victims to NGOs. In 2006, the government provided<br />
f<strong>in</strong>ancial assistance to victims trafficked abroad.<br />
Some local governments provided some <strong>in</strong>-k<strong>in</strong>d<br />
assistance to NGO traffick<strong>in</strong>g shelters.<br />
Prevention<br />
The government conducted active public awareness<br />
ef<strong>for</strong>ts. In 2006, more than 1,900 articles on<br />
traffick<strong>in</strong>g were published <strong>in</strong> state-run national and<br />
regional newspapers and 800 segments were broadcast<br />
on radio and television. Surveys show significant<br />
public awareness of the dangers of traffick<strong>in</strong>g.<br />
Law en<strong>for</strong>cement officials met with community<br />
groups to discuss traffick<strong>in</strong>g. Law en<strong>for</strong>cement<br />
regularly <strong>in</strong>spected labor recruitment and tourism<br />
agencies to verify their legitimacy. Kazakhstan has<br />
not ratified the 2000 UN TIP Protocol.<br />
KENYA (Tier 2 Watch List)<br />
Kenya is a source, transit, and dest<strong>in</strong>ation country<br />
<strong>for</strong> men, women, and children trafficked <strong>for</strong> the<br />
purposes of <strong>for</strong>ced labor and commercial sexual<br />
exploitation. Kenyan children are trafficked with<strong>in</strong><br />
the country <strong>for</strong> domestic servitude, street vend<strong>in</strong>g,<br />
agricultural labor, and commercial sexual exploitation,<br />
<strong>in</strong>clud<strong>in</strong>g <strong>in</strong>volvement <strong>in</strong> the coastal sex tourism<br />
<strong>in</strong>dustry. Kenyan men, women, and girls are<br />
trafficked to the Middle East, other African nations,<br />
Europe, and North America <strong>for</strong> domestic servitude,<br />
enslavement <strong>in</strong> massage parlors and brothels, and<br />
<strong>for</strong>ced manual labor. Foreign employment agencies<br />
facilitate and profit from the traffick<strong>in</strong>g of Kenyan<br />
nationals to Middle Eastern nations, notably<br />
Saudi Arabia, the U.A.E., and Lebanon, as well as<br />
Germany. Ch<strong>in</strong>ese, Indian, and Pakistani women<br />
reportedly transit Nairobi en route to exploitation<br />
<strong>in</strong> Europe’s commercial sex trade. Brothels and<br />
massage parlors <strong>in</strong> Nairobi employ <strong>for</strong>eign women,<br />
some of whom are likely trafficked.<br />
The Government of Kenya does not fully comply<br />
with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of<br />
traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant ef<strong>for</strong>ts<br />
to do so. Kenya is placed on Tier 2 Watch List <strong>for</strong> a<br />
second consecutive year due to the lack of evidence<br />
of <strong>in</strong>creas<strong>in</strong>g ef<strong>for</strong>ts to combat severe <strong>for</strong>ms of traffick<strong>in</strong>g<br />
over the last year. The government should<br />
sensitize law en<strong>for</strong>cement officials throughout the<br />
country to traffick<strong>in</strong>g crimes, and it should push <strong>for</strong><br />
greater <strong>in</strong>vestigations and prosecutions of traffickers.<br />
It should also pass and implement comprehensive<br />
anti-traffick<strong>in</strong>g legislation; <strong>in</strong>stitute traffick<strong>in</strong>g<br />
awareness tra<strong>in</strong><strong>in</strong>g <strong>for</strong> diplomats posted overseas;<br />
and cont<strong>in</strong>ue its positive and expand<strong>in</strong>g ef<strong>for</strong>ts to<br />
address child sex tourism on the coast.<br />
Prosecution<br />
The government failed to punish acts of traffick<strong>in</strong>g<br />
dur<strong>in</strong>g the report<strong>in</strong>g period, but showed <strong>in</strong>creased<br />
law en<strong>for</strong>cement activity <strong>in</strong> the beg<strong>in</strong>n<strong>in</strong>g of <strong>2007</strong>.<br />
Kenya does not prohibit all <strong>for</strong>ms of traffick<strong>in</strong>g,<br />
though it crim<strong>in</strong>alizes the traffick<strong>in</strong>g of children and<br />
adults <strong>for</strong> sexual exploitation through its Sexual<br />
Offenses Act, enacted <strong>in</strong> July 2006. This law<br />
prescribes penalties that are sufficiently str<strong>in</strong>gent and<br />
commensurate with those <strong>for</strong> rape. However, Kenya<br />
lacks laws aga<strong>in</strong>st labor traffick<strong>in</strong>g. The Attorney<br />
General’s Office is review<strong>in</strong>g a draft comprehensive<br />
anti-traffick<strong>in</strong>g bill. The Kenya Police Service’s<br />
Human <strong>Traffick<strong>in</strong>g</strong> Unit conducted no <strong>in</strong>vestigations<br />
<strong>in</strong>to traffick<strong>in</strong>g cases dur<strong>in</strong>g the report<strong>in</strong>g period.<br />
There were no traffick<strong>in</strong>g prosecutions or convictions<br />
reported over the last year. A newly created community<br />
polic<strong>in</strong>g and child protection police unit,<br />
however, <strong>in</strong> February <strong>2007</strong> obta<strong>in</strong>ed <strong>in</strong>dictments<br />
— its first <strong>in</strong>dictments — of two men <strong>for</strong> allegedly<br />
traffick<strong>in</strong>g two Ethiopian m<strong>in</strong>ors to Kenya <strong>for</strong><br />
domestic servitude. Corruption among law en<strong>for</strong>cement<br />
authorities and other public officials hampered<br />
ef<strong>for</strong>ts to br<strong>in</strong>g traffickers to justice. In August 2006,<br />
two police officers <strong>in</strong> Trans-Nzoia were suspended<br />
from duty <strong>for</strong> complicity <strong>in</strong> traffick<strong>in</strong>g, but were<br />
re<strong>in</strong>stated without further discipl<strong>in</strong>ary action. In<br />
June 2006, the Tourism M<strong>in</strong>ister led police and other<br />
officials on a raid of a resort hotel suspected of host<strong>in</strong>g<br />
children <strong>in</strong> prostitution; two young girls were<br />
removed from the premises. Police reportedly also<br />
<strong>in</strong>vestigated traffick<strong>in</strong>g cases <strong>in</strong> the coastal and Rift<br />
Valley regions, but further <strong>in</strong><strong>for</strong>mation on result<strong>in</strong>g<br />
arrests or prosecutions was not provided.<br />
Protection<br />
While the government did not provide traffick<strong>in</strong>g<br />
victims shelter or access to medical or social<br />
services, it did improve its assistance to children<br />
fac<strong>in</strong>g labor exploitation. Victims are encouraged to<br />
assist with <strong>in</strong>vestigations and prosecutions, but are<br />
usually deported be<strong>for</strong>e the <strong>in</strong>vestigation concludes<br />
due to budget constra<strong>in</strong>ts, <strong>in</strong>sufficient capacity,<br />
and the absence of legal statutes under which to<br />
prosecute traffickers. Police also treat some sexually<br />
exploited children as crim<strong>in</strong>als rather than victims.<br />
In 2006, City Council social services departments<br />
<strong>in</strong> Nairobi, Mombasa, and Kisumu established<br />
shelters to rehabilitate street children vulnerable<br />
to <strong>for</strong>ced labor and sexual abuse; shelter staff need<br />
tra<strong>in</strong><strong>in</strong>g <strong>in</strong> recogniz<strong>in</strong>g and document<strong>in</strong>g traffick<strong>in</strong>g<br />
cases. In 2006, 5,026 children were removed<br />
from labor and 4,178 at-risk children were kept <strong>in</strong><br />
school through the <strong>in</strong>volvement of labor <strong>in</strong>spec-
