cases, up from 386 <strong>in</strong> 2005. The Government of<br />

Moldova did not provide prosecution data <strong>for</strong> 2006,<br />

however. Convictions were obta<strong>in</strong>ed aga<strong>in</strong>st 71<br />

traffickers <strong>in</strong> 2006, up from 58 convictions <strong>in</strong> 2005.<br />

Sentenc<strong>in</strong>g data <strong>for</strong> 2006 was <strong>in</strong>conclusive.<br />

Protection<br />

The government made no real ef<strong>for</strong>ts to improve<br />

victim assistance and protection <strong>in</strong> 2006, <strong>in</strong> part<br />

because of its limited resources. Despite implementation<br />

of a referral mechanism <strong>in</strong> five counties,<br />

most government officials were not proactive<br />

<strong>in</strong> identify<strong>in</strong>g victims or potential victims, even<br />

when allegations were made. Police did refer some<br />

underage victims who were repatriated from Russia<br />

to NGOs <strong>for</strong> assistance. All victim assistance and<br />

protection cont<strong>in</strong>ued to be provided by NGOs and<br />

<strong>in</strong>ternational organizations and funded by <strong>for</strong>eign<br />

donors, although the government did provide<br />

limited <strong>in</strong>-k<strong>in</strong>d support to some NGOs. The<br />

government <strong>in</strong> 2006 provided a new build<strong>in</strong>g <strong>for</strong><br />

the IOM-managed and funded rehabilitation center<br />

<strong>for</strong> traffick<strong>in</strong>g victims. Victims are granted a 30-day<br />

reflection period. Victims generally do not assist law<br />

en<strong>for</strong>cement with <strong>in</strong>vestigations or prosecutions<br />

because the government is largely unable to protect<br />

victims from retaliation by traffickers. Despite a<br />

2005 law to the contrary, victims cont<strong>in</strong>ued to be<br />

penalized <strong>for</strong> prostitution or illegal border cross<strong>in</strong>g.<br />

Prevention<br />

Moldova’s ef<strong>for</strong>ts to prevent traffick<strong>in</strong>g rema<strong>in</strong>ed<br />

weak <strong>in</strong> 2006. The government cont<strong>in</strong>ued to rely on<br />

NGOs and <strong>in</strong>ternational organizations to provide<br />

the majority of public awareness and education<br />

campaigns. Officers from CCTIP met with students<br />

and teachers at several schools <strong>in</strong> Chis<strong>in</strong>au and<br />

provided <strong>in</strong>terviews to local media dur<strong>in</strong>g the<br />

report<strong>in</strong>g period. Some government officials participated<br />

<strong>in</strong> radio programs discuss<strong>in</strong>g traffick<strong>in</strong>g.<br />

MONGOLIA (Tier 2)<br />

Mongolia is a source country <strong>for</strong> women and men<br />

trafficked <strong>for</strong> the purposes of sexual exploitation and<br />

<strong>for</strong>ced labor. <strong>Traffick<strong>in</strong>g</strong> reportedly has <strong>in</strong>creased<br />

<strong>in</strong> Mongolia over the last few years but rema<strong>in</strong>s<br />

difficult to quantify. Most victims do not file police<br />

reports or approach NGOs. Mongolian girls and<br />

women are trafficked to People’s Republic of Ch<strong>in</strong>a,<br />

Macau, and South Korea <strong>for</strong> commercial sexual<br />

exploitation. A significant number of North Koreans<br />

contract laborers <strong>in</strong> Mongolia are not free to leave<br />

their employment, rais<strong>in</strong>g strong concerns that<br />

their labor is compulsory. Some Mongolian women<br />

who enter <strong>in</strong>to marriages with <strong>for</strong>eign husbands<br />

— ma<strong>in</strong>ly South Koreans — discovered conditions of<br />

<strong>in</strong>voluntary servitude after mov<strong>in</strong>g to their husbands’<br />

homeland. Underage girls are trafficked <strong>in</strong>ternally <strong>for</strong><br />

the purpose of commercial sexual exploitation.<br />

The Government of Mongolia does not fully<br />

comply with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation<br />

of traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant<br />

ef<strong>for</strong>ts to do so. Mongolia should <strong>in</strong>crease its<br />

ef<strong>for</strong>ts to combat traffick<strong>in</strong>g <strong>in</strong> persons, particularly<br />

through law en<strong>for</strong>cement means. The government<br />

should ensure that it has the legal tools to prosecute<br />

all traffick<strong>in</strong>g offenses, <strong>in</strong>clud<strong>in</strong>g those which occur<br />

through fraud or coercion.<br />

Prosecution<br />

The Government of Mongolia’s anti-traffick<strong>in</strong>g<br />

law en<strong>for</strong>cement ef<strong>for</strong>ts did not improve over the<br />

report<strong>in</strong>g period. Mongolia appears to prohibit all<br />

<strong>for</strong>ms of traffick<strong>in</strong>g <strong>in</strong> persons through Section 113<br />

of its crim<strong>in</strong>al code, with prescribed penalties of 10<br />

to 15 years’ imprisonment, which are sufficiently<br />

str<strong>in</strong>gent and commensurate with those <strong>for</strong> other<br />

grave crimes. Over the last year, the government did<br />

not prosecute any traffick<strong>in</strong>g offenses or convict<br />

any traffick<strong>in</strong>g offenders, a decl<strong>in</strong>e from five cases<br />

prosecuted and one trafficker convicted dur<strong>in</strong>g the<br />

previous year. Twelve cases of traffick<strong>in</strong>g <strong>in</strong>volv<strong>in</strong>g<br />

25 victims were <strong>in</strong>vestigated by police dur<strong>in</strong>g<br />

the year. Prosecution ef<strong>for</strong>ts are hampered by the<br />

paucity of victims fil<strong>in</strong>g police compla<strong>in</strong>ts, as well<br />

as by the fact that State prosecutors do not pursue<br />

some cases presented to them by the police. Legal<br />

changes are under consideration that would help<br />

ensure the effective prosecution of traffick<strong>in</strong>g<br />

crimes. While there were reports that some law<br />

en<strong>for</strong>cement officials may have facilitated traffick<strong>in</strong>g<br />

crimes, there were no documented cases of such<br />

facilitation and no <strong>in</strong>vestigations or prosecutions of<br />

officials <strong>for</strong> complicity <strong>in</strong> traffick<strong>in</strong>g.<br />

Protection<br />

The Mongolian government susta<strong>in</strong>ed ef<strong>for</strong>ts to<br />

protect victims of traffick<strong>in</strong>g over the last year.<br />

Although the government does not run or fund<br />

shelters <strong>for</strong> victims of traffick<strong>in</strong>g, Mongolian<br />

authorities refer identified victims to protection<br />

services provided by NGOs. Victims are encouraged<br />

to participate <strong>in</strong> the <strong>in</strong>vestigation of traffickers.<br />

The government ensures that identified victims<br />

of traffick<strong>in</strong>g are not penalized <strong>for</strong> unlawful acts<br />

committed as a direct result of be<strong>in</strong>g trafficked.<br />

The government cont<strong>in</strong>ued to provide assistance<br />

to child victims of commercial sexual exploitation,<br />

through a police program that encourages<br />

their re-entry <strong>in</strong>to school. In 2006, the government<br />
