announced plans to open a consulate <strong>in</strong> Macau <strong>in</strong><br />

order to provide services to Mongolian nationals,<br />

<strong>in</strong>clud<strong>in</strong>g those who have become victims of traffick<strong>in</strong>g<br />

<strong>in</strong> the Macau Special Adm<strong>in</strong>istrative Region.<br />

The government began cooperation with the IOM<br />

on a program to assist with repatriation of victims<br />

and to provide counsel<strong>in</strong>g and other services.<br />

Prevention<br />

The Mongolian government cont<strong>in</strong>ued ef<strong>for</strong>ts to<br />

raise public awareness of traffick<strong>in</strong>g by conduct<strong>in</strong>g<br />

an anti-traffick<strong>in</strong>g campaign throughout the year.<br />

The M<strong>in</strong>istry of Foreign Affairs cont<strong>in</strong>ued its distribution<br />

of <strong>in</strong><strong>for</strong>mation on traffick<strong>in</strong>g to consular<br />

officers serv<strong>in</strong>g overseas. Mongolia has not ratified<br />

the 2000 UN TIP Protocol.<br />

MONTENEGRO (Tier 2)<br />

Montenegro is a source, transit, and dest<strong>in</strong>ation<br />

country <strong>for</strong> women and girls trafficked with<strong>in</strong> the<br />

country and transnationally <strong>for</strong> the purpose of<br />

commercial sexual exploitation. <strong>Women</strong> and girls<br />

from Ukra<strong>in</strong>e, Lithuania, Bosnia and Herzegov<strong>in</strong>a,<br />

Russia, and Serbia were trafficked to Montenegro<br />

<strong>for</strong> commercial sexual exploitation.<br />

The Government of Montenegro does not<br />

fully comply with the m<strong>in</strong>imum standards<br />

<strong>for</strong> the elim<strong>in</strong>ation of traffick<strong>in</strong>g; however,<br />

it is mak<strong>in</strong>g significant ef<strong>for</strong>ts to do so.<br />

Montenegro became <strong>in</strong>dependent <strong>in</strong><br />

2006, dissolv<strong>in</strong>g the <strong>for</strong>mer State Union<br />

of Serbia and Montenegro. In past years,<br />

Montenegro’s activities were reported<br />

separately from that of Serbia, but the<br />

State Union was ranked as a whole on the<br />

aggregate level of its ef<strong>for</strong>ts to combat traffick<strong>in</strong>g.<br />

The government should make additional ef<strong>for</strong>ts to<br />

identify, arrest, and prosecute traffickers and police<br />

officers who protect traffick<strong>in</strong>g operations. The<br />

government should cont<strong>in</strong>ue educat<strong>in</strong>g law en<strong>for</strong>cement<br />

officers on recogniz<strong>in</strong>g traffick<strong>in</strong>g cases, s<strong>in</strong>ce<br />

the special anti-traffick<strong>in</strong>g team was elim<strong>in</strong>ated <strong>in</strong><br />

early <strong>2007</strong> as part of an overall plan to reorganize<br />

the police. The government plans to name a senior<br />

police officer to assume responsibility <strong>for</strong> coord<strong>in</strong>at<strong>in</strong>g<br />

anti-traffick<strong>in</strong>g activities. The government should<br />

make greater ef<strong>for</strong>ts to prosecute and convict police<br />

officials who are <strong>in</strong>volved <strong>in</strong> traffick<strong>in</strong>g.<br />

Prosecution<br />

The Government of Montenegro demonstrated some<br />

discernable progress <strong>in</strong> its anti-traffick<strong>in</strong>g law en<strong>for</strong>cement<br />

ef<strong>for</strong>ts over the last year. Montenegro prohibits<br />

sex and labor traffick<strong>in</strong>g through Article 444 of its<br />

crim<strong>in</strong>al code. Penalties <strong>for</strong> traffick<strong>in</strong>g are sufficiently<br />

str<strong>in</strong>gent, and penalties <strong>for</strong> traffick<strong>in</strong>g <strong>for</strong> commercial<br />

sexual exploitation are commensurate with those <strong>for</strong><br />

rape. The government rout<strong>in</strong>ely provided data on<br />

arrests, prosecutions, convictions, and sentences <strong>in</strong><br />

traffick<strong>in</strong>g cases <strong>in</strong> 2006, both periodically (<strong>in</strong>clud<strong>in</strong>g<br />

press releases) as monthly reports, and as an<br />

annual summary. Eight persons, <strong>in</strong> two cases, were<br />

convicted of traffick<strong>in</strong>g <strong>in</strong> persons offenses <strong>in</strong> 2006.<br />

Three persons were convicted of attempt<strong>in</strong>g to traffic<br />

Bangladeshi nationals to Western Europe through<br />

Montenegro <strong>for</strong> labor exploitation. Sentences<br />

imposed on the three were: three years’ imprisonment;<br />

two years and eight months’ imprisonment;<br />

and two years and six months’ imprisonment. Law<br />

en<strong>for</strong>cement officials currently are <strong>in</strong>vestigat<strong>in</strong>g other<br />

suspected traffick<strong>in</strong>g cases. The government provides<br />

extensive tra<strong>in</strong><strong>in</strong>g to police, prosecutors, judges, and<br />

other officials on how to recognize, <strong>in</strong>vestigate, and<br />

prosecute traffick<strong>in</strong>g. In cooperation with the Italian<br />

government, the Government of Montenegro drafted<br />

a Manual <strong>for</strong> Tra<strong>in</strong><strong>in</strong>g Judges and Prosecutors. The<br />

government provided tra<strong>in</strong><strong>in</strong>g on traffick<strong>in</strong>g to police<br />

of all ranks. In <strong>2007</strong>, as part of a reorganization ef<strong>for</strong>t,<br />

Montenegro elim<strong>in</strong>ated the police special anti-traffick<strong>in</strong>g<br />

team and its officers were assigned other duties.<br />

Low-level corruption among police and customs officials<br />

who unofficially provide security to nightclubs<br />

or bars that serve as traffick<strong>in</strong>g outlets allows some<br />

traffickers to evade law en<strong>for</strong>cement ef<strong>for</strong>ts.<br />

Protection<br />

The Government of Montenegro demonstrated<br />

<strong>in</strong>creased ef<strong>for</strong>ts to protect and assist victims of<br />

traffick<strong>in</strong>g. The Montenegr<strong>in</strong> government did not<br />

demonstrate use of a systematic ef<strong>for</strong>t to identify<br />

victims of traffick<strong>in</strong>g among vulnerable populations,<br />

such as <strong>for</strong>eigners found <strong>in</strong> prostitution<br />

or deta<strong>in</strong>ed <strong>for</strong> immigration violations. It did,<br />

however, encourage victims to assist <strong>in</strong> the <strong>in</strong>vestigation<br />

and prosecution of traffick<strong>in</strong>g crimes,<br />

though few cases were actually developed <strong>in</strong> the last<br />

year. Occasionally this encouragement may amount<br />

to excessive pressure on victims. Victims may file<br />

civil suits aga<strong>in</strong>st traffickers, but this has not yet<br />

occurred. Montenegro issues temporary residence<br />

permits <strong>for</strong> <strong>for</strong>eign victims of traffick<strong>in</strong>g <strong>for</strong> up to<br />

one year at a time; if necessary, victims are resettled<br />

to third countries. Victims are not deta<strong>in</strong>ed,<br />

prosecuted, f<strong>in</strong>ed, or otherwise penalized <strong>for</strong><br />

unlawful acts committed as a direct result of be<strong>in</strong>g<br />

trafficked. The Government provides adequate<br />

protection, shelter, and care <strong>for</strong> victims. There are<br />

two shelters <strong>for</strong> victims of traffick<strong>in</strong>g, one run by
