<strong>in</strong>g victims, Mexico’s social welfare agency operates<br />
shelters that assist traffick<strong>in</strong>g victims along with other<br />
victims of violence. The government also provides<br />
limited fund<strong>in</strong>g to anti-traffick<strong>in</strong>g NGOs. Most<br />
<strong>for</strong>eign traffick<strong>in</strong>g victims <strong>in</strong> Mexico cont<strong>in</strong>ued to be<br />
deported, although the government <strong>in</strong> September<br />
2006 authorized the issuance of renewable one-year<br />
humanitarian visas to victims who assist with the<br />
prosecution of their traffickers. So far, 11<br />
traffick<strong>in</strong>g victims have been given these<br />
visas. However, many victims <strong>in</strong> Mexico are<br />
reluctant to press their cases due to fear of<br />
retribution from their traffickers, many of<br />
whom are members of organized crim<strong>in</strong>al<br />
networks. While government resources<br />
<strong>in</strong> this area may be limited, sett<strong>in</strong>g up<br />
a secure witness-protection program <strong>in</strong><br />
human traffick<strong>in</strong>g cases would help law<br />
en<strong>for</strong>cement to ensure the physical safety<br />
of traffick<strong>in</strong>g victims, and guarantee their testimony<br />
at trial. Fund<strong>in</strong>g anti-traffick<strong>in</strong>g NGOs with specific<br />
capacity would accomplish the same goal. In 2005,<br />
there were no reports of victims be<strong>in</strong>g penalized <strong>for</strong><br />
unlawful acts committed as a direct result of be<strong>in</strong>g<br />
trafficked. However, some child victims of commercial<br />
sexual exploitation <strong>in</strong> Cancun reportedly were further<br />
sexually exploited by police upon detention. The<br />
government lacks procedures <strong>for</strong> identify<strong>in</strong>g traffick<strong>in</strong>g<br />
victims among vulnerable populations, such as<br />
persons deta<strong>in</strong>ed <strong>for</strong> prostitution or immigration<br />
violations. In addition, no <strong>for</strong>mal mechanism exists<br />
<strong>for</strong> referr<strong>in</strong>g identified traffick<strong>in</strong>g victims to specialized<br />
NGOs <strong>for</strong> care. Ef<strong>for</strong>ts to implement memoranda<br />
of understand<strong>in</strong>g with Guatemala, Belize, Honduras,<br />
and El Salvador to repatriate undocumented migrants,<br />
<strong>in</strong>clud<strong>in</strong>g children and traffick<strong>in</strong>g victims, cont<strong>in</strong>ued<br />
to be <strong>in</strong>complete.<br />
Prevention<br />
The government <strong>in</strong>creased prevention ef<strong>for</strong>ts dur<strong>in</strong>g<br />
the report<strong>in</strong>g period. High-level government officials<br />
cont<strong>in</strong>ued to stress the need to fight traffick<strong>in</strong>g. The<br />
government produced anti-traffick<strong>in</strong>g literature,<br />
and sponsored sem<strong>in</strong>ars to raise public awareness<br />
about human traffick<strong>in</strong>g. The Mexican Senate and<br />
the federal police launched anti-traffick<strong>in</strong>g commercials<br />
and media campaigns. The government does<br />
not have a national action plan to combat human<br />
traffick<strong>in</strong>g, although some government agencies have<br />
drafted their own. Some NGOs reported government<br />
resistance to collaborat<strong>in</strong>g on anti-traffick<strong>in</strong>g <strong>in</strong>itiatives<br />
and projects, especially on the federal level.<br />
Better collaboration is reported on the state level.<br />
MOLDOVA (Tier 2 Watch List)<br />
Moldova is a major source, and to a lesser extent,<br />
a transit country <strong>for</strong> women and girls trafficked <strong>for</strong><br />
the purpose of commercial sexual exploitation.<br />
Moldovan women are trafficked to Turkey, Israel,<br />
the U.A.E., Ukra<strong>in</strong>e, Russia, Cyprus, Greece, Albania,<br />
Romania, Hungary, Slovakia, the Czech Republic,<br />
Italy, France, Portugal, and Austria. Girls and young<br />
women are trafficked <strong>in</strong>ternally from rural areas to<br />
Chis<strong>in</strong>au. The small breakaway region of Transnistria<br />
<strong>in</strong> eastern Moldova is outside the central government’s<br />
control and rema<strong>in</strong>ed a significant source and<br />
transit area <strong>for</strong> traffick<strong>in</strong>g <strong>in</strong> persons.<br />
The Government of Moldova does not fully comply<br />
with m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation<br />
of traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant<br />
ef<strong>for</strong>ts to do so. Moldova is placed on Tier 2<br />
Watch List because it did not provide evidence<br />
that the government is address<strong>in</strong>g complicity <strong>in</strong><br />
severe <strong>for</strong>ms of traffick<strong>in</strong>g by government officials.<br />
<strong>Traffick<strong>in</strong>g</strong> corruption at all levels throughout the<br />
government cont<strong>in</strong>ued unchecked dur<strong>in</strong>g most of<br />
the report<strong>in</strong>g period. Throughout the year, specific<br />
reports surfaced of officials’ complicity <strong>in</strong> traffick<strong>in</strong>g,<br />
<strong>in</strong>volv<strong>in</strong>g senior government officials, as<br />
well as border guards and police officers, though<br />
the government made no significant ef<strong>for</strong>ts to<br />
<strong>in</strong>vestigate, prosecute, convict, or sentence these<br />
complicit officials. In August 2006, several government<br />
<strong>in</strong>vestigators, prosecutors and senior officials<br />
— <strong>in</strong>clud<strong>in</strong>g the deputy director of the <strong>Center</strong> to<br />
Combat <strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Persons</strong> (CCTIP) — were<br />
dismissed from their jobs <strong>for</strong> assist<strong>in</strong>g a prom<strong>in</strong>ent<br />
trafficker and his syndicate, but have not been<br />
prosecuted. The Government of Moldova should:<br />
vigorously <strong>in</strong>vestigate, prosecute, convict, and<br />
sentence all public officials complicit <strong>in</strong> traffick<strong>in</strong>g;<br />
fund the implementation of a new National Action<br />
Plan through its national committee on traffick<strong>in</strong>g;<br />
<strong>in</strong>crease resources devoted to victim assistance and<br />
protection; and boost proactive ef<strong>for</strong>ts to identify<br />
traffick<strong>in</strong>g victims and <strong>in</strong>vestigate traffick<strong>in</strong>g crimes.<br />
Prosecution<br />
The Government of Moldova showed modest<br />
improvement <strong>in</strong> its anti-traffick<strong>in</strong>g law en<strong>for</strong>cement<br />
ef<strong>for</strong>ts, with an <strong>in</strong>creased number of traffick<strong>in</strong>g<br />
<strong>in</strong>vestigations dur<strong>in</strong>g the report<strong>in</strong>g period. Moldova<br />
prohibits traffick<strong>in</strong>g <strong>for</strong> the purposes of commercial<br />
sexual exploitation and <strong>for</strong>ced labor through Articles<br />
165 and 206 of its crim<strong>in</strong>al code, respectively.<br />
Penalties prescribed range from seven years to life<br />
imprisonment, which are sufficiently str<strong>in</strong>gent and<br />
are commensurate with those <strong>for</strong> other grave crimes.<br />
