<strong>City</strong> <strong>of</strong> <strong>Wilmington</strong><br />
(4) Covenant. To assure continuation <strong>of</strong> amenities and other public benefits built<br />
to qualify the project for bonus height allowance, the property owner must execute a<br />
covenant with the <strong>City</strong>. The covenant is required in consideration <strong>of</strong> the <strong>City</strong>'s issuing<br />
a building permit allowing additional height beyond the height permitted in the<br />
<strong>zoning</strong> for the area.<br />
(5) Requirements. The covenant must run with the land and be attached to the<br />
land. It must provide that in the event <strong>of</strong> the property owner's failure to abide by the<br />
covenant, the <strong>City</strong> is empowered to terminate occupancy <strong>of</strong> the structure and to<br />
obtain, in the name <strong>of</strong> the <strong>City</strong>, injunctive relief in a court <strong>of</strong> competent jurisdiction<br />
enjoining future occupancy <strong>of</strong> the structure while violation <strong>of</strong> the covenant exists. All<br />
covenants must be approved as to form by the city attorney and be recorded in the<br />
appropriate records <strong>of</strong> the county in which the property is located. Covenants must be<br />
recorded prior to issuance <strong>of</strong> any building permit and must specify that the owner will<br />
comply with all approved conditions, conditions listed for approval <strong>of</strong> the applicable<br />
bonus provision, and the provisions <strong>of</strong> this section.<br />
(6) Enforcement for Height Increases in Areas 1--3. In order for a certificate <strong>of</strong><br />
occupancy to be issued at completion <strong>of</strong> the building, all requirements <strong>of</strong> the height<br />
bonus must be completed, and certified by the <strong>City</strong>'s Code enforcement <strong>of</strong>ficer. In<br />
addition to the initial approval, all conditions for which the bonus was approved must<br />
remain permanently in effect. Urban parks, public parking areas and other public<br />
spaces must be available to the general public during regular hours. A permanent sign<br />
with a surface area <strong>of</strong> not less that two (2) square feet, stating that the space is open to<br />
the general public, shall be displayed in a prominent location on any public space for<br />
which a bonus is granted.<br />
(7) Replacement <strong>of</strong> Public Benefit Features. A public amenity or benefit feature<br />
may only be diminished or discontinued if the feature is replaced by another approved<br />
benefit feature <strong>of</strong> at least equivalent size or value. Approval <strong>of</strong> the replacement<br />
feature will be by the <strong>City</strong>.<br />
Where a bonus is granted for the inclusion <strong>of</strong> retail or <strong>of</strong>fice uses in a building, the<br />
following shall apply: In the event that the occupant or operator <strong>of</strong> one (1) <strong>of</strong> the<br />
public benefit features above moves out <strong>of</strong> a structure, the owner shall have a<br />
maximum <strong>of</strong> twelve (12) months after the space is vacated to replace the use with<br />
another one which meets the provisions under which the bonus was granted. If any<br />
portion <strong>of</strong> the space is not reoccupied with an approved use, another public benefit<br />
feature with equal bonus value may be substituted if approved by the <strong>City</strong>.<br />
(8) Maintenance. The building owner, lessee, management entity or authorized<br />
agent are jointly and severally responsible for the maintenance <strong>of</strong> any public parks,<br />
parking facilities or other public facilities for which a bonus has been granted. These<br />
maintenance responsibilities include, but are not limited to litter control and care and<br />
replacement <strong>of</strong> trees, shrubs and furniture. Any person violating the provisions <strong>of</strong> this<br />
ordinance shall be subject to the penalties set forth in Article 3.<br />
(9) Measurement. The vertical distance from average grade to the highest finished<br />
ro<strong>of</strong> surface in the case <strong>of</strong> flat ro<strong>of</strong>s or to a point at the average height <strong>of</strong> ro<strong>of</strong>s having<br />
a pitch <strong>of</strong> more than one (1) foot in four and one-half (4 1/2) feet.<br />
