worked with Spanish authorities to break up two<br />

traffick<strong>in</strong>g r<strong>in</strong>gs, one of which was transport<strong>in</strong>g Cape<br />

Verdeans through Senegal and The Gambia to Spa<strong>in</strong>.<br />

Although at least four sex tourists were prosecuted<br />

<strong>for</strong> pedophilia dur<strong>in</strong>g the year, the special commissariat<br />

set up by the Interior M<strong>in</strong>istry <strong>in</strong> 2005 to fight<br />

sex tourism has taken no def<strong>in</strong>itive actions.<br />

Protection<br />

The Senegalese government demonstrated susta<strong>in</strong>ed<br />

ef<strong>for</strong>ts to provide care <strong>for</strong> traffick<strong>in</strong>g victims dur<strong>in</strong>g<br />

the year. The government’s G<strong>in</strong>ddi <strong>Center</strong> <strong>for</strong> atrisk-children,<br />

<strong>in</strong>clud<strong>in</strong>g traffick<strong>in</strong>g victims, received<br />

373 children dur<strong>in</strong>g the year, but failed to provide<br />

specific data on the number of traffick<strong>in</strong>g victims<br />

aided. The <strong>Center</strong>’s child protection hotl<strong>in</strong>e received<br />

21,533 calls dur<strong>in</strong>g the year, and the government<br />

provided tra<strong>in</strong><strong>in</strong>g to <strong>Center</strong> personnel to help them<br />

address the needs of traffick<strong>in</strong>g victims and street<br />

children. In October 2006, a Presidential Council<br />

on Street Children recommended the creation of<br />

a partnership between the government, NGOs,<br />

religious leaders, and donors to provide care <strong>for</strong><br />

street children, many of whom may be escaped traffick<strong>in</strong>g<br />

victims or vulnerable to be<strong>in</strong>g trafficked. The<br />

government does not encourage all victims to assist<br />

<strong>in</strong> traffick<strong>in</strong>g <strong>in</strong>vestigations or prosecutions, though<br />

officials encourage boys trafficked by religious<br />

teachers to help identify and prosecute their teachers.<br />

The government does not provide traffick<strong>in</strong>gspecific<br />

legal alternatives to the removal of victims<br />

to countries where they face hardship or retribution.<br />

Victims may file refugee asylum claims <strong>for</strong> temporary<br />

or permanent residency. Although the anti-traffick<strong>in</strong>g<br />

law prohibits victims from be<strong>in</strong>g penalized <strong>for</strong> acts<br />

related to be<strong>in</strong>g trafficked, child victims of traffick<strong>in</strong>g<br />

are arrested and prosecuted.<br />

Prevention<br />

The Government of Senegal made modest ef<strong>for</strong>ts<br />

to raise awareness about traffick<strong>in</strong>g dur<strong>in</strong>g the<br />

report<strong>in</strong>g period. The President and the World Bank<br />

co-hosted a Presidential Council on street children<br />

<strong>in</strong> October 2006, with the President propos<strong>in</strong>g<br />

that every Senegalese family take responsibility <strong>for</strong><br />

one street child. The President and the M<strong>in</strong>ister<br />

of Family also discussed traffick<strong>in</strong>g with religious<br />

officials. In December 2006, the Family M<strong>in</strong>istry<br />

organized donor-funded workshops and roundtables<br />

<strong>in</strong> Mbour, Kolda, and Fatick to raise awareness<br />

among government officials and the general<br />

population about the dangers of child labor.<br />

SERBIA (Tier 2)<br />

Serbia is a source, transit, and dest<strong>in</strong>ation country<br />

<strong>for</strong> women and girls trafficked transnationally and<br />

<strong>in</strong>ternally <strong>for</strong> the purpose of commercial sexual<br />

exploitation. Foreign victims orig<strong>in</strong>ated primarily<br />

from Macedonia, Ukra<strong>in</strong>e, Moldova, Bosnia and<br />

Herzegov<strong>in</strong>a, Bulgaria, and Albania and some transited<br />

Serbia en route to Western Europe. Internal<br />

sex traffick<strong>in</strong>g of Serbian women and girls <strong>in</strong>creased<br />

over the past year with traffickers <strong>in</strong>creas<strong>in</strong>gly utiliz<strong>in</strong>g<br />

Internet chat rooms and SMS (short messag<strong>in</strong>g<br />

service) to recruit young people. In some cases<br />

children were trafficked <strong>in</strong>to <strong>for</strong>ced labor or <strong>for</strong>ced<br />

street begg<strong>in</strong>g.<br />

The Government of Serbia does not fully comply<br />

with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of<br />

traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant ef<strong>for</strong>ts<br />

to do so. The government passed a comprehensive<br />

national strategy, augmented prevention ef<strong>for</strong>ts, and<br />

cont<strong>in</strong>ued tra<strong>in</strong><strong>in</strong>g ef<strong>for</strong>ts at the national and local<br />

levels. The government should aggressively prosecute<br />

cases and ensure that traffickers receive jail sentences<br />

consistent with the he<strong>in</strong>ous nature of the offense.<br />

Prosecution<br />

The Government of Serbia demonstrated cont<strong>in</strong>ued<br />

ef<strong>for</strong>ts to actively <strong>in</strong>vestigate traffick<strong>in</strong>g cases <strong>in</strong> the<br />

last year, though punishment <strong>for</strong> traffick<strong>in</strong>g crimes<br />

rema<strong>in</strong>ed weak. The crim<strong>in</strong>al code <strong>for</strong> Serbia, which<br />

went <strong>in</strong>to effect <strong>in</strong> January 2006, crim<strong>in</strong>ally prohibits<br />

sex and labor traffick<strong>in</strong>g <strong>in</strong> article 388. Penalties<br />

<strong>for</strong> commercial sexual exploitation are commensurate<br />

with those <strong>for</strong> rape. The law prescribes penalties<br />

<strong>for</strong> traffick<strong>in</strong>g that are sufficiently str<strong>in</strong>gent;<br />

however, traffickers may receive imposed sentences<br />

that are light or suspended. Even after the Supreme<br />

Court confirms a verdict, <strong>in</strong>efficient adm<strong>in</strong>istrative<br />

procedures cause delay, and it is not uncommon<br />

<strong>for</strong> convicted traffickers to rema<strong>in</strong> free and able to<br />

cont<strong>in</strong>ue traffick<strong>in</strong>g <strong>for</strong> years. Of the three highprofile<br />

prosecutions from previous years, one trafficker<br />

orig<strong>in</strong>ally sentenced <strong>in</strong> March 2004 still has<br />

not begun serv<strong>in</strong>g his sentence. In 2006, the government<br />

filed 37 crim<strong>in</strong>al cases aga<strong>in</strong>st 84 people<br />

<strong>for</strong> traffick<strong>in</strong>g <strong>in</strong> persons, up from 34 <strong>in</strong>dividuals<br />

<strong>in</strong>dicted last year. Eleven people were convicted <strong>for</strong><br />

traffick<strong>in</strong>g <strong>in</strong> persons; sentences ranged from three<br />

to eight years’ imprisonment. The organized crime<br />

police <strong>for</strong>ce <strong>in</strong>cludes a full-time traffick<strong>in</strong>g unit<br />

and the border police <strong>for</strong>ce has a full-time office to<br />

combat traffick<strong>in</strong>g and smuggl<strong>in</strong>g. There were no<br />

reports of traffick<strong>in</strong>g-related corruption; however,<br />

authorities did not respond to requests <strong>for</strong> <strong>in</strong><strong>for</strong>mation<br />

on alleged local police complicity <strong>in</strong> previous<br />

years <strong>in</strong> a prostitution r<strong>in</strong>g <strong>in</strong> Novi Pazar.<br />
