persons of Haitian descent were often neglected. The<br />

government does not provide legal alternatives to the<br />

removal of <strong>for</strong>eign victims to countries where they<br />

face hardship or retribution. The government should<br />

assure protection to Haitians and undocumented<br />

persons of Haitian descent born <strong>in</strong> the Dom<strong>in</strong>ican<br />

Republic, many of whom fall victim to human<br />

traffick<strong>in</strong>g.<br />

Prevention<br />

The government carried out limited prevention<br />

ef<strong>for</strong>ts by conduct<strong>in</strong>g anti-traffick<strong>in</strong>g sem<strong>in</strong>ars at<br />

schools across the country, reach<strong>in</strong>g more than<br />

5,000 students. The government relies on NGOs<br />

and <strong>in</strong>ternational organizations <strong>for</strong> all other<br />

prevention activities.<br />

EAST TIMOR (Tier 2)<br />

East Timor is a dest<strong>in</strong>ation country <strong>for</strong> women<br />

from Thailand, Indonesia, the Philipp<strong>in</strong>es, and<br />

the People’s Republic of Ch<strong>in</strong>a (P.R.C.) trafficked<br />

<strong>for</strong> the purpose of commercial sexual exploitation.<br />

Internal traffick<strong>in</strong>g of Timorese women and girls<br />

from rural areas to Dili <strong>for</strong> sexual exploitation is<br />

a problem and there are concerns that it could<br />

<strong>in</strong>crease due to long-term <strong>in</strong>ternal displacement<br />

and <strong>in</strong>creased presence of <strong>in</strong>ternational peacekeepers.<br />

An attempt to traffic Timorese women to Syria<br />

was thwarted, but po<strong>in</strong>ts to the possibility of East<br />

Timor becom<strong>in</strong>g a source country. There are unverified<br />

reports of men trafficked <strong>for</strong> <strong>for</strong>ced labor <strong>in</strong><br />

East Timor.<br />

The Government of East Timor does not fully<br />

comply with the m<strong>in</strong>imum standards <strong>for</strong> the<br />

elim<strong>in</strong>ation of traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g<br />

significant ef<strong>for</strong>ts to do so. The government has not<br />

enacted a draft penal code that def<strong>in</strong>es and punishes<br />

the crime of traffick<strong>in</strong>g because of concerns<br />

regard<strong>in</strong>g other unrelated provisions and delays<br />

related to the political crisis <strong>in</strong> the country. The<br />

political crisis disrupted the work of the country’s<br />

<strong>Traffick<strong>in</strong>g</strong> Work<strong>in</strong>g Group; it has not met <strong>in</strong> over<br />

a year. As the East Timor legal system develops <strong>in</strong><br />

the com<strong>in</strong>g years and takes over functions handled<br />

by <strong>in</strong>ternational officials, the government should<br />

focus on law en<strong>for</strong>cement ef<strong>for</strong>ts aga<strong>in</strong>st traffick<strong>in</strong>g,<br />

<strong>in</strong>clud<strong>in</strong>g specialized tra<strong>in</strong><strong>in</strong>g of officials <strong>in</strong><br />

<strong>in</strong>vestigat<strong>in</strong>g, prosecut<strong>in</strong>g, and obta<strong>in</strong><strong>in</strong>g convictions<br />

of traffickers. The government should devote<br />

considerably more resources to prevention, rescue,<br />

treatment and rehabilitation of traffick<strong>in</strong>g victims,<br />

as government f<strong>in</strong>ance and project management<br />

capabilities develop <strong>in</strong> the com<strong>in</strong>g years and as reliance<br />

on <strong>in</strong>ternational organizations dim<strong>in</strong>ishes.<br />

Prosecution<br />

The Government of East Timor showed m<strong>in</strong>imal<br />

anti-traffick<strong>in</strong>g law en<strong>for</strong>cement ef<strong>for</strong>ts over the past<br />

year. Currently East Timor’s law en<strong>for</strong>cement system<br />

depends on <strong>in</strong>ternational police, prosecutors, and<br />

judges, with expectations that Timorese officials will<br />

gradually accept more responsibility. East Timor<br />

prohibits all <strong>for</strong>ms of sex and labor traffick<strong>in</strong>g<br />

through its 2003 Immigration and Asylum Act and<br />

prescribes penalties <strong>for</strong> traffick<strong>in</strong>g <strong>for</strong> commercial<br />

sexual exploitation that, while not commensurate<br />

with those <strong>for</strong> rape, are sufficiently str<strong>in</strong>gent. The<br />

government has not prosecuted any cases aga<strong>in</strong>st<br />

traffickers. In March 2006 national police conducted<br />

a raid aga<strong>in</strong>st an establishment <strong>in</strong> Dili <strong>in</strong> which a<br />

Philipp<strong>in</strong>e victim was <strong>for</strong>ced <strong>in</strong>to sexual exploitation.<br />

Eight additional victims from the P.R.C. and<br />

Indonesia were rescued, and suspected traffickers<br />

were arrested. The Office of the Prosecutor General<br />

dismissed the case without any <strong>in</strong>dictments and<br />

no further action was taken. There were allegations<br />

that the establishment owner had powerful bus<strong>in</strong>ess<br />

connections. A new penal code based on the<br />

Portuguese penal code was approved by the Council<br />

of M<strong>in</strong>isters <strong>in</strong> late 2005. However, due to controversy<br />

regard<strong>in</strong>g other, unrelated provisions, the code<br />

was not promulgated and rema<strong>in</strong>s <strong>in</strong> limbo. Pend<strong>in</strong>g<br />

the promulgation of a penal code, East Timor’s<br />

judicial system cont<strong>in</strong>ues to rely on the Indonesian<br />

penal code. In January <strong>2007</strong>, UN police arrested<br />

two men suspected of attempt<strong>in</strong>g to traffic East<br />

Timorese women to Syria. There is limited evidence<br />

of a tolerance <strong>for</strong> traffick<strong>in</strong>g by border officials and<br />

police who may take bribes to allow victims <strong>in</strong>to the<br />

country or turn a bl<strong>in</strong>d eye to brothel operations.<br />

Protection<br />

The East Timorese Government began provid<strong>in</strong>g<br />

limited but still <strong>in</strong>sufficient victim protection<br />

dur<strong>in</strong>g the report<strong>in</strong>g period, rely<strong>in</strong>g largely on<br />

<strong>in</strong>ternational organizations and NGOs to provide<br />

this care <strong>for</strong> victims. Authorities encouraged victims<br />

to participate <strong>in</strong> the <strong>in</strong>vestigation of traffickers and<br />

to file civil suits aga<strong>in</strong>st traffickers; however, the<br />

country’s dysfunctional court system prevented<br />

most legal action. Foreign victims can request<br />

refugee status; victims were repatriated through a<br />

process known as “voluntary abandonment.” Under<br />

this arrangement, <strong>in</strong>dividuals present <strong>in</strong> East Timor<br />

illegally, but thought to be traffick<strong>in</strong>g victims,<br />

are given 10 days to depart the country and are<br />

provided assistance with travel documents. There is<br />

no threat of prosecution <strong>in</strong>volved <strong>in</strong> the voluntary<br />
