Prevention<br />
The Government of Chad cont<strong>in</strong>ued modest ef<strong>for</strong>ts<br />
to raise awareness about traffick<strong>in</strong>g dur<strong>in</strong>g the<br />
report<strong>in</strong>g period. The government, <strong>in</strong> collaboration<br />
with UNICEF and other partners, staged two<br />
public awareness-rais<strong>in</strong>g rallies on the exploitation<br />
of children as herders and domestics workers<br />
<strong>in</strong> Metekaga and Nderguigui; 6,000 people were<br />
present. Government-controlled television aired<br />
anti-traffick<strong>in</strong>g documentaries and government<br />
radio broadcast programs <strong>for</strong> parents about how to<br />
protect children from traffickers. The government<br />
denied reports that the Chadian National Army<br />
recruits m<strong>in</strong>ors. However, it agreed to cooperate<br />
with UNICEF to conduct a survey on child soldiers<br />
<strong>in</strong> Chad <strong>in</strong> <strong>2007</strong>. Chad has not ratified the 2000<br />
UN TIP Protocol.<br />
CHILE (Tier 2)<br />
Chile is a source, transit, and dest<strong>in</strong>ation country<br />
<strong>for</strong> women and children trafficked <strong>for</strong> the purpose<br />
of commercial sexual exploitation. Most victims of<br />
sex traffick<strong>in</strong>g are Chilean women and girls who are<br />
trafficked with<strong>in</strong> the country. Chileans are trafficked<br />
to neighbor<strong>in</strong>g countries, the United States, Spa<strong>in</strong>,<br />
and Japan <strong>for</strong> sexual and labor exploitation. Foreign<br />
victims are brought to Chile <strong>for</strong> commercial sexual<br />
exploitation and <strong>for</strong>ced labor from Peru, Argent<strong>in</strong>a,<br />
Colombia, Bolivia, and Ch<strong>in</strong>a. Ch<strong>in</strong>ese nationals<br />
transit Chile en route to Mexico, the United States,<br />
and Canada.<br />
The Government of Chile does not fully comply<br />
with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of<br />
traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant ef<strong>for</strong>ts<br />
to do so. The government made solid ef<strong>for</strong>ts to<br />
raise public awareness about the dangers of human<br />
traffick<strong>in</strong>g, to coord<strong>in</strong>ate government ef<strong>for</strong>ts to<br />
combat traffick<strong>in</strong>g, and to support NGO victimassistance<br />
programs. In the com<strong>in</strong>g year, the government<br />
should enact comprehensive anti-traffick<strong>in</strong>g<br />
legislation to crim<strong>in</strong>alize all <strong>for</strong>ms of traffick<strong>in</strong>g<br />
and <strong>in</strong>crease tra<strong>in</strong><strong>in</strong>g <strong>for</strong> judges, police, and key<br />
crim<strong>in</strong>al-justice personnel.<br />
Prosecution<br />
The Government of Chile cont<strong>in</strong>ued to improve its<br />
law en<strong>for</strong>cement ef<strong>for</strong>ts aga<strong>in</strong>st traffickers. Chile<br />
does not prohibit all <strong>for</strong>ms of traffick<strong>in</strong>g, though<br />
it crim<strong>in</strong>alizes transnational traffick<strong>in</strong>g <strong>for</strong> sexual<br />
exploitation through Article 367 of its penal code.<br />
Penalties under this statute range from three to<br />
20 years’ imprisonment, depend<strong>in</strong>g on whether<br />
aggravated circumstances exist. Such penalties<br />
are sufficiently str<strong>in</strong>gent and commensurate with<br />
penalties <strong>for</strong> rape and other grave crimes. However,<br />
the government does not prohibit labor traffick<strong>in</strong>g<br />
and some <strong>for</strong>ms of <strong>in</strong>ternal traffick<strong>in</strong>g. A draft<br />
anti-traffick<strong>in</strong>g law is now pend<strong>in</strong>g be<strong>for</strong>e Chile’s<br />
Chamber of Deputies; it should be passed so<br />
that all <strong>for</strong>ms of traffick<strong>in</strong>g are clearly prohibited<br />
and punished. Dur<strong>in</strong>g the report<strong>in</strong>g period, the<br />
government opened 13 traffick<strong>in</strong>g <strong>in</strong>vestigations,<br />
completed two prosecutions, and obta<strong>in</strong>ed one<br />
conviction, which resulted <strong>in</strong> a six-year sentence.<br />
The government also opened 94 <strong>in</strong>vestigations <strong>in</strong>to<br />
the promotion and facilitation of child prostitution,<br />
obta<strong>in</strong><strong>in</strong>g n<strong>in</strong>e convictions. Chilean authorities<br />
reported difficulties, however, <strong>in</strong> obta<strong>in</strong><strong>in</strong>g<br />
convictions <strong>in</strong> traffick<strong>in</strong>g cases where witnesses had<br />
not been physically victimized or <strong>in</strong>jured. Chilean<br />
police engaged <strong>in</strong> covert anti-traffick<strong>in</strong>g operations<br />
and st<strong>in</strong>gs and <strong>in</strong>corporated traffick<strong>in</strong>g <strong>in</strong>to police<br />
tra<strong>in</strong><strong>in</strong>g programs <strong>in</strong> 2006. The government works<br />
closely with neighbor<strong>in</strong>g governments and the<br />
United States on <strong>in</strong>ternational traffick<strong>in</strong>g cases. No<br />
government officials were <strong>in</strong>vestigated or prosecuted<br />
<strong>for</strong> complicity with traffick<strong>in</strong>g dur<strong>in</strong>g the<br />
report<strong>in</strong>g period.<br />
Protection<br />
The Chilean government made solid ef<strong>for</strong>ts to assist<br />
traffick<strong>in</strong>g victims dur<strong>in</strong>g the report<strong>in</strong>g period. The<br />
government systematically identifies and refers<br />
traffick<strong>in</strong>g victims to NGOs and shelters, where they<br />
receive psychological counsel<strong>in</strong>g and support. The<br />
government also funds victim-assistance programs<br />
and projects. Chilean authorities encourage victims<br />
to assist <strong>in</strong> the <strong>in</strong>vestigation and prosecution of<br />
their traffickers. There were no reports that victims<br />
were punished <strong>for</strong> unlawful acts committed as a<br />
direct result of be<strong>in</strong>g trafficked. <strong>Traffick<strong>in</strong>g</strong> victims<br />
may rema<strong>in</strong> <strong>in</strong> Chile dur<strong>in</strong>g legal proceed<strong>in</strong>gs<br />
aga<strong>in</strong>st their traffickers, and may apply <strong>for</strong> legal<br />
residency. The government works with <strong>for</strong>eign<br />
governments to facilitate the safe return of Chilean<br />
victims trafficked abroad.<br />
Prevention<br />
The government cont<strong>in</strong>ued prevention ef<strong>for</strong>ts dur<strong>in</strong>g<br />
the report<strong>in</strong>g period. The government conducted<br />
regular education and outreach campaigns, which<br />
were geared to prevent the sexual exploitation of<br />
m<strong>in</strong>ors. The government also cont<strong>in</strong>ued to conduct<br />
jo<strong>in</strong>t public awareness-rais<strong>in</strong>g projects with NGOs<br />
and <strong>in</strong>ternational organizations, and it funded antitraffick<strong>in</strong>g<br />
tra<strong>in</strong><strong>in</strong>g programs and projects.<br />
