Prior to pass<strong>in</strong>g the new anti-traffick<strong>in</strong>g law<br />
crim<strong>in</strong>aliz<strong>in</strong>g labor <strong>for</strong>ms of traffick<strong>in</strong>g, the<br />
Government of Israel cont<strong>in</strong>ued to use exist<strong>in</strong>g<br />
statutes to combat traffick<strong>in</strong>g <strong>for</strong> <strong>in</strong>voluntary<br />
servitude. Dur<strong>in</strong>g the report<strong>in</strong>g period, the Crime<br />
Unit of the Immigration Adm<strong>in</strong>istration opened<br />
708 crim<strong>in</strong>al cases <strong>for</strong> fraud and deceit of <strong>for</strong>eign<br />
workers, 77 cases of withhold<strong>in</strong>g the passports of<br />
<strong>for</strong>eign workers, and five cases of labor exploitation.<br />
Of these, the government filed charges <strong>in</strong> 10 cases<br />
<strong>for</strong> withhold<strong>in</strong>g passports and 43 cases <strong>in</strong>volv<strong>in</strong>g<br />
fraud by manpower agencies and private recruiters<br />
aga<strong>in</strong>st <strong>for</strong>eign workers. It is unclear, however, how<br />
many of these cases specifically <strong>in</strong>volved traffick<strong>in</strong>g<br />
<strong>in</strong> persons <strong>for</strong> the purpose of <strong>in</strong>voluntary servitude.<br />
The government reported no convictions <strong>for</strong><br />
<strong>in</strong>voluntary servitude this year, nor did it provide<br />
evidence of conduct<strong>in</strong>g crim<strong>in</strong>al <strong>in</strong>vestigations of<br />
manpower agencies <strong>for</strong> illegally charg<strong>in</strong>g recruitment<br />
fees, a factor that may contribute to a situation<br />
of debt bondage <strong>for</strong> many <strong>for</strong>eign workers.<br />
In cooperation with local NGOs, Israel provided<br />
anti-traffick<strong>in</strong>g tra<strong>in</strong><strong>in</strong>g to judges; government<br />
employees who potentially encounter traffick<strong>in</strong>g<br />
victims, such as passport control officers and<br />
employees <strong>in</strong> the visa department; and government<br />
officials <strong>in</strong> relevant m<strong>in</strong>istries. The government<br />
also specifically tra<strong>in</strong>ed legal aid officers and other<br />
government officials on provisions <strong>in</strong> the new antitraffick<strong>in</strong>g<br />
law perta<strong>in</strong><strong>in</strong>g to traffick<strong>in</strong>g <strong>for</strong> <strong>in</strong>voluntary<br />
servitude.<br />
Protection<br />
Although the Government of Israel made some<br />
improvements <strong>in</strong> its protection of sex traffick<strong>in</strong>g<br />
victims over the report<strong>in</strong>g period, protection of<br />
victims of <strong>in</strong>voluntary servitude rema<strong>in</strong>ed relatively<br />
weak. Victims of commercial sexual exploitation<br />
are not punished <strong>for</strong> unlawful acts committed as<br />
a result of be<strong>in</strong>g trafficked. The M<strong>in</strong>istry of Social<br />
Affairs and local NGOs jo<strong>in</strong>tly operate a shelter<br />
<strong>for</strong> victims of sex traffick<strong>in</strong>g. Dur<strong>in</strong>g the report<strong>in</strong>g<br />
period, police, immigration authorities, and NGOs<br />
referred 46 victims to the shelter. Victims <strong>in</strong> this<br />
shelter receive medical treatment, psychiatric and<br />
social services, stipends, and temporary residency<br />
and work permits. Although the government<br />
encourages victims of sex traffick<strong>in</strong>g to assist <strong>in</strong><br />
<strong>in</strong>vestigations and prosecutions of traffickers, it<br />
now also allows victims to rema<strong>in</strong> <strong>in</strong> the shelter<br />
even if they are not will<strong>in</strong>g or able to testify. Victims<br />
are permitted to apply <strong>for</strong> a one-year extension to<br />
their temporary residency permits on humanitarian<br />
grounds.<br />
Victims of traffick<strong>in</strong>g <strong>for</strong> <strong>in</strong>voluntary servitude,<br />
however, rema<strong>in</strong> largely unprotected. The government<br />
does not offer shelter, medical, or psychological<br />
services to these victims, but does assist them <strong>in</strong><br />
obta<strong>in</strong><strong>in</strong>g new employment. Migrant workers who<br />
file crim<strong>in</strong>al compla<strong>in</strong>ts are not arrested, but they are<br />
also not encouraged to assist <strong>in</strong> <strong>in</strong>vestigations aga<strong>in</strong>st<br />
their traffickers. This year, the government’s anti-traffick<strong>in</strong>g<br />
national coord<strong>in</strong>ator prepared a tool kit <strong>for</strong><br />
law en<strong>for</strong>cement authorities to assist them <strong>in</strong> identify<strong>in</strong>g<br />
victims of <strong>in</strong>voluntary servitude. Israel’s new<br />
anti-traffick<strong>in</strong>g law mandates legal aid <strong>for</strong> all victims<br />
of traffick<strong>in</strong>g to file civil suits aga<strong>in</strong>st their traffickers;<br />
<strong>for</strong> victims of <strong>in</strong>voluntary servitude, a pilot project<br />
will be <strong>in</strong> place until September 2008. The law also<br />
<strong>in</strong>cludes broad <strong>for</strong>feiture provisions that permit<br />
the government to seize traffickers’ assets <strong>for</strong> use <strong>in</strong><br />
rehabilitation of victims and compensation.<br />
Prevention<br />
The Israeli government susta<strong>in</strong>ed its modest ef<strong>for</strong>ts<br />
to prevent traffick<strong>in</strong>g <strong>in</strong> persons over the report<strong>in</strong>g<br />
period. The government published brochures<br />
<strong>in</strong><strong>for</strong>m<strong>in</strong>g <strong>in</strong>com<strong>in</strong>g <strong>for</strong>eign workers of their rights.<br />
These brochures were pr<strong>in</strong>ted <strong>in</strong> the workers’ native<br />
language and outl<strong>in</strong>ed their rights and resources<br />
<strong>for</strong> assistance. Israel also cont<strong>in</strong>ued to monitor its<br />
southern border with Egypt <strong>for</strong> signs of traffick<strong>in</strong>g;<br />
report<strong>in</strong>g period, the Ramon Border Unit prevented<br />
the traffick<strong>in</strong>g of 15 women <strong>for</strong> commercial sexual<br />
exploitation through proactive screen<strong>in</strong>g of <strong>in</strong>com<strong>in</strong>g<br />
illegal migrants. Israel has not ratified the 2000<br />
UN TIP Protocol.<br />
ITALY (Tier 1)<br />
Italy is a transit and dest<strong>in</strong>ation country <strong>for</strong> women,<br />
children and men trafficked <strong>for</strong> the purposes of<br />
commercial sexual exploitation and <strong>for</strong>ced labor.<br />
Most victims are women and children from Nigeria,<br />
Romania, Moldova, Albania, and Ukra<strong>in</strong>e though<br />
<strong>in</strong> smaller numbers there are also victims from<br />
Russia, Bulgaria, Lat<strong>in</strong> America, North and East<br />
Africa, the Middle East, and Ch<strong>in</strong>a. Children constitute<br />
7 to 10 percent of victims. There has been an<br />
<strong>in</strong>crease <strong>in</strong> Romanian m<strong>in</strong>ors trafficked to Italy <strong>for</strong><br />
sexual exploitation, an un<strong>in</strong>tended consequence of<br />
a EU-mandated closure of Romanian orphanages.<br />
The number of Roma children trafficked <strong>for</strong> <strong>for</strong>ced<br />
begg<strong>in</strong>g has also risen. Men from Poland and the<br />
P.R.C. are trafficked to Italy <strong>for</strong> <strong>for</strong>ced labor, mostly<br />
<strong>in</strong> the agricultural sector.<br />
The Government of Italy fully complies with the<br />
m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of traffick<strong>in</strong>g.<br />
Italy has taken aggressive steps to en<strong>for</strong>ce its<br />
anti-traffick<strong>in</strong>g laws and to provide protection to<br />
victims. To further strengthen further its response<br />
to traffick<strong>in</strong>g, Italy should take steps to ensure<br />
that Article 18 benefits are adm<strong>in</strong>istered equally<br />
to labor traffick<strong>in</strong>g victims, ensure that victims are<br />
not penalized <strong>for</strong> crimes committed as a result of<br />
be<strong>in</strong>g trafficked, and launch demand reduction<br />
campaigns.
