these offices registered compla<strong>in</strong>ts and filed reports<br />

of traffick<strong>in</strong>g crimes be<strong>for</strong>e turn<strong>in</strong>g victims over<br />

to NGOs <strong>for</strong> care. Dur<strong>in</strong>g the year, these offices<br />

received 47 human traffick<strong>in</strong>g cases, some <strong>in</strong>volv<strong>in</strong>g<br />

multiple victims, from NGOs and, occasionally,<br />

from police. Police officers reportedly returned<br />

victims to their homes. In May, a local NGO<br />

opened the country’s first permanent shelter <strong>for</strong><br />

child traffick<strong>in</strong>g victims, which was constructed on<br />

land donated by the Moamba District government.<br />

Prevention<br />

The government’s prevention ef<strong>for</strong>ts rema<strong>in</strong>ed<br />

weak. Most anti-traffick<strong>in</strong>g educational workshops<br />

were run by NGOs with government participation.<br />

Dur<strong>in</strong>g the year, law en<strong>for</strong>cement officials<br />

publicized several traffick<strong>in</strong>g cases and governmentowned<br />

media outlets covered such stories.<br />

NEPAL (Tier 2)<br />

Nepal is a source country <strong>for</strong> men, women, and children<br />

trafficked <strong>for</strong> the purposes of commercial sexual<br />

exploitation and <strong>in</strong>voluntary servitude. Children<br />

are trafficked <strong>in</strong>ternally and to India and the Middle<br />

East <strong>for</strong> commercial sexual exploitation or <strong>for</strong>ced<br />

marriage, as well as to India and with<strong>in</strong> the country<br />

<strong>for</strong> <strong>in</strong>voluntary servitude as child soldiers, domestic<br />

servants, and circus enterta<strong>in</strong>ment or factory workers.<br />

Nepalese women are trafficked to India and to<br />

countries of the Middle East <strong>for</strong> commercial sexual<br />

exploitation. They also migrate will<strong>in</strong>gly — though<br />

sometimes illegally — to Malaysia, Israel, South<br />

Korea, the United States, Saudi Arabia, United Arab<br />

Emirates, Qatar, and other Gulf states to work as<br />

domestic servants, but some subsequently face<br />

conditions of <strong>in</strong>voluntary servitude such as withhold<strong>in</strong>g<br />

of passports and other restrictions on movement,<br />

non-payment of wages, threats, and physical<br />

or sexual abuse. Despite the Government of Nepal’s<br />

ban on travel<strong>in</strong>g to Iraq <strong>for</strong> work, some Nepalese<br />

who believe they are be<strong>in</strong>g offered jobs <strong>in</strong> Jordan or<br />

Kuwait travel there, and then are later deceived and<br />

trafficked <strong>in</strong>to <strong>in</strong>voluntary servitude <strong>in</strong> Iraq.<br />

The Government of Nepal does not fully comply<br />

with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of<br />

traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant ef<strong>for</strong>ts<br />

to do so. Effective implementation of anti-traffick<strong>in</strong>g<br />

policies is hampered by political <strong>in</strong>stability and<br />

limited resources. The absence of local government<br />

<strong>in</strong> rural areas as a result of the decade-long <strong>in</strong>surgency<br />

has <strong>in</strong>creased the risk of traffick<strong>in</strong>g while<br />

constra<strong>in</strong><strong>in</strong>g the government’s efficiency. Despite<br />

these limitations, Nepal ma<strong>in</strong>ta<strong>in</strong>ed its ef<strong>for</strong>ts to<br />

prosecute sex traffick<strong>in</strong>g offenses and expanded<br />

local <strong>Women</strong>’s Police Cells to 24 stations. The<br />

government, however, was not able to adequately<br />

fund or staff the <strong>Women</strong>’s Cells, limit<strong>in</strong>g their effectiveness.<br />

Nepal also did not demonstrate a concerted<br />

ef<strong>for</strong>t to crim<strong>in</strong>ally prosecute and adequately<br />

punish labor recruiters who use deceptive practices<br />

to <strong>for</strong>ce workers <strong>in</strong>to <strong>in</strong>voluntary servitude abroad.<br />

Prosecution<br />

Nepal made significant ef<strong>for</strong>ts to prosecute cases<br />

of traffick<strong>in</strong>g <strong>for</strong> commercial sexual exploitation<br />

this year, but made <strong>in</strong>adequate progress <strong>in</strong> prosecut<strong>in</strong>g<br />

and punish<strong>in</strong>g traffick<strong>in</strong>g <strong>for</strong> <strong>in</strong>voluntary<br />

servitude. Nepal does not prohibit all <strong>for</strong>ms of<br />

traffick<strong>in</strong>g <strong>in</strong> persons, but prohibits slavery, the<br />

sell<strong>in</strong>g of human be<strong>in</strong>gs, and <strong>for</strong>ced prostitution<br />

through its Human <strong>Traffick<strong>in</strong>g</strong> Control Act of 1986.<br />

Prescribed punishments under this law — 5 to 20<br />

years’ imprisonment — are sufficiently str<strong>in</strong>gent<br />

and commensurate with those <strong>for</strong> other grave<br />

crimes. Fraudulent or deceptive labor recruitment is<br />

punishable by three to five years’ imprisonment or<br />

a f<strong>in</strong>e or both. From July 15, 2005 through July 14,<br />

2006, Nepal filed a total of 393 sex traffick<strong>in</strong>g cases<br />

at the district, appellate and Supreme Court levels.<br />

Of these cases, 87 were prosecuted to conviction, 60<br />

persons were acquitted, and 246 cases are pend<strong>in</strong>g.<br />

The government does not keep records on sentences<br />

and f<strong>in</strong>es, but NGO lawyers report that, <strong>in</strong> over half<br />

of the cases the government prosecuted, traffickers<br />

received the maximum prison sentence. Nepal did<br />

not report any cases filed aga<strong>in</strong>st corrupt government<br />

officials who may have facilitated traffick<strong>in</strong>g<br />

by tak<strong>in</strong>g bribes at the India-Nepal border or engag<strong>in</strong>g<br />

<strong>in</strong> document fraud.<br />

The government demonstrated only slight progress<br />

<strong>in</strong> adequately punish<strong>in</strong>g labor recruiters who use<br />

deceptive recruitment practices to coerce Nepali<br />

workers abroad <strong>for</strong> labor exploitation. This report<strong>in</strong>g<br />

period, the government reported receiv<strong>in</strong>g<br />

786 compla<strong>in</strong>ts aga<strong>in</strong>st agencies and <strong>in</strong>dividual<br />

recruiters, cancel<strong>in</strong>g licenses <strong>for</strong> 116 manpower<br />

agencies, and order<strong>in</strong>g compensation to workers<br />

total<strong>in</strong>g $450,000. However, Nepal did not report<br />

any prison sentences imposed on agency owners<br />

or employees found to be engag<strong>in</strong>g <strong>in</strong> labor traffick<strong>in</strong>g<br />

through the use of deceptive or fraudulent<br />

recruitment practices. Nepal should expand ef<strong>for</strong>ts<br />

to vigorously <strong>in</strong>vestigate and adequately punish<br />

recruitment agency owners and employees believed<br />

to be <strong>in</strong>volved <strong>in</strong> traffick<strong>in</strong>g, and should improve<br />

its law en<strong>for</strong>cement ef<strong>for</strong>ts aga<strong>in</strong>st corrupt officials<br />

facilitat<strong>in</strong>g traffick<strong>in</strong>g.<br />
