ms of traffick<strong>in</strong>g<br />

are the follow<strong>in</strong>g:<br />

(1) The government of the country should<br />

prohibit severe <strong>for</strong>ms of traffick<strong>in</strong>g <strong>in</strong><br />

persons and punish acts of such traffick<strong>in</strong>g.<br />

(2) For the know<strong>in</strong>g commission of any act<br />

of sex traffick<strong>in</strong>g <strong>in</strong>volv<strong>in</strong>g <strong>for</strong>ce, fraud,<br />

coercion, or <strong>in</strong> which the victim of sex<br />

traffick<strong>in</strong>g is a child <strong>in</strong>capable of giv<strong>in</strong>g<br />

mean<strong>in</strong>gful consent, or of traffick<strong>in</strong>g<br />

which <strong>in</strong>cludes rape or kidnapp<strong>in</strong>g or<br />

which causes a death, the government of<br />

the country should prescribe punishment<br />

commensurate with that <strong>for</strong> grave crimes,<br />

such as <strong>for</strong>cible sexual assault.<br />

(3) For the know<strong>in</strong>g commission of any act of<br />

a severe <strong>for</strong>m of traffick<strong>in</strong>g <strong>in</strong> persons, the<br />

government of the country should prescribe<br />

punishment that is sufficiently str<strong>in</strong>gent<br />

to deter and that adequately reflects the<br />

he<strong>in</strong>ous nature of the offense.<br />

(4) The government of the country should<br />

make serious and susta<strong>in</strong>ed ef<strong>for</strong>ts to<br />

elim<strong>in</strong>ate severe <strong>for</strong>ms of traffick<strong>in</strong>g <strong>in</strong><br />

persons.<br />

wholly or partly with<strong>in</strong> the territory of the<br />

country. After reasonable requests from<br />

the Department of State <strong>for</strong> data regard<strong>in</strong>g<br />

<strong>in</strong>vestigations, prosecutions, convictions,<br />

and sentences, a government, which<br />

does not provide such data, consistent<br />

with the capacity of such government to<br />

obta<strong>in</strong> such data, shall be presumed not to<br />

have vigorously <strong>in</strong>vestigated, prosecuted,<br />

convicted or sentenced such acts. Dur<strong>in</strong>g<br />

the periods prior to the annual report<br />

submitted on June 1, 2004, and on June<br />

1, 2005, and the periods afterwards<br />

until September 30 of each such year,<br />

the Secretary of State may disregard the<br />

presumption conta<strong>in</strong>ed <strong>in</strong> the preced<strong>in</strong>g<br />

sentence if the government has provided<br />

some data to the Department of State<br />

regard<strong>in</strong>g such acts and the Secretary has<br />

determ<strong>in</strong>ed that the government is mak<strong>in</strong>g<br />

a good faith ef<strong>for</strong>t to collect such data.<br />

(2) Whether the government of the country<br />

protects victims of severe <strong>for</strong>ms of<br />

traffick<strong>in</strong>g <strong>in</strong> persons and encourages<br />

their assistance <strong>in</strong> the <strong>in</strong>vestigation and<br />

prosecution of such traffick<strong>in</strong>g, <strong>in</strong>clud<strong>in</strong>g<br />

provisions <strong>for</strong> legal alternatives to their<br />

removal to countries <strong>in</strong> which they would<br />

face retribution or hardship, and ensures<br />

that victims are not <strong>in</strong>appropriately<br />

<strong>in</strong>carcerated, f<strong>in</strong>ed, or otherwise penalized<br />

solely <strong>for</strong> unlawful acts as a direct result of<br />

be<strong>in</strong>g trafficked.<br />

(B) Criteria<br />

In determ<strong>in</strong>ations under subsection (a)(4) of<br />

this section, the follow<strong>in</strong>g factors should be<br />

considered as <strong>in</strong>dicia of serious and susta<strong>in</strong>ed<br />

ef<strong>for</strong>ts to elim<strong>in</strong>ate severe <strong>for</strong>ms of traffick<strong>in</strong>g <strong>in</strong><br />

persons:<br />

(1) Whether the government of the country<br />

vigorously <strong>in</strong>vestigates and prosecutes acts<br />

of severe <strong>for</strong>ms of traffick<strong>in</strong>g <strong>in</strong> persons,<br />

and convicts and sentences persons<br />

responsible <strong>for</strong> such acts, that take place<br />

(3) Whether the government of the country has<br />

adopted measures to prevent severe <strong>for</strong>ms<br />

of traffick<strong>in</strong>g <strong>in</strong> persons, such as measures<br />

to <strong>in</strong><strong>for</strong>m and educate the public, <strong>in</strong>clud<strong>in</strong>g<br />

potential victims, about the causes and<br />

consequences of severe <strong>for</strong>ms of traffick<strong>in</strong>g<br />

<strong>in</strong> persons, measures to reduce the demand<br />

<strong>for</strong> commercial sex acts and <strong>for</strong> participation<br />

<strong>in</strong> <strong>in</strong>ternational sex tourism by nationals<br />

of the country, measures to ensure that its<br />

nationals who are deployed abroad as part of<br />

a peacekeep<strong>in</strong>g or other similar mission do not<br />

engage <strong>in</strong> or facilitate severe <strong>for</strong>ms of traffick<strong>in</strong>g<br />
