MACAU (Tier 2 Watch List)<br />

Macau is a dest<strong>in</strong>ation territory <strong>for</strong> the traffick<strong>in</strong>g<br />

of women and girls from the Ch<strong>in</strong>ese ma<strong>in</strong>land,<br />

Mongolia, Russia, Philipp<strong>in</strong>es, Thailand, Vietnam,<br />

and Central Asia <strong>for</strong> the purpose of commercial<br />

sexual exploitation. Foreign and ma<strong>in</strong>land Ch<strong>in</strong>ese<br />

women and girls, many of whom are <strong>in</strong>dependent<br />

operators, are sometimes deceived <strong>in</strong>to migrat<strong>in</strong>g<br />

voluntarily to the Macau Special Adm<strong>in</strong>istrative<br />

Region (MSAR) <strong>for</strong> employment opportunities and<br />

then <strong>in</strong>duced <strong>in</strong>to sexual servitude through debt<br />

bondage, coercion, or <strong>for</strong>ce. Mongolian authorities<br />

and NGOs cite Macau as the primary dest<strong>in</strong>ation<br />

<strong>for</strong> Mongolian girls and women trafficked <strong>for</strong> sexual<br />

exploitation. These women are often conf<strong>in</strong>ed<br />

<strong>in</strong> massage parlors and illegal brothels operat<strong>in</strong>g<br />

under the control or protection of Macau-based<br />

organized crime syndicates.<br />

Macau does not fully comply with the m<strong>in</strong>imum<br />

standards <strong>for</strong> the elim<strong>in</strong>ation of traffick<strong>in</strong>g; however,<br />

it is mak<strong>in</strong>g significant ef<strong>for</strong>ts to do so. Macau is<br />

placed on Tier 2 Watch List <strong>for</strong> a second consecutive<br />

year because the determ<strong>in</strong>ation that it has made<br />

significant ef<strong>for</strong>ts to elim<strong>in</strong>ate traffick<strong>in</strong>g is based<br />

on its commitment of future action over the com<strong>in</strong>g<br />

year, namely the review of current anti-traffick<strong>in</strong>g<br />

laws with the <strong>in</strong>tent to address exist<strong>in</strong>g gaps and<br />

more vigorous anti-traffick<strong>in</strong>g law en<strong>for</strong>cement<br />

action. Macau authorities have not yet recognized<br />

the full extent of the significant traffick<strong>in</strong>g problem<br />

<strong>in</strong> the MSAR, although they took steps to review<br />

exist<strong>in</strong>g laws <strong>in</strong> order to identify gaps deal<strong>in</strong>g with<br />

traffick<strong>in</strong>g and to crim<strong>in</strong>alize and adequately punish<br />

all <strong>for</strong>ms of traffick<strong>in</strong>g, while offer<strong>in</strong>g legal protections<br />

<strong>for</strong> victims of traffick<strong>in</strong>g. Macau authorities<br />

cont<strong>in</strong>ue to view migrant girls and women <strong>in</strong>volved<br />

<strong>in</strong> the commercial sex trade as “will<strong>in</strong>g participants,”<br />

despite regular reports from other governments and<br />

NGOs <strong>in</strong>dicat<strong>in</strong>g that a significant share of these<br />

females are <strong>in</strong> the sex trade under conditions of debt<br />

bondage, coercion, or <strong>for</strong>ce.<br />

Prosecution<br />

Macau authorities demonstrated marg<strong>in</strong>al ef<strong>for</strong>ts<br />

to identify and punish crimes of traffick<strong>in</strong>g <strong>in</strong> the<br />

MSAR over the report<strong>in</strong>g period. Macau does not<br />

prohibit all <strong>for</strong>ms of traffick<strong>in</strong>g, though traffick<strong>in</strong>g<br />

of persons from Macau to outside dest<strong>in</strong>ations is<br />

crim<strong>in</strong>alized by Article 7 of its Law on Organized<br />

Crime, which is rarely used as there have been no<br />

identified cases of outbound traffick<strong>in</strong>g from Macau.<br />

Article 153 of Macau’s Crim<strong>in</strong>al Code crim<strong>in</strong>alizes<br />

the sale or purchase of a person with the <strong>in</strong>tent of<br />

plac<strong>in</strong>g that person <strong>in</strong> a state of slavery, <strong>for</strong> which<br />

punishment is sufficiently str<strong>in</strong>gent — 10 to 20<br />

years’ imprisonment — but which also has rarely<br />

been used. Kidnapp<strong>in</strong>g and rape statutes could<br />

be used to punish sex traffick<strong>in</strong>g crimes, and they<br />

prescribe sufficiently str<strong>in</strong>gent punishments of 3 to<br />

12 years’ imprisonment, though these too are rarely<br />

used <strong>for</strong> traffick<strong>in</strong>g crimes. There were no reported<br />

<strong>in</strong>vestigations of traffick<strong>in</strong>g crimes, or prosecutions<br />

or convictions of traffick<strong>in</strong>g offenders dur<strong>in</strong>g the<br />

report<strong>in</strong>g period. Dur<strong>in</strong>g the year, Macau authorities<br />

reported 10 cases <strong>in</strong>volv<strong>in</strong>g 17 women, who<br />

compla<strong>in</strong>ed of be<strong>in</strong>g brought to the MSAR under<br />

false pretenses and <strong>for</strong>ced <strong>in</strong>to prostitution, although<br />

no one was prosecuted. A separate case of traffick<strong>in</strong>g<br />

was reported by a newspaper <strong>in</strong> Macau — the prostitution<br />

of a 15-year-old ma<strong>in</strong>land Ch<strong>in</strong>ese girl <strong>in</strong> a<br />

brothel — but it is not known if the exploiter <strong>in</strong> the<br />

case was ever punished. Regard<strong>in</strong>g labor traffick<strong>in</strong>g,<br />

<strong>in</strong> March <strong>2007</strong>, one ma<strong>in</strong>land woman was arrested<br />

<strong>for</strong> allegedly deceiv<strong>in</strong>g three friends out of approximately<br />

$9,000 <strong>for</strong> import-labor jobs <strong>in</strong> Macau. The<br />

case was transferred to the Public Prosecutor’s Office<br />

<strong>for</strong> further <strong>in</strong>vestigation. Dur<strong>in</strong>g the year, outside<br />

NGOs and <strong>for</strong>eign governments reported on specific<br />

cases of women trafficked to Macau from Russia,<br />

Mongolia, and the Philipp<strong>in</strong>es.<br />

Protection<br />

Macau did not make significant progress <strong>in</strong> protect<strong>in</strong>g<br />

victims of traffick<strong>in</strong>g over the report<strong>in</strong>g period.<br />

Macau authorities neither offered victims dedicated<br />

services nor implemented systematic ef<strong>for</strong>ts to identify<br />

and refer <strong>for</strong> assistance victims among vulnerable<br />

populations, such as the 1,800 women arrested<br />

<strong>for</strong> prostitution violations <strong>in</strong> 2006, of which 1,600<br />

were from the ma<strong>in</strong>land and the rema<strong>in</strong><strong>in</strong>g 200<br />

were <strong>for</strong>eigners. The Macau authorities do not<br />

encourage victims to participate <strong>in</strong> <strong>in</strong>vestigations<br />

or prosecutions. While women from the ma<strong>in</strong>land<br />

who are subjected to conditions of <strong>in</strong>voluntary<br />

servitude <strong>in</strong> the commercial sex trade occasionally<br />

escape with the help of Macau police or service<br />

agencies, most <strong>for</strong>eign women, such as those from<br />

Mongolia, Russia, Thailand and the Philipp<strong>in</strong>es,<br />

f<strong>in</strong>d it extremely difficult to escape given the lack<br />

of services <strong>in</strong> their respective languages and the<br />

lack of their governments’ diplomatic representation<br />

<strong>in</strong> Macau. Moreover, the control of organized<br />

crime organizations over Macau’s lucrative sex<br />

trade prevents MSAR ef<strong>for</strong>ts to provide victims with<br />

witness protection should they wish to participate<br />

<strong>in</strong> a prosecution of the traffick<strong>in</strong>g offender. Victims<br />

are not offered legal alternatives to their removal to<br />
