EQUATORIAL GUINEA (Tier 3)<br />

Equatorial Gu<strong>in</strong>ea is primarily a dest<strong>in</strong>ation country<br />

<strong>for</strong> children trafficked <strong>for</strong> the purposes of <strong>for</strong>ced<br />

labor and possibly <strong>for</strong> commercial sexual exploitation,<br />

though some children may also be trafficked<br />

with<strong>in</strong> the country from rural areas to Malabo and<br />

Bata <strong>for</strong> these same purposes. Children are trafficked<br />

from Nigeria, Ben<strong>in</strong>, Cameroon, and Gabon<br />

<strong>for</strong> domestic, farm and commercial labor to Malabo<br />

and Bata, where demand is high due to a thriv<strong>in</strong>g<br />

oil <strong>in</strong>dustry and a grow<strong>in</strong>g expatriate bus<strong>in</strong>ess<br />

community. <strong>Report</strong>s <strong>in</strong>dicate that there are girls <strong>in</strong><br />

prostitution <strong>in</strong> Equatorial Gu<strong>in</strong>ea from Cameroon,<br />

Ben<strong>in</strong>, Togo, other neighbor<strong>in</strong>g countries, and the<br />

People’s Republic of Ch<strong>in</strong>a, who may be victims of<br />

traffick<strong>in</strong>g.<br />

The Government of Equatorial Gu<strong>in</strong>ea does not<br />

fully comply with the m<strong>in</strong>imum standards <strong>for</strong> the<br />

elim<strong>in</strong>ation of traffick<strong>in</strong>g, and it is not mak<strong>in</strong>g<br />

significant ef<strong>for</strong>ts to do so. Despite its significant<br />

resources, the government failed to <strong>in</strong>vestigate and<br />

prosecute traffickers and protect victims. However,<br />

it did take steps to raise awareness of traffick<strong>in</strong>g.<br />

The government has not shown a political<br />

commitment to address<strong>in</strong>g the country’s traffick<strong>in</strong>g<br />

<strong>in</strong> persons problem. To demonstrate a credible<br />

response to traffick<strong>in</strong>g, the government should:<br />

create a specialized anti-traffick<strong>in</strong>g police unit to<br />

<strong>in</strong>vestigate traffick<strong>in</strong>g compla<strong>in</strong>ts; <strong>in</strong>crease ef<strong>for</strong>ts<br />

to prosecute and convict traffickers; support local<br />

NGO ef<strong>for</strong>ts to shelter victims; develop a system <strong>for</strong><br />

referr<strong>in</strong>g victims to NGOs; and create mechanisms<br />

<strong>for</strong> collect<strong>in</strong>g traffick<strong>in</strong>g crime and victim data.<br />

Prosecution<br />

The Government of Equatorial Gu<strong>in</strong>ea demonstrated<br />

<strong>in</strong>sufficient law en<strong>for</strong>cement ef<strong>for</strong>ts to combat traffick<strong>in</strong>g<br />

dur<strong>in</strong>g the report<strong>in</strong>g period. The government<br />

prohibits all <strong>for</strong>ms of traffick<strong>in</strong>g through its 2004<br />

Law on the Smuggl<strong>in</strong>g of Migrants and <strong>Traffick<strong>in</strong>g</strong> <strong>in</strong><br />

<strong>Persons</strong>, which carries sufficiently str<strong>in</strong>gent penalties<br />

of 10 to 15 years’ imprisonment <strong>for</strong> labor and sex<br />

traffick<strong>in</strong>g. However, no one has been prosecuted<br />

under this law. The government failed to report any<br />

traffick<strong>in</strong>g arrests dur<strong>in</strong>g the year and did not effectively<br />

<strong>in</strong>vestigate cases, fail<strong>in</strong>g to respond adequately<br />

to at least 11 cases reported by civil society activists,<br />

<strong>for</strong>eign embassy officials, and religious orders. If<br />

police determ<strong>in</strong>ed a reported case to be valid, they<br />

paid the trafficker a visit, but lacked tra<strong>in</strong><strong>in</strong>g and<br />

awareness to identify traffick<strong>in</strong>g suspects or victims.<br />

The government also failed to <strong>in</strong>vestigate allegations<br />

that Ch<strong>in</strong>ese employers may be recruit<strong>in</strong>g Ch<strong>in</strong>ese<br />

laborers <strong>for</strong> construction and confiscat<strong>in</strong>g their travel<br />

documents to keep them <strong>in</strong> <strong>in</strong>voluntary servitude.<br />

The government funded two 5-day workshops at<br />

which 210 law en<strong>for</strong>cement officers were tra<strong>in</strong>ed<br />

about traffick<strong>in</strong>g. The government also reached out<br />

to the <strong>in</strong>ternational community to request additional<br />

law en<strong>for</strong>cement tra<strong>in</strong><strong>in</strong>g.<br />

Protection<br />

The government demonstrated weak and <strong>in</strong>adequate<br />

ef<strong>for</strong>ts to provide care <strong>for</strong> traffick<strong>in</strong>g victims dur<strong>in</strong>g<br />

the year. The Equatogu<strong>in</strong>ean government neither<br />

operates victim shelters nor funds the protection<br />

ef<strong>for</strong>ts of local NGOs, despite its considerable<br />

resources. The government also has no system <strong>in</strong><br />

place <strong>for</strong> identify<strong>in</strong>g traffick<strong>in</strong>g victims among<br />

vulnerable populations and referr<strong>in</strong>g victims to<br />

NGOs <strong>for</strong> care. The government failed to provide<br />

data on any services it provided to victims. The<br />

government does not encourage victims to assist <strong>in</strong><br />

traffick<strong>in</strong>g or slavery <strong>in</strong>vestigations or prosecutions.<br />

The government does not provide legal alternatives<br />

to the removal of <strong>for</strong>eign victims to countries where<br />

they face hardship or retribution. However, victims<br />

are not <strong>in</strong>appropriately <strong>in</strong>carcerated or f<strong>in</strong>ed <strong>for</strong><br />

unlawful acts as a direct result of be<strong>in</strong>g trafficked.<br />

Prevention<br />

The Government of Equatorial Gu<strong>in</strong>ea made<br />

progress <strong>in</strong> rais<strong>in</strong>g awareness about traffick<strong>in</strong>g<br />

dur<strong>in</strong>g the year. The government dissem<strong>in</strong>ated its<br />

2006 National Action Plan through workshops <strong>for</strong><br />

over 500 representatives from local, prov<strong>in</strong>cial and<br />

national government agencies, <strong>for</strong>eign government<br />

and <strong>in</strong>ternational organization representatives,<br />

NGOs, and the media. The government collaborated<br />

with UNICEF to educate the public about<br />

traffick<strong>in</strong>g. It provided public service time <strong>for</strong> radio<br />

and television announcements, pay<strong>in</strong>g <strong>for</strong> the staff<br />

time and production materials <strong>for</strong> these broadcasts.<br />

ESTONIA (Tier 2)<br />

Estonia is a source, transit, and dest<strong>in</strong>ation country<br />

<strong>for</strong> men and women trafficked <strong>for</strong> the purposes<br />

of sexual exploitation and <strong>for</strong>ced labor. Estonian<br />

women and girls are trafficked to Sweden, F<strong>in</strong>land,<br />

Norway, Denmark, the United K<strong>in</strong>gdom, Spa<strong>in</strong>,<br />

Belgium, Germany, and the Netherlands <strong>for</strong> purposes<br />

of sexual exploitation. Men and women were<br />

trafficked from Estonia to the United K<strong>in</strong>gdom <strong>for</strong><br />

the purpose of <strong>for</strong>ced labor.<br />

The Government of Estonia does not fully comply<br />

with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of<br />
