14-year-old Jenny left her native Nigeria <strong>for</strong> the<br />

United States to work <strong>in</strong> the home of a couple,<br />

also orig<strong>in</strong>ally from an African country. She<br />

thought she would be paid to look after their<br />

children, but the reality was very different. For<br />

five years Jenny was repeatedly raped by her<br />

employer and his wife physically assaulted her,<br />

sometimes with a cane, and on one occasion<br />

with a high-heeled shoe. Tipped off by a local<br />

NGO, law en<strong>for</strong>cement officials rescued Jenny<br />

and prosecuted the perpetrators.<br />

“<strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Persons</strong>”<br />

Def<strong>in</strong>ed<br />

The <strong>Traffick<strong>in</strong>g</strong> Victims Protection Act def<strong>in</strong>es “severe <strong>for</strong>ms of<br />

traffick<strong>in</strong>g <strong>in</strong> persons” as:<br />

(a) sex traffick<strong>in</strong>g <strong>in</strong> which a commercial sex act is <strong>in</strong>duced by<br />

<strong>for</strong>ce, fraud, or coercion, or <strong>in</strong> which the person is <strong>in</strong>duced to<br />

per<strong>for</strong>m such an act has not atta<strong>in</strong>ed 18 years of age; or<br />

(b) the recruitment, harbor<strong>in</strong>g, transportation, provision, or<br />

obta<strong>in</strong><strong>in</strong>g of a person <strong>for</strong> labor or services, through the use<br />

of <strong>for</strong>ce, fraud, or coercion <strong>for</strong> the purpose of subjection to<br />

<strong>in</strong>voluntary servitude, peonage, debt bondage or slavery.<br />

Def<strong>in</strong>ition of Terms<br />

Sex traffick<strong>in</strong>g means the recruitment, harbor<strong>in</strong>g, transportation,<br />

provision, or obta<strong>in</strong><strong>in</strong>g of a person <strong>for</strong> the purpose of a commercial<br />

sex act.<br />

Commercial sex act means any sex act on account of which<br />

anyth<strong>in</strong>g of value is given to or received by any person.<br />

Coercion means (a) threats of serious harm to or physical restra<strong>in</strong>t<br />

aga<strong>in</strong>st any person; (b) any scheme, plan or pattern <strong>in</strong>tended to<br />

cause a person to believe that failure to per<strong>for</strong>m an act would result<br />

<strong>in</strong> serious harm to or physical restra<strong>in</strong>t aga<strong>in</strong>st any person; or, (c) the<br />

abuse or threatened abuse of the legal process.<br />

Involuntary servitude <strong>in</strong>cludes a condition of servitude <strong>in</strong>duced<br />

by means of (a) any scheme, plan, or pattern <strong>in</strong>tended to cause a<br />

person to believe that, if that person did not enter <strong>in</strong>to or cont<strong>in</strong>ue <strong>in</strong><br />

such condition, that person or another person would suffer serious<br />

harm or physical restra<strong>in</strong>t; or (b) the abuse or threatened abuse of<br />

the legal process.<br />

Labor <strong>Traffick<strong>in</strong>g</strong><br />

Most <strong>in</strong>stances of <strong>for</strong>ced labor occur as unscrupulous<br />

employers take advantage of gaps <strong>in</strong> law<br />

en<strong>for</strong>cement to exploit vulnerable workers. These<br />

workers are made more vulnerable to <strong>for</strong>ced labor<br />

practices because of unemployment, poverty,<br />

crime, discrim<strong>in</strong>ation, corruption, political<br />

conflict, and cultural acceptance of the practice.<br />

Immigrants are particularly vulnerable, but<br />

<strong>in</strong>dividuals are also <strong>for</strong>ced <strong>in</strong>to labor <strong>in</strong> their own<br />

countries. Female victims of <strong>for</strong>ced or bonded<br />

labor, especially women and girls <strong>in</strong> domestic<br />

servitude, are often sexually abused.<br />

Forced labor is a <strong>for</strong>m of human traffick<strong>in</strong>g<br />

that can be harder to identify and estimate than<br />

sex traffick<strong>in</strong>g. It may not <strong>in</strong>volve the<br />

same crim<strong>in</strong>al networks profit<strong>in</strong>g from<br />

transnational traffick<strong>in</strong>g <strong>for</strong> sexual<br />

exploitation. More often, <strong>in</strong>dividuals are<br />

guilty of subject<strong>in</strong>g one domestic servant<br />

or hundreds of unpaid workers at a<br />

factory to <strong>in</strong>voluntary servitude.<br />

Bonded Labor<br />

One <strong>for</strong>m of <strong>for</strong>ce or coercion is the<br />

use of a bond, or debt, to keep a person<br />

under subjugation. This is referred to<br />

<strong>in</strong> law and policy as “bonded labor” or<br />

“debt bondage.” It is crim<strong>in</strong>alized under<br />

U.S. law and <strong>in</strong>cluded as a <strong>for</strong>m of exploitation<br />

related to traffick<strong>in</strong>g <strong>in</strong> the United<br />

Nations Protocol To Prevent, Suppress,<br />

and Punish <strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Persons</strong>,<br />

Especially <strong>Women</strong> and Children (UN<br />

TIP Protocol). Many workers around the<br />

world fall victim to debt bondage when<br />

traffickers or recruiters unlawfully exploit<br />

an <strong>in</strong>itial debt the worker assumed as<br />

part of the terms of employment or when<br />

workers <strong>in</strong>herit debt <strong>in</strong> more traditional<br />

systems of bonded labor. Traditional<br />

bonded labor <strong>in</strong> South Asia enslaves huge<br />

numbers of people from generation to<br />

generation.
