served some time <strong>in</strong> prison; this is a significant<br />
decrease from 2004 when 13 of 16 convicted traffickers<br />
served time <strong>in</strong> prison. In 2006, Polish authorities<br />
worked closely with <strong>for</strong>eign counterparts on several<br />
high-profile <strong>in</strong>ternational traffick<strong>in</strong>g cases. In May<br />
2006, Austrian authorities arrested two Polish policemen<br />
who were <strong>in</strong>volved <strong>in</strong> a group suspected of<br />
hav<strong>in</strong>g trafficked 440 Polish and Romanian women<br />
to Austria. To date, there have been no cases of law<br />
en<strong>for</strong>cement officials punished <strong>for</strong> traffick<strong>in</strong>g-related<br />
corruption <strong>in</strong> Poland.<br />
Protection<br />
The Polish government cont<strong>in</strong>ued to provide quality<br />
assistance to traffick<strong>in</strong>g victims. It <strong>in</strong>creased its<br />
fund<strong>in</strong>g to victim support and susta<strong>in</strong>ed implementation<br />
of its victim referral mechanism govern<strong>in</strong>g<br />
cooperation among police, border guards, and victim<br />
assistance organizations. Once identified, victims<br />
were typically referred to the nearest victim assistance<br />
location. Although the government has <strong>in</strong>vested<br />
significant resources <strong>in</strong> victim identification tra<strong>in</strong><strong>in</strong>g,<br />
the number of identified victims <strong>in</strong> the country<br />
rema<strong>in</strong>ed low. Concerns exist that a two-month<br />
victim reflection period <strong>for</strong> victims, available start<strong>in</strong>g<br />
<strong>in</strong> 2005, was not properly implemented; at least<br />
one <strong>for</strong>eign victim identified herself to law en<strong>for</strong>cement<br />
but was still deported without be<strong>in</strong>g offered<br />
the reflection period. The government encouraged<br />
victims to assist <strong>in</strong> traffick<strong>in</strong>g <strong>in</strong>vestigations and<br />
prosecutions; 11 victims assisted authorities <strong>in</strong> 2006.<br />
Prevention<br />
The government cont<strong>in</strong>ued to improve its traffick<strong>in</strong>g<br />
prevention ef<strong>for</strong>ts. Dur<strong>in</strong>g the report<strong>in</strong>g period,<br />
the government funded several NGOs to conduct<br />
workshops at orphanages and childcare centers to<br />
raise awareness of the dangers of traffick<strong>in</strong>g. A<br />
government-funded NGO also conducted an awareness<br />
campaign on the Polish-Ukra<strong>in</strong>ian border.<br />
Anti-traffick<strong>in</strong>g awareness guidebooks target<strong>in</strong>g both<br />
Poles travel<strong>in</strong>g abroad <strong>for</strong> work and <strong>for</strong>eign women<br />
migrat<strong>in</strong>g to Poland <strong>for</strong> work were produced and<br />
dissem<strong>in</strong>ated among these two groups.<br />
PORTUGAL (Tier 2)<br />
Portugal is primarily a dest<strong>in</strong>ation and transit country<br />
<strong>for</strong> women, men, and children trafficked from<br />
Brazil, Ukra<strong>in</strong>e, Moldova, Russia, Romania, and to a<br />
lesser extent Africa. The majority of Brazilian female<br />
victims are trafficked <strong>for</strong> the purposes of commercial<br />
sexual exploitation. Male victims from Eastern<br />
European countries are trafficked <strong>for</strong> <strong>for</strong>ced labor <strong>in</strong><br />
the construction <strong>in</strong>dustry. Some traffick<strong>in</strong>g victims<br />
transit through Portugal to other European countries.<br />
The Government of Portugal does not fully comply<br />
with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation of<br />
traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant ef<strong>for</strong>ts<br />
to do so. In 2006, a multi-agency government center<br />
responsible <strong>for</strong> gather<strong>in</strong>g traffick<strong>in</strong>g-related data<br />
opened and required that police fill out a standard<br />
detailed <strong>for</strong>m with case <strong>in</strong><strong>for</strong>mation. The parliament<br />
should pass the new anti-traffick<strong>in</strong>g penal<br />
code re<strong>for</strong>ms currently be<strong>for</strong>e it and the government<br />
should actively implement those re<strong>for</strong>ms.<br />
Prosecution<br />
The Government of Portugal demonstrated weak<br />
ef<strong>for</strong>ts to prosecute traffick<strong>in</strong>g <strong>in</strong> 2006, although it<br />
has established a system to facilitate the compil<strong>in</strong>g<br />
of comprehensive law en<strong>for</strong>cement data under the<br />
category of traffick<strong>in</strong>g. Portugal prohibits labor traffick<strong>in</strong>g<br />
and most <strong>for</strong>ms of sex traffick<strong>in</strong>g through<br />
various traffick<strong>in</strong>g-related provisions of its penal<br />
code. In addition, sex traffick<strong>in</strong>g of Portuguese<br />
citizens across <strong>in</strong>ternational borders is specifically<br />
prohibited. To bolster its ef<strong>for</strong>ts to combat traffick<strong>in</strong>g,<br />
the government submitted to parliament<br />
re<strong>for</strong>ms that will standardize the penal code as it<br />
relates to traffick<strong>in</strong>g. The re<strong>for</strong>ms explicitly crim<strong>in</strong>alize<br />
labor traffick<strong>in</strong>g, broaden the def<strong>in</strong>ition of<br />
sex traffick<strong>in</strong>g, and <strong>in</strong>crease penalties <strong>for</strong> both types<br />
of traffick<strong>in</strong>g offenses. Current penalties prescribed<br />
by law <strong>for</strong> commercial sexual exploitation are<br />
commensurate with those <strong>for</strong> rape, and the laws<br />
generally prescribe penalties that are sufficiently<br />
str<strong>in</strong>gent. However, sentences imposed on convicted<br />
offenders are often suspended. In 2006, a bar<br />
owner accused of sex traffick<strong>in</strong>g was convicted <strong>for</strong><br />
related crimes of pimp<strong>in</strong>g, aid<strong>in</strong>g illegal immigration,<br />
kidnapp<strong>in</strong>g, and illegal possession of weapons.<br />
He was sentenced to n<strong>in</strong>e years’ imprisonment<br />
<strong>for</strong> recruit<strong>in</strong>g and exploit<strong>in</strong>g Brazilian women.<br />
There is no evidence of government officials<br />
complicit <strong>in</strong> traffick<strong>in</strong>g.<br />
Protection<br />
The Government of Portugal expanded its ef<strong>for</strong>ts to<br />
provide protection assistance to victims of traffick<strong>in</strong>g<br />
<strong>in</strong> 2006 and encouraged victims to assist<br />
<strong>in</strong> the <strong>in</strong>vestigation and prosecution of traffickers.<br />
Victims may file civil suits aga<strong>in</strong>st their traffickers.<br />
Victims are allowed a 30 to 60 day reflection period<br />
to decide whether or not they will press charges<br />
aga<strong>in</strong>st the traffickers and regardless of their decision,<br />
have the right to a one-year residency permit.<br />
Victims who are <strong>in</strong>itially deta<strong>in</strong>ed are transferred<br />
to shelter facilities and do not face penalties <strong>for</strong><br />
unlawful acts committed as a direct part of their<br />
be<strong>in</strong>g trafficked. In the last year, Portugal opened<br />
