Ord<strong>in</strong>ance. Dur<strong>in</strong>g the report<strong>in</strong>g period, the government<br />

convicted 65 traffickers under the Human<br />

<strong>Traffick<strong>in</strong>g</strong> Ord<strong>in</strong>ance. The government began an<br />

anti-traffick<strong>in</strong>g <strong>in</strong>vestigation of 20 major traffickers<br />

and also requested that Interpol issue arrest warrants<br />

<strong>for</strong> 22 of its nationals accused of traffick<strong>in</strong>g. In<br />

addition, Pakistan filed cases aga<strong>in</strong>st 21 government<br />

officials <strong>for</strong> complicity <strong>in</strong> traffick<strong>in</strong>g. Notably, <strong>in</strong><br />

February <strong>2007</strong>, the Federal Investigations Agency<br />

(FIA) began <strong>in</strong>vestigat<strong>in</strong>g a traffick<strong>in</strong>g case <strong>in</strong>volv<strong>in</strong>g<br />

a current Federal M<strong>in</strong>ister. Nonetheless, Pakistan did<br />

not demonstrate <strong>in</strong>creas<strong>in</strong>g law en<strong>for</strong>cement ef<strong>for</strong>ts<br />

aga<strong>in</strong>st bonded labor or other labor <strong>for</strong>ms of traffick<strong>in</strong>g.<br />

Although Pakistan has a significant bonded<br />

labor problem — estimated at over 1 million victims<br />

— the government did not provide evidence of<br />

any <strong>in</strong>vestigations, prosecutions, convictions, or<br />

sentences <strong>for</strong> bonded labor or <strong>in</strong>voluntary servitude.<br />

The government should strengthen law en<strong>for</strong>cement<br />

ef<strong>for</strong>ts aga<strong>in</strong>st such <strong>for</strong>ms of traffick<strong>in</strong>g, as well as<br />

aga<strong>in</strong>st the <strong>in</strong>ternal traffick<strong>in</strong>g of boys and girls <strong>for</strong><br />

commercial sexual exploitation.<br />

Protection<br />

This year, the government took modest steps to<br />

improve victim protection. The government requires<br />

victims to assist <strong>in</strong> the <strong>in</strong>vestigation of traffick<strong>in</strong>g<br />

cases and permits <strong>for</strong>eign victims to work pend<strong>in</strong>g<br />

the trial of their trafficker. Foreign victims reportedly<br />

are not prosecuted or deported <strong>for</strong> unlawful acts<br />

committed as a direct result of be<strong>in</strong>g trafficked, but<br />

some victims may still be subjected to prosecution<br />

<strong>for</strong> <strong>for</strong>nication, even as victims of sex traffick<strong>in</strong>g.<br />

The government does not provide victims with legal<br />

alternatives to removal to a country where they<br />

might face hardship or retribution. Government<br />

officials rout<strong>in</strong>ely refer <strong>for</strong>eign victims to a shelter<br />

operated by IOM; and, Pakistani victims can access<br />

any of 276 government centers offer<strong>in</strong>g medical<br />

treatment, vocational tra<strong>in</strong><strong>in</strong>g, and legal assistance<br />

to women and children. The government, however,<br />

lacks protection services <strong>for</strong> male victims who can<br />

neither access the IOM shelter nor the government<br />

centers. The government does not provide assistance<br />

to male or female victims of bonded and other <strong>for</strong>ms<br />

of <strong>for</strong>ced labor. Pakistan should: ensure that victims<br />

of traffick<strong>in</strong>g are not punished; rescue and protect an<br />

<strong>in</strong>creased number of victims of sex and labor <strong>for</strong>ms<br />

of traffick<strong>in</strong>g; and make available protection services<br />

to all victims of traffick<strong>in</strong>g.<br />

Prevention<br />

Pakistan made some progress <strong>in</strong> prevent<strong>in</strong>g traffick<strong>in</strong>g<br />

over the last year. In March 2006, law en<strong>for</strong>cement<br />

officers from India and Pakistan <strong>for</strong>med<br />

a work<strong>in</strong>g group to cooperate on cross-border<br />

traffick<strong>in</strong>g. Pakistan jo<strong>in</strong>ed <strong>in</strong> a similar agreement<br />

with Iran <strong>in</strong> June 2006. The government cont<strong>in</strong>ues<br />

to use technology to monitor airports <strong>for</strong> traffick<strong>in</strong>g<br />

patterns and victims. Pakistan has not ratified the<br />

2000 UN TIP Protocol.<br />

PANAMA (Tier 2)<br />

Panama is a source, transit, and dest<strong>in</strong>ation country<br />

<strong>for</strong> women and children trafficked <strong>for</strong> the purpose<br />

of commercial sexual exploitation. Colombian<br />

women and children are trafficked to or through<br />

Panama; some become victims of traffick<strong>in</strong>g<br />

<strong>for</strong> sexual exploitation after arriv<strong>in</strong>g <strong>in</strong> Panama<br />

voluntarily. Some Panamanian women have been<br />

trafficked to Jamaica <strong>for</strong> sexual exploitation. Rural<br />

children <strong>in</strong> Panama may be trafficked <strong>in</strong>ternally to<br />

urban areas <strong>for</strong> labor exploitation.<br />

The Government of Panama does not fully comply<br />

with the m<strong>in</strong>imum standards <strong>for</strong> the elim<strong>in</strong>ation<br />

of traffick<strong>in</strong>g; however, it is mak<strong>in</strong>g significant<br />

ef<strong>for</strong>ts to do so. Dur<strong>in</strong>g the report<strong>in</strong>g period, the<br />

government <strong>in</strong>tensified its ef<strong>for</strong>ts to prosecute and<br />

convict traffickers, and stepped up public awareness<br />

campaigns and prevention ef<strong>for</strong>ts. The government<br />

should commit more resources to law-en<strong>for</strong>cement<br />

activities and victim protection, and consider<br />

end<strong>in</strong>g its “alternadora” visa program which facilitates<br />

the migration to Panama of women <strong>in</strong> prostitution,<br />

some of whom fall victim to traffickers.<br />

Prosecution<br />

The Government of Panama made modest progress<br />

<strong>in</strong> <strong>in</strong>vestigat<strong>in</strong>g and prosecut<strong>in</strong>g sex traffick<strong>in</strong>g<br />

crimes dur<strong>in</strong>g the report<strong>in</strong>g period. Panama does<br />

not prohibit all <strong>for</strong>ms of traffick<strong>in</strong>g, although its<br />

Law 16 crim<strong>in</strong>alizes traffick<strong>in</strong>g <strong>for</strong> commercial<br />

sexual exploitation, which prescribes punishments<br />

of 3 to 10 years’ imprisonment; these punishments<br />

are sufficiently str<strong>in</strong>gent and commensurate with<br />

those <strong>for</strong> other grave crimes. In early <strong>2007</strong>, the<br />

government obta<strong>in</strong>ed its first conviction under Law<br />

16, result<strong>in</strong>g <strong>in</strong> a five-year sentence <strong>for</strong> the owner of<br />

a nightclub. A second sexual-exploitation prosecution<br />

is underway, and the government <strong>in</strong>vestigated<br />

five other sex traffick<strong>in</strong>g cases <strong>in</strong> 2006. In addition<br />

to assign<strong>in</strong>g three prosecutors <strong>in</strong> the Attorney<br />

General’s Office to work on anti-traffick<strong>in</strong>g cases,<br />

the government provides anti-traffick<strong>in</strong>g tra<strong>in</strong><strong>in</strong>g to<br />

all key crim<strong>in</strong>al justice personnel: police and public<br />

<strong>for</strong>ces, judges, and prosecutors. The government<br />

also works with other governments and Interpol on<br />

<strong>in</strong>ternational traffick<strong>in</strong>g cases and extradited four<br />

alleged pedophiles to the United States dur<strong>in</strong>g the<br />

report<strong>in</strong>g period.<br />
