has the region’s largest traffick<strong>in</strong>g problem, with<br />
hundreds of thousands of traffick<strong>in</strong>g victims, and it<br />
has a huge and largely unchecked problem of<br />
traffick<strong>in</strong>g-related complicity by public officials.<br />
Law en<strong>for</strong>cement ef<strong>for</strong>ts improved over the last<br />
year, but rema<strong>in</strong> <strong>in</strong>sufficient, and there has been<br />
scant political will shown to provide greater protection<br />
to migrant workers at risk of traffick<strong>in</strong>g.<br />
A memorandum of understand<strong>in</strong>g with Malaysia<br />
signed <strong>in</strong> May 2006 ceded basic worker rights to<br />
employers mak<strong>in</strong>g it easier <strong>for</strong> Indonesians to be<br />
trapped <strong>in</strong> slave-like conditions. The agreement<br />
allows Malaysian employers to hold workers’ passports,<br />
restrict their freedom to return home, deduct<br />
up to 50 percent of their negotiated monthly wages<br />
to repay loans, and provide no time off. While the<br />
M<strong>in</strong>istry of Manpower conducted crackdowns on<br />
illegal activities of migrant manpower agencies,<br />
there was no official recognition that Indonesia’s<br />
migrant worker system lacks measures to protect<br />
workers from exploitation or debt bondage. The<br />
government should make greater ef<strong>for</strong>ts to prosecute<br />
and convict public officials who profit from<br />
or are <strong>in</strong>volved <strong>in</strong> traffick<strong>in</strong>g. It is essential that<br />
the government implement a migrant manpower<br />
recruitment and placement system that <strong>in</strong>corporates<br />
measures to protect workers, rather than benefit<strong>in</strong>g<br />
exploitative manpower agencies and employers. The<br />
government should also greatly <strong>in</strong>crease its budget<br />
<strong>for</strong> the prevention of traffick<strong>in</strong>g as well as the repatriation,<br />
treatment and rehabilitation of victims,<br />
rely<strong>in</strong>g less on <strong>in</strong>ternational donors.<br />
Prosecution<br />
The Indonesian government demonstrated<br />
improved ef<strong>for</strong>ts to combat traffick<strong>in</strong>g <strong>in</strong> persons<br />
<strong>in</strong> 2006, although the lack of a comprehensive<br />
law stymied the effectiveness of these ef<strong>for</strong>ts. With<br />
the passage and enactment <strong>in</strong> April <strong>2007</strong> of a<br />
comprehensive anti-traffick<strong>in</strong>g law, Indonesia now<br />
prohibits all <strong>for</strong>ms of traffick<strong>in</strong>g <strong>in</strong> persons; the<br />
law prescribes penalties of 3 to 15 years’ imprisonment.<br />
These penalties are sufficiently str<strong>in</strong>gent and<br />
commensurate with those <strong>for</strong> other grave crimes.<br />
The new anti-traffick<strong>in</strong>g law conta<strong>in</strong>s provisions <strong>for</strong><br />
the prosecution of corporate entities which could<br />
be applied to job placement agencies <strong>in</strong>volved <strong>in</strong><br />
traffick<strong>in</strong>g. Another provision specifically crim<strong>in</strong>alizes<br />
traffick<strong>in</strong>g by government officials. The new law<br />
will also facilitate anti-traffick<strong>in</strong>g data collection, a<br />
chronic problem <strong>in</strong> Indonesia.<br />
Law en<strong>for</strong>cement aga<strong>in</strong>st traffickers <strong>in</strong>creased <strong>in</strong><br />
2006 over 2005, with arrests up 29 percent, from<br />
110 to 142; prosecutions up 87 percent, from 30 to<br />
56; and convictions up 112 percent, from 17 to 36.<br />
The average sentence <strong>in</strong> these cases was 54 months.<br />
The longest traffick<strong>in</strong>g sentence <strong>in</strong> 2006 was 15<br />
years, imposed pursuant to the Child Protection<br />
Act. The number of women’s police desks help<strong>in</strong>g<br />
victims <strong>in</strong>creased to 280 <strong>in</strong> 2006, while national<br />
traffick<strong>in</strong>g police <strong>in</strong>vestigators nearly doubled to<br />
20, still an <strong>in</strong>adequate number given the huge size<br />
of Indonesia’s traffick<strong>in</strong>g problem. Prosecutors with<br />
the Transnational Crime <strong>Center</strong>, which was established<br />
<strong>in</strong> July 2006 to handle high-priority cases of<br />
traffick<strong>in</strong>g and terrorism, prosecuted 10 traffick<strong>in</strong>g<br />
cases <strong>in</strong> its first six months of operation. A number<br />
of prov<strong>in</strong>cial and local laws were also passed to<br />
protect women and children aga<strong>in</strong>st traffick<strong>in</strong>g.<br />
Indonesia posted police liaison officers <strong>in</strong><br />
Indonesian embassies <strong>in</strong> Saudi Arabia, Malaysia,<br />
Australia, and Thailand to aid <strong>in</strong> traffick<strong>in</strong>g<br />
<strong>in</strong>vestigations. Complicity <strong>in</strong> traffick<strong>in</strong>g of <strong>in</strong>dividual<br />
security <strong>for</strong>ce members and corrupt officials<br />
<strong>in</strong>volved <strong>in</strong> prostitution and sex traffick<strong>in</strong>g<br />
rema<strong>in</strong>ed unchecked. Individual members of the<br />
security <strong>for</strong>ces were complicit <strong>in</strong> traffick<strong>in</strong>g, provid<strong>in</strong>g<br />
protection to brothels and prostitution fronts or<br />
by receiv<strong>in</strong>g bribes. The <strong>for</strong>mer Indonesian Consul<br />
General <strong>in</strong> Penang, Malaysia, was sentenced to 20<br />
months’ imprisonment and f<strong>in</strong>ed 100 million rupiah<br />
<strong>for</strong> collect<strong>in</strong>g illegal charges from Indonesian<br />
laborers <strong>in</strong> Malaysia. A <strong>for</strong>mer Consul General <strong>in</strong><br />
Johor Bahru, Malaysia, was arrested <strong>for</strong> <strong>in</strong>flat<strong>in</strong>g<br />
fees <strong>for</strong> services and abus<strong>in</strong>g authority.<br />
Protection<br />
The Indonesian government <strong>in</strong>creased ef<strong>for</strong>ts, at the<br />
national and local levels, to protect victims of traffick<strong>in</strong>g<br />
<strong>in</strong> Indonesia and abroad; however, available<br />
victim services are overwhelmed by the large number<br />
of traffick<strong>in</strong>g victims. The government’s policy is<br />
to encourage victim participation <strong>in</strong> <strong>in</strong>vestigations<br />
aga<strong>in</strong>st traffickers and not to deta<strong>in</strong> or imprison<br />
traffick<strong>in</strong>g victims; however, local government and<br />
police practices varied. In some cases police officers<br />
treated victims as crim<strong>in</strong>als, subjected them to detention,<br />
and demanded bribes from them. Authorities<br />
cont<strong>in</strong>ued to round up and deport a small number<br />
of <strong>for</strong>eign women and girls <strong>in</strong> prostitution without<br />
attempt<strong>in</strong>g to identify traffick<strong>in</strong>g victims among<br />
them. The government operates four medical centers<br />
that treat traffick<strong>in</strong>g victims. The Foreign M<strong>in</strong>istry<br />
operated shelters <strong>for</strong> traffick<strong>in</strong>g victims and migrant<br />
workers at its embassies and consulates <strong>in</strong> Malaysia,<br />
Saudi Arabia, Kuwait, and S<strong>in</strong>gapore. The Indonesian<br />
Embassy <strong>in</strong> Kuala Lumpur, Malaysia, established a<br />
