anti-traffick<strong>in</strong>g law, it prohibits slavery under Article<br />
260-261 of its penal code and coerced prostitution<br />
through Article 220. Prescribed punishment <strong>for</strong><br />
both crimes are sufficiently str<strong>in</strong>gent and commensurate<br />
with penalties prescribed <strong>for</strong> other grave<br />
crimes. In July 2006, the Sultan issued Royal Decree<br />
74 prohibit<strong>in</strong>g <strong>for</strong>ced labor and <strong>in</strong>creas<strong>in</strong>g the<br />
applicable penalties , but those penalties — up to<br />
one month <strong>in</strong> prison or f<strong>in</strong>es — are not sufficiently<br />
str<strong>in</strong>gent to deter this serious offense. In November<br />
2006, the M<strong>in</strong>istry of Manpower issued a legallyen<strong>for</strong>ceable<br />
circular prohibit<strong>in</strong>g employers from<br />
withholidng workers’ passports; the circular does<br />
not specify penalties <strong>for</strong> non-compliance, and the<br />
practice cont<strong>in</strong>ues to be widespread. The government<br />
did not report any prosecutions <strong>for</strong> traffick<strong>in</strong>g<br />
offenses under these laws <strong>in</strong> the last year and has<br />
taken no active measures to <strong>in</strong>vestigate traffick<strong>in</strong>g<br />
<strong>in</strong> persons offenses. Oman should significantly<br />
<strong>in</strong>crease crim<strong>in</strong>al <strong>in</strong>vestigations and prosecutions<br />
of traffick<strong>in</strong>g offenses. The government should also<br />
follow through with its plans to enact a comprehensive<br />
anti-traffick<strong>in</strong>g law that crim<strong>in</strong>alizes all <strong>for</strong>ms<br />
of traffick<strong>in</strong>g, and assigns penalties both sufficiently<br />
str<strong>in</strong>gent to deter the offense and reflective of the<br />
he<strong>in</strong>ous nature of the crime.<br />
Protection<br />
Dur<strong>in</strong>g the report<strong>in</strong>g period, Oman made no<br />
significant ef<strong>for</strong>ts to improve protections or services<br />
<strong>for</strong> victims of traffick<strong>in</strong>g. The government cont<strong>in</strong>ues<br />
to lack a systematic procedure to identify<br />
victims of traffick<strong>in</strong>g among vulnerable<br />
groups, such as illegal migrants and<br />
women arrested <strong>for</strong> prostitution. In May<br />
and June 2006, the government conducted<br />
sweeps to f<strong>in</strong>d, deta<strong>in</strong> and deport illegal<br />
migrant workers; Omani authorities did<br />
not, however, systematically identify<br />
traffick<strong>in</strong>g victims from among the group<br />
of deportees. As a result, victims may<br />
have been deta<strong>in</strong>ed and deported without adequate<br />
protection. Oman does not offer <strong>for</strong>eign victims legal<br />
alternatives to their removal to countries <strong>in</strong> which<br />
they may face hardship or retribution. The government<br />
reports that it encourages victims to assist <strong>in</strong><br />
<strong>in</strong>vestigations, but authorities often have not <strong>in</strong>vestigated<br />
cases of <strong>for</strong>eign workers who have escaped<br />
exploitative conditions and may have returned them<br />
to their abusive employers or recruit<strong>in</strong>g agencies.<br />
Prevention<br />
Oman made <strong>in</strong>sufficient ef<strong>for</strong>ts to prevent traffick<strong>in</strong>g<br />
<strong>in</strong> persons this year. Oman’s military and police<br />
cont<strong>in</strong>ued to monitor Oman’s borders to prevent<br />
illegal entry and human smuggl<strong>in</strong>g. The government<br />
also developed, <strong>in</strong> partnership with the Indian<br />
embassy, a pamphlet that will <strong>in</strong><strong>for</strong>m Indian workers<br />
of their rights and resources; as of the writ<strong>in</strong>g of this<br />
report, however, these pamphlets have not been<br />
distributed.<br />
PAKISTAN (Tier 2)<br />
Pakistan is a source, dest<strong>in</strong>ation, and transit country<br />
<strong>for</strong> men, women, and children trafficked <strong>for</strong> the<br />
purposes of sexual exploitation and <strong>in</strong>voluntary<br />
servitude. Pakistani women and men migrate<br />
voluntarily to the Gulf, Iran, Turkey, and Greece <strong>for</strong><br />
work as domestic servants or construction workers.<br />
Once abroad, however, some f<strong>in</strong>d themselves<br />
<strong>in</strong> situations of <strong>in</strong>voluntary servitude when faced<br />
with overwhelm<strong>in</strong>g recruitment and transportation<br />
fees, restrictions on their movement, and physical<br />
or sexual abuse. There were no new confirmed<br />
reports of the traffick<strong>in</strong>g of Pakistani boys to the<br />
Middle East to serve as camel jockeys, but some<br />
NGOs contend that Pakistani children are trafficked<br />
to the Gulf <strong>for</strong> sexual exploitation. Pakistan faces<br />
a significant <strong>in</strong>ternal traffick<strong>in</strong>g problem reportedly<br />
<strong>in</strong>volv<strong>in</strong>g thousands of women and children<br />
trafficked to settle debts and disputes or <strong>for</strong>ced<br />
<strong>in</strong>to sexual exploitation or domestic servitude.<br />
Unconfirmed estimates of Pakistani victims of<br />
bonded labor are <strong>in</strong> the millions. <strong>Women</strong> and children<br />
from Bangladesh, India, Burma, Afghanistan,<br />
Sri Lanka, Nepal, Azerbaijan, Iran, Kazakhstan,<br />
Kyrgz Republic, Turkmenistan, Uzbekistan, and<br />
Tajikistan are also trafficked to Pakistan <strong>for</strong> sexual<br />
exploitation and <strong>in</strong>voluntary servitude. In addition,<br />
Bangladeshi, Sri Lankan, Nepali, and Burmese<br />
women are trafficked through Pakistan.<br />
The Government of Pakistan does not fully comply<br />
with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation<br />
of traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant<br />
ef<strong>for</strong>ts to do so. Dur<strong>in</strong>g the report<strong>in</strong>g period,<br />
the government prosecuted traffickers, <strong>in</strong>clud<strong>in</strong>g<br />
government officials facilitat<strong>in</strong>g traffick<strong>in</strong>g, and<br />
cont<strong>in</strong>ued to refer victims to available protection<br />
services. Pakistan did not, however, demonstrate<br />
ef<strong>for</strong>ts to address the serious issues of bonded labor<br />
and other <strong>for</strong>ms of <strong>in</strong>voluntary servitude. Over the<br />
next year, Pakistan should cont<strong>in</strong>ue to <strong>in</strong>crease its<br />
anti-traffick<strong>in</strong>g ef<strong>for</strong>ts, particularly <strong>in</strong> the areas of<br />
bonded labor, <strong>for</strong>ced child labor, and <strong>in</strong>ternal traffick<strong>in</strong>g<br />
<strong>for</strong> commercial sexual exploitation.<br />
Prosecution<br />
The Government of Pakistan made uneven progress<br />
<strong>in</strong> prosecut<strong>in</strong>g traffick<strong>in</strong>g this year. Pakistan prohibits<br />
all <strong>for</strong>ms of traffick<strong>in</strong>g <strong>in</strong> persons through its<br />
